PROJECT INFORMATION AND STAFF COMMENTS UXIIIJ "- In APPLICANT: LOCATION: SITE DATA: WATER: SEWER: ACCESS: EXISTING ZONING: ADJACENT ZONING: BOCC 912/97 Special Use Permit for a natural gas processing facility. Site Description: The subject tract is six (6) acres in size, located approximately three (3) miles southeast of Rifle, on the north side County Road 333. The site is in the north- central portion of Hunter Mesa, which slopes gently to the north. There is all existing natural gas compressor facility located on the parcel. B. Adjacent Land Uses: Land uses adjacent to and in the vicinity of the parcel are agricultural, with limited industrial (oil and gas) land uses nearby. See vicinity map, page 05—P - �* 00 1. C. Development Proposal: The applicant proposes to construct a natural gas refrigeration plant on the site, to be used in conjunction with the existing compressor facility. The addition of the refrigeration plant would enable the applicant to expand production to 30 Mmsefd, operating 24 hours /day, seven days /week. The refrigeration plant would condense natural gas into a liquefied form, which would be stored in three (3), 30,000 gallon storage vessels and transported from the site on a weekly basis. Ill. MAJOR ISSUES AND CONCERNS A. Zoning: The subject tract is 7.oned A/R/RD and the proposed use may be permitted as a Special Use, pursuant to Section 5.00 of the Zoning Resolution. As an industrial operation, specifically processing of natural resources, the applicant has submitted an impact statement that addresses the performance standards contained in Section 5.03.07: 1 ] No water would be used in processing the natural gas; however, the applicant is proposing to drill a new water well for use in an operations building. This building would be equipped with toilet facilities and an approved, individual sewage disposal system is proposed. 2] Impacts on adjacent lands are expected to be nonexistent as the nearest residence is approximately one (1) mule from the site, and all surrounding land is agricultural. The impact statement asserts that the proposed expansion would not increase generation of vapor, dust, smoke, noise, glare or vibrations, and that the facility would be operated pursuant to all applicable regulations- 31 Impacts to wildlife and domestic animals would be eliminated by surrounding the six acre site with chain link fence, which is not expected to affect migratory patterns. 41 Traffic on local roads would increase during construction of the facility-, however, after completion, the facility would Continue to be monitored twice daily, as it currently is. Other service trucks would access the site, anticipated to be on a weekly or bi- weekly frequency. 51 Land adjacent to the site is agricuitural and under the ownership of a single owner. The applicant anticipates no impacts to adjacent lands. 61 The impact statement contemplates little or no affects arising from the operation of the facility. The existing facility is operated in compliance with applicable regulations and all permits will be kept in force and updated. 7] Upon cessation of operations, the site would be rehabilitated including the removal of all fences, structures and tanks, and all disturbed areas would be revegetated, S. OwnersWn: Currently the applicant leases a one acre parcel which is proposed to be increased to a total of six acres to accommodate the refrigeration facility. The owner of the tract has signed an acknowledgment grantitl the applicant permission to install the proposed facility. See agreement, page 0 `- - . -_ .02.0 C. Water: Tile applicant is proposing to drill a well to supply the facility control room with potable and sanitary water. An application has been made to the Division of Water Resources for a commercial well, which according to the lease agreement, would also supply water for livestock. See well permit application, page f' ■ At time of building permit submittal for the proposed control room, the applicant shall include a copy of an approved well permit. If no permit is submitted, the control room shall not include lavatory facilities. D. Soils/Sewer: Wastewater generated within the control room is proposed to be treated by an individual sewage disposal system. According to the Soil conservation Service, soils are classified as a Potts loam, typically a deep, well - drained soil. When utilized for building site development and the placement of ISD systems, the soil is considered to have slight to moderate constraints, respectively. Due to slow percolation, an engineered ISD system may be required. E. Access: County Road 333, a gravel and dirt road, borders the southern portion of the site, and provides access tot he existing facility. Stair has visited the site and contemplates no site distance problems associated with this access. F. Fire Protection/Emergency Management: The applicant shall develop an emergency mitigation plan and file the plan with the appropriate fire protection district and the Garfield County Office of Emergency Management. Additionally, development of the site shall conform to wildfire mitigation policies observed by Garfield County. IV. SUGGESTED FINDINGS That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. That for the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION Staff recommends APPROVAL of the application, subject to the following conditions: That all representations of the applicant, either within the application or stated at tine 0 s. I meeting before the Board of County Commissioners, shall be considered conditions of approval. Z.. Prior to the operation of the facilities, all air pollution emission permit(s) shall be issued and operation of the facilities shall be consistent with the conditions of approval of such permit(s). Upon receipt of the permit(s), copies shall be submitted to the Planning Department for review and inclusion within the file. 3. Reclamation and revegetation of the site shall be required when the operator ceases use of the facility, in a manner that returns the site to its original, preconstruction state. If re- seeding is required, it shall occur with certified, weed -free seeds. 4, The applicant shall file an emergency plan with the appropriate fire protection district and the Garfield County Department of Emergency Management, prior to the issuance of the Special Use Permit. 5. Any out -of -state vehicles used in the construction, operation or maintenance of the facility shall be registered or apportioned in the State of Colorado. b. The Special Use Permit shall be issued upon demonstration of satisfactory compliance of all listed conditions of approval. 7. The applicant /operator of the facility shall control noxious weeds on the site. 8. The allowance for a bathroom and/or toilet facilities shall be allowed within the proposed shop/office building so long as the applicant demonstrates a Iegal water right at the time of building permit application to the County Building Department. Such application shall clearly indicate the bathroom facilities. The shop /office may be permitted without bathroom facilities. 9. The shop /office shall not be used for housing employees or agents of the applicant or operator of the facility, either temporarily or permanently. 10. The minimum defensible space distance for structures and storage tanks shall be at least 30 feet on level terrain, plus appropriate modification to recognize the increased rate of fire spread at sloped sites.
