ZONING: Resource Lands -Plateau TYPE OF APPLICATION: Limited Impact Review-Material Handling, Water Impoundment, Water Tank/Treatment Facility I. GENERAL DESCRIPTION & DISCUSSION Encana proposes the development of the Divide Road Water Treatment Facility to provide water storage and treatment for produced water generated during natural gas production from wells in the North Piceance Plateau area. Water will be transported to the site by pipeline. Water will be treated on the site and recycled and redelivered to well pads in the plateau area for use in tracing and completion activities. The facility will help avoid the need for trucking of water. Facilities on the site will include a DAF treatment building, condensate tanks, sludge tanks, pump house, five 206,000 barrel storage tanks, along with containment berms. The site is located off County Road 401, and access is planned via County Road 215 and private access roads to the site. In addition to standard requirements of the ULUR the following topics need to also be addressed by the submittals. • Evidence that produced water is non-tributary and its use is in compliance with applicable regulations (Division of Water Resources & CRS 37-90-137. • Location of wells served by the facility. • Location of conveyance network (pipelines) serving the facility, County permitting information if applicable, and easement information if pipeline alignments extend off of Encana Property. The site plan provided below reflects modifications to the original plan and preapplication summary. Access to the site has been modified, facilities/treatment reconfigured and the amount of water storage expanded (two additional tanks). k-r----fw!--r ....-~-:.;.:~-~-II. COMPREHENSIVE PLAN-SITE PLAN The site is designated in the Garfield County Comprehensive Plan 2030 as Resource Production/Natural (RPN). The Comprehensive Plan description of this use includes support building and facilities needed for the natural resource extraction industry. This description is consistent with the current proposal. The plan also notes that this designation includes areas that may have significant environmental constraints including slopes. Ill. REGULATORY PROVISIONS APPLICANT IS REQURED TO ADDRESS · • Garfield County Comprehensive Plan 2030 • Garfield County Unified Land Use Resolution of 2008, as amended (effective 8/13/12) o Article Ill, Zoning & Use Tables-Resource Lands Plateau Zone District o Article IV, Application and Review Procedures including Sections 4-104 (Limited Impact Review), Section 4-117 (Waiver of Standards), Section 4-202 (Waiver of Submittal Requirements, and Section 4-203 Submittal Requirements o Article VII, Standards-Divisions 1 and 2 and 3 as applicable o Article VII, Section 7-1101, Industrial Use Standards o Article XVI, Definitions • Colorado Department of Public Health and Environment Regulations Pertaining to Storm Water and Air Quality • Safety Regulations pertaining to emergency procedures and Spill Prevention Plans • Colorado Revised Statutes Regulations on Noise • Garfield County Building Code Permits and requirements at the time of building permit application and construction IV. Waiver Requests The Applicant has identified a number of waiver requests both from submittal requirements and standards. The Application needs to clearly address the review criteria contained in Sections 4-117 and 2-202 in justifying the requests. Where waiver's from completion of fully developed plans (i.e. landscaping plans) are the intent of the waiver request the Application should still contain general information appropriate to demonstrate compliance with the review criteria. In some cases compliance with CDPHE Regulations (i.e. stormwater drainage plans) may support waivers from similar requirements contained in the ULUR. Where technical issues are concerned (i.e. roadway standards) the Application needs to demonstrate that adequate accessibility and safety are maintained. The water supply waiver needs to demonstrate the minimal staffing requirements for the site and how an appropriate level of service will be maintained. V. REVIEW PROCESS-LIMITED IMPACT REVIEW 1. ADDITIONAL SUBMITTAL REQUIREMENTS An Application for a Limited Impact Review will also need to provide a listing of all property owners (with addresses) within 200ft., an excerpt from the Assessor's Office mapping showing the ownerships, a listing of any mineral rights owners on the property (with addresses), authorization to represent statements/letters, evidence of ownership and/or lease agreements for the site.
