Plan – Waiver Request Pursuant to Section 4-202 of the Garfield County Unified Land Use Resolution, Encana requests a waiver for the submittal requirement of a landscape plan for the
Divide Road Produced Water Treatment Facility. Pursuant to Section 4-202.C, waiver requests shall be considered based on the following criteria: 1. The Applicant shows good cause for
the requested waiver; Response: As described in the wildlife report prepared by WestWater Engineering, the affected vegetation on the project site consists of rabbitbrush and greasewood
with an understory of mixed native and non-native grasses and forbs. Native vegetation in undisturbed areas surrounding the site is composed of greasewood and sagebrush shrublands, pinyon-juniper
woodlands, and a riparian area along Parachute Creek. The vegetation removed as a result of this project is primarily aggressive native species and weedy annual species that have become
established on previously disturbed soils. Vegetation surrounding the project area will not be affected and will likely remain in its current condition. 2. The project size, complexity,
anticipated impacts, or other factors support a waiver; Response: As stated above, the vegetation that will be removed as a result of this project is primarily aggressive native species
and weedy annual species that have become established on previously disturbed soils. Surrounding vegetation would not be affected and would remain in its current condition. 3. The waiver
does not compromise a proper and complete review; and Response: A proper and complete review of a produced water treatment facility would not be compromised without a landscape plan.
4. The information is not material to describing the proposal or demonstrating compliance with approval criteria. Response: A landscape plan is not material to describing the purpose,
operation and maintenance of a produced water treatment facility or demonstrating compliance with applicable approval criteria.
