Dear Ms. Allen,
Olsson Associates, on behalf of OXY USA WTP LP (Oxy), submits the above
referenced application for review by the Garfield County Community Development
Department.
As we previously discussed, this proposed use requires an administrative review in the
Resource Land Zone Districts under the recently adopted Garfield County Land Use
and Development Code, Table 3 -403. The previous code required a Limit Impact
Review (LIR) for this type of use. The pre - application conference summary, as well as
many of the supporting documents in the application, was prepared prior to the recent
code changes. Please disregard any reference to a LIR in the application materials.
Oxy desires that this application be administratively reviewed.

TYPE OF APPLICATION: Limited Impact Review — Equipment Storage Area
I. GENERAL PROJECT DESCRIPTION
The Application proposes operation of an equipment storage area on an existing pad. The
project area is approximately 1.49 acres in size and is served by existing access roadways.
Storage of heavy equipment (loaders, graders, etc.) is proposed. Fencing may be required
to delineate the storage area. The pad is located adjacent to an existing well pad and is
covered by blanket bonds for reclamation.
Operational staff are anticipated to be on site only for delivery or pickup of equipment from
the storage yard.
II. WAIVERS
Some waivers may be appropriate given the location on an existing pad and the limited
area (if any) of additional disturbance. Potential waivers from landscaping plans, water
supply plans, and elements of the impact report were discussed. Application submissions
need to clearly request waivers and include justification based on the review criteria
contained in Sections 4 -117 and 4 -202 of the ULUR.

• CDPHE Regulations Pertaining to Storm Water Management and Air Quality as
applicable
• COGCC Regulations and/or demonstration of compliance including SPCC Plans
• Garfield County Comprehensive Plan 2030: An excerpt from the Future Land
Use Map is attached and shows the site in the Resource Production /Natural
designation.

V. SUBMITTAL REQUIREMENTS
• Submittal requirements are detailed in Article 4, Division 2, Section 4 -203 and
Table 4 -201
• Additional Submittal Requirements include: Application forms and fees,
payment agreement form, listing of all property owners (with addresses) within
200 ft., an excerpt from the Assessor's Office mapping showing the ownerships,
a listing of any mineral rights owners on the property (with addresses),
authorization to represent statements /letters, evidence of ownership.

General Application Processing
Planner reviews case for completeness and sends to referral agencies for comments. Case
planner contacts applicant and sets up a site visit. Staff reviews application to determine if
it meets standards of review. Case planner makes a recommendation of approval, approval
with conditions, or denial to the appropriate hearing body.
