HomeMy WebLinkAboutExhibit C - Staff Memo 07.10.20131 | P a g e MEMO TO: Planning Commissioners FROM: Tamra Allen, Planning Manager DATE: July 10, 2013 RE: Targeted Code Revisions, Referral Draft Background On September 4, 2012, the BOCC formally initiated the text amendment process for Phase II, Targeted Code Improvements to Improve Efficiency and Reduce Barriers to Economic Development. On March 13, 2013, the Planning Commission unanimously approved a resolution recommending and certifying to the Board of County Commissioner’s the changes to the Unified Land Use Resolution of 2008. The Board of County Commissioners began their review of the Targeted Code Improvements on May 7th and on June 17th referred the code changes back to the Planning Commission for review. The Colorado Revised Statutes 30-28-112 requires the “county planning commission to certify a copy of the plans for zoning or any part of the unincorporated county,…” or any amendment thereof. In addition, the section states that “No substantial change in or departure from the text or map so certified by the county planning commission shall be made unless such change or departure is first submitted to the certifying county planning commission for its approval, disapproval, or suggestions and, if disapproved, shall receive the favorable vote of not less than a majority of the entire membership of the board of county commissioners.” The county planning commission shall have 30 days after such submission within which to send its decision to the BOCC. Board of County Commissioner’s Modifications to the Code Included in your agenda documentation was a binder that included Articles 1 through 16. At the front of each Article are the redlined pages that the BOCC has proposed to make to the Planning Commission’s Recommendation Draft dated March 13, 2013. Each redline section is followed by the Clean version of the BOCC’s Referral Draft, dated June 17, 2013. Review and Decision As the Planning Commission, the ULUR requires the review of the proposed text amendments based upon compliance with the Review Criteria in Section 4-113.C. Applications for a text amendment shall meet the following criteria: 2 | P a g e 1. The proposed text amendment is in compliance with any applicable intergovernmental agreement, and 2. The proposed text does not conflict with State statutory provisions regulation land use. Upon the completion of the Planning Commission’s review of the BOCC’s proposed modifications, the Planning Commission should motion to recommend approve, approve with conditions (suggestions), or disapprove the text amendment inclusive of the proposed modifications made by the BOCC. In addition, the motion should include a recommendation to authorize the Chair to sign a resolution re-certifying to changes to the land use code to the BOCC. Staff has prepared a draft resolution for review.
