PRACTICAL LOCATION: Adjacent to and north of 1 -70 and west of Rulison, CO TYPE OF APPLICATION: Major Impact Review — Material Handling and Processing GENERAL PROJECT DESCRIPTION: The Applicant seeks approval of a land use change permit on a portion of a 365 acre parcel to allow for processing of petroleum contaminated soil. The soil will be transported to the site by truck, soil will be spread on the site and then treated with microbes and saw dust until such time as the contamination levels are minimized. Once the soils are acceptable for reuse they will be trucked off --site and utilized for construction of berms, access roads, and other oil and gas activities of the Applicant. The purpose of the site is to provide treatment necessary to allow for the reuse of the material. The site is located west of Rulison and north of 1 -70, however access is from the Town of Parachute and the north frontage road. A private road is then accessed from that north frontage road (Highway 6) to provide access to the project area. The original pre - application meeting discussion included impacts to groundwater, installation of monitoring wells, air quality permits, dust, screening of the site, and on -site storage of vehicles and equipment used to turn the contaminated soil during remediation treatment. In addition to the standards contained in Divisions 1, 2 and 3 of the ULUR, the site will also need to demonstrate compliance with Standards for industrial uses (Section 7- 1101). This operation is considered Material Handling and Processing which requiress a Land Use Change Permit through Major Impact Review. I. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS: • Garfield County Comprehensive Plan 2030 Applicant is required to demonstrate general conformance with the plan. • Garfield County Unified Land Use Resolution of 2008, as amended o Article IV, Application and Review Procedures • Section 4 -101 Common Review Procedures • Section 4 -105 Major Impact Review Process • Division 2 — submittal requirements and description o Article VII, Standards • General Approval Standards for Land Use Change Permits (Division 1) • General Resource Protection Standards for Land Use Change Permits (Division 2) • Site Planning and Development Standards (Division 3) • Additional Standards Applicable to Industrial Uses (Section 7 -1101) Please remember to be complete in filling out the application form, particularly regarding any request for waiver of standards or waiver of submittal requirements. II. PROCESS In summary, the process will be the following - Sections 4 -104 (B): 1. Pre - application Meeting; 2. Application Submittal (three paper copies and one CD); 3. Planner assigned and technical completeness review commences; 4. Upon a determination of technical completeness the Planning Commission Public Hearing will be scheduled, notice requirements will commence, and additional copies will be required for referral agencies; 5. Evaluation by the Director /Staff review resulting in a staff report; 6. Review and recommendation by the Planning Commission at public hearing; 7. Notice requirements provided to Applicant for public hearing with the Board of County Commissioners (BOCC); 8. Review and action by the BOCC at a public hearing; 9. Resolution memorializing the hearing is written and signature of BOCC obtained; 10. Applicant satisfies any necessary conditions of approval and a Land Use Change Permit is issued. III. APPLICATION REVIEW a. Review by: Staff for completeness recommendation and referral agencies for additional technical review b, Public Hearings: Planning Commission and Board of County Commissioners IV. APPLICATION REVIEW FEES a. Planning Review Fees: $ 525.00 b. Referral Agency Fees: $ TBD but typically includes engineer review by hour c. Total Deposit: $ 525.00 (additional hours are billed at $ 40.50 /hour) 2 General Application Processing Planner reviews case for completeness and sends to referral agencies for comments, Case planner contacts applicant and sets up a site visit. Staff reviews application to determine if it meets standards of review. Case planner makes a recommendation of approval, approval with conditions, or denial to the appropriate hearing body.
