This property, known as the Rifle Gas Plant, is under joint ownership with PSCo and Source Gas and is located in Section 12 & 13, Township 6 South, Range 94 West, Garfield County, Colorado. Although "branded" as Xcel Energy, the legal owner and operator of th e utility facilities in Colorado is Public Service Company of Colorado. All utility facilities and related land rights, including fee property, easements, permits, etc., are owned by, operated by and held in the name of Public Service Company of Colorado, a Colorado Corporation The is a new project at the Rifle Gas Plant that involves installing a prefabricated wood building to be used for materials storage. The skid mounted building is 12 ft. by 32 ft. with a 9 ft. roll up door, a 3 ft. by 3 ft. window and a 3 ft. wide passage door. A site plan showing the approximate location of the building and a photo of the proposed building is attached. PSCo is submitting this information to determine if the Special Use permit for the plant needs to be amended to allow for this modification. That proper public notice was provided as required for the hearing before the Board of County Commissioners and proof thereof submitted in the record; 2. That for the above stated and other reasons, the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that SUP is hereby approved subject to compliance with all of the following specific conditions: 1. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended, and the Colorado Department of Public Health and Environmental standards. 3. The natural gas booster compressor station shall comply with all State and Federal regulations and standards, such as Noise Abatement and Air Quality. 4. The Applicant shall comply with the Garfield County Noxious Weed Management PIau. Weed management shall take place on the entire pennitted property. Prior to completion of work of the Compressor, an inventory and mapping of any listed Garfield County Noxious Weeds shall be submitted to the Building and Planning Department. 5. The installation of the second compressor engine shall required applicable building pennits. Prior to installation of the second compressor engine, an air quality pennit shall be submitted and obtained by the Colorado Department of Public Health and Environment. 6. An application for an air quality construction permit for the second compressor engine, prior to its installation, shall be submitted and approved by the Colorado Department of Public Health and Environment. 7. At the time of building pennit submittal, the following shall be submitted for record: A. A drainage plan. 8. The following commitments shall be adhere to: A. Building lighting, inside and outside, shall be manual. Lights shall be positioned downward to minimize glare. B. The exterior color of the structure shall blend with the surrounding environment C. Emergency signage shall be posted 'and comply with County sign regnlations. D. WHEREAS, the BoardofCounty ConuniSsioners of Garfield County, Colorado, has received application from PUBLIC SERVICE OF COLORADO for constructing a natural gas transmission pipeline on the following described tracts ofland: SEEEXHmITA (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 9th day of September, 1994 upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: L That proper publication and public notice was provided as required hy law for the hearing before the Board of County ConuniSsionern .. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1918, as amended. 4; For theabovestate,d and other reasons,theproposeduse is in the best interest ofthe health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County: NOW, THEREFORE, BE ITRESOL YED by the Board of County Commissioners ofGarlie1d County, Colorado, that the Special Use Pennitbe and hereby is authorized pennitting the construction ora natural gas pipeline, upon the following specific conditions: I. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditionssetforth in the Resolution. The Special Use Pennit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use have commenced. 3. AU revegetatIon shall be conducted with certified weed-free seed. Public Service of Colorado shall beresponsible for weed control in aCcordance with State and County regulations. 4. Prior to construction, the appliCant shall obtain an excavation permit from Garfield County Road and Bridge Department, if necessary. 5. Prior to issuance of aSUP, the applicant shall submit evidence that all necessary easements have been obtained 6. The applicant shall submit approval from the Rifle Fire District prior to issuance of a ' Final SUP. 7. All vehicles shall be licensed in the State of Colorado.
