I . -'._--'-.... ~." _.c_·!~=~--\ \ A T& T proposes to construct a 40-foot stealth "monopine" telecommunications tower and associated equipment within lease areas A and B on a 1.6 acre
subject parcel. The subject site consists of the lease areas A and B along with an access and utility route identified by the hatched area on the site plan. The subject parcel has access
onto an existing road which connects to County Road 154 (CR 154). The Applicant also has secured access from the subject parcel to CR 154. The tower will support 12 panel antennas and
other miscellaneous equipment (E-911 GPS antenna, etc.) in an asphalt paved parking area at the north end of the middle single storage building of the H Lazy Z Mini Storage facility.
The type of service the tower will provide is for cellular telephone (voice and data) and will be designed to accommodate similar equipment for at least one additional wireless service
provider in the event another provider wishes to co

metal storage facility and connected to the tower by means of underground conduit. The color of the antennas, associated cabling, and mounting brackets will match the supporting structure(s)

H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL An approximately nine (9) foot tall chain link fence encloses the subject property and two (2) steel bollards will
be set at the base of the tower to protect it from vehicles within the parcel. The subject site also slopes toward the west at a one (1) percent grade. AT&T's site selection process
for the proposed facility was based on the following criteria: 1) technical performance (adequate coverage): 2) zoning and regulatory suitability: 3) property availability: and, 4) constructability.
AT&T reviewed six (6) locations for the future communication facility, see Assessment Matrix in application, along with a tower located on County Road 109 (CR 109) in the Westbank Mesa
subdivision. After assessment of the properties in and around the intended service area, H Lazy Z Mini Storage was determined to be the best location by satisfying all four criteria
listed above. This decision was based on: 1) facility's location near SH 82 and CR 154: 2) location is at the midpoint of the area it is intended to serve: 3) location is among fairly
tall trees which provides screening from most vantage points along SH 82: 4) availability of self storage units for concealing radio equipment: and, 5) absence of other suitable nearby
structures for co-location. The communication facility has a 25 year lease with the land owner. After this time frame the lease will be on a year to year basis. II. LOCATION AND SITE
DESCRIPTION This site is located off of an existing road and southwest of the intersection of County Roads 154 and 114 and State Highway 82. III. ZONING AND ADJACENT USES Surrounding
properties are zoned Commercial-Limited and land uses consist of a mixture of light industrial and single family residential. IV. REFERRAL AGENCIES Comments have been requested from
the following agencies and comments received are integrated throughout this report as applicable. Garfield County Road and Bridge Department (Exhibit G): This department has no issues
with this application. Garfield County Vegetation Management (Exhibit H): This department has no comments on this application. Garfield County Public Health (Exhibit I): This department
has no comments on this application. Colorado Department of Transportation (Exhibit J): This department has no comments on this application. Carbondale & Rural Fire Protection District
(Exhibit K): This agency has no issues on this application. Mountain Cross Engineering. Inc. (Consulting Engineer-Exhibit Ll: This consultant had no comments. 3
H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL Colorado Division of Wildlife -No comments received. V. REVIEW STANDARDS & STAFF COMMENTS Limited Impact Reviews are
required to adequately address topics in Section 4-502(D) Land Suitability Analysis, Section 4-502(E) Impact Analysis, the general development standards found in Article VII with specific
attention to Section 7-823 which are additional standards applicable to Telecommunication Facilities as codified in the Garfield County Unified Land Use Resolution of 2008, as amended
(ULUR). The following section provides a review of those standards in bold italics followed by a Staff Response. A. Section 4-502/E\ Land Suitability Analysis 1. Public Access to Site.
Show historic public access to or through the site. Staff Response: The site is accessed by an existing road which obtains access from CR 154. 2. Access to adjoining Roadways. Identify
access to adjoining roads and site distance and intersection constraints. Staff Response: The site is accessed off of an existing road and doesn't appear to be any constraints regarding
access or intersections in the vicinity of this proposal. Road & Bridge had no issues with the facility. 3. Easements. Show all easements defining, limiting or aI/owing use types and
access. Staff Response: All easements are described. The proposed facility will not impact existing easements found on the site. 4. Topography and Slope. Topography and slope determination.
Staff Response: There are no topographic issues related to the proposed location of the communication facility. 5. Natural Features. Significant natural features on-site and off-site.
Staff Response: No significant natural features are in the vicinity. 6. Drainage Features. Existing drainages and impoundments, natural and manmade. Staff Response: The only drainage
feature is a grassed drainage swale that is located outside the subject parcel's security fence along the east perimeter of the property. The communication facility will be located downhill
of this feature and will not impact the ditch. 7. Water. Historic irrigation, tai/water issues, water demands, adequate water supply plan pursuant to Section 7-104. Staff Response: The
proposed facility is unmanned therefore provision of water is not applicable. 8. Floodplain. Flood plain and flood fringe delineations. Staff Response: The site is not located within
a mapped floodplain. 9. Soils. Soils determination, percolation constraints, as applicable. Staff Response: A Subsoil Study prepared by HP Geotech (dated 12/16/10) indicates that the
subsoils consist of dense silty sandy gravel, cobbles, and boulders. This report recommends a spread footing for these subsoil conditions. 4

11. Natural Habitat. Existing flora and fauna habitat, wetlands, migration routes. Staff Comment: The proposed site consists of a storage building and asphalt pavement. No existing flora
or fauna habitat, wetlands, or migration routes are impacted by this application. 12. Resource Areas. Protected or Registered Archaeological, cultural, paleontological and historic resource
areas. Staff Comment: The proposed site consists of a storage building and pavement. Section 4-502(E) Impact AnalYsis. The Impact Analysis shall provide a description of the impacts
that the proposed land use change may cause, based upon the standards that the proposed use must satisfy. The Impact Analysis shall include a complete description of how the applicant
will ensure that impacts will be mitigated and standards will be satisfied. The following information shall be included in the Impact Analysis. 1. Adjacent Property. An address list
of real property adjacent to the subject property, and the mailing address for each of the property owners. Staff Comment: A list was provided of adjacent property owners along with
mailing addresses for each. 2. Adjacent Land Use. Existing use of adjacent property and neighboring properties within 1500' radius. Staff Comment: Existing use of property within 1,500
feet is residential and light industrial. 3. Site Features. A description of site features such as streams, areas subject to flooding, lakes, high ground water areas, topography, vegetative
cover, climatology, and other features that may aid in the evaluation of the proposed development. Staff Comment: The site is located over 1,000 feet east of the Roaring Fork River.
The subject parcel consists of pavement and storage buildings. The elevation of the subject parcel is approximately 5,960 feet above sea level. 4. Soil Characteristics. A description
of soil characteristics of the site which have a significant influence on the proposed use of the land. Staff Comment: A Subsoil Study prepared by HP Geotech (dated 12/16/10) indicates
that the subsoils consist of: dense silty sandy gravel, cobbles, and boulders. This report recommends a spread footing for the subsoil conditions. 5. Geology and Hazard. A description
of the geologic characteristics of the area including any potential natural or man-made hazards, and a determination of what effect such factors would have on the proposed use of the
land. Staff Comment: No geological hazards have been identified. 6. Effect on Existing Water Supply and Adequacy of Supply. Evaluation of the effect of the proposed land use on the capacity
of the source of water supply to meet 5

7-104. Staff Comment: The site is unmanned therefore provision of water is not applicable. 7. Effect on Groundwater and Aquifer Recharge Areas. Evaluation of the relationship of the
subject parcel to floodplains, the nature of soils and subsoils and their ability to adequately support waste disposal, the slope of the land, the effect of sewage effluents, and the
pollution of surface runoff, stream flow and groundwater. Staff Comment: The limited area of disturbance will not adversely impact any of the above criteria. No water or wastewater will
be used or generated by this facility. 8. Environmental Effects. Determination of the existing environmental conditions on the parcel to be developed and the effects of development on
those conditions, including: a. Determination of the long term and short term effect on flora and fauna. Staff Comment: The site consists of buildings and asphalt pavement. b. Determination
of the effect on significant archaeological, cultural, paleontological, historic resources. Staff Comment: The site consists of buildings and asphalt pavement. c. Determination of the
effect on designated environmental resources, including critical wildlife habitat. (1) Impacts on wildlife and domestic animals through creation of hazardous attractions, alteration
of existing native vegetation, blockade of migration routes, use patterns or other disruptions. Staff Comment: The site consists of buildings and asphalt pavement. d. Evaluation of any
potential radiation hazard that may have been identified by the State or County Health Departments. Staff Comment: To ensure that routine exposure to a cell site is safe, the FCC regulates
the level of radio frequency that a site may emit. e. Spilf' Prevention Control and Counter Measures plan, if applicable. Staff Comment: The construction of this facility is proposed
to occur on an existing paved commercial site. The limited area of disturbance will cause minimal impact. The equipment located in the storage unit will contain battery electrolyte which
is found in the backup batteries. These batteries will be housed in the storage unit and located in a polyvinyl catch basin of greater volume that the batteries. Best Management Practices
include monitoring alarms to notify maintenance personnel in the event of a battery leak or power loss. 9. Traffic. Assessment of traffic impacts based upon a traffic study prepared
in compliance with Section 4-502(J). Staff Comment: A temporary increase in traffic will occur during construction of the facility, a maximum of five (5) trips per day for approximately
1.5 months. After construction, the proposed use will be accessed by one (1) vehicle per month. 6
H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL 10. Nuisance. Impacts on adjacent land from generation of vapor, dust, smoke, noise, glare or vibration, or other
emanations. Staff Comment: The proposed communication facility is not anticipated to cause nuisance impacts to adjacent land. Performance standards are applicable to this site. 11. Reclamation
Plan. A reclamation plan consistent with the standards in Section 7-212. Staff Comment: The parcel in which the site is located is entirely paved and will result in minimal disturbance.
The property presently has sufficient drainage and the proposed facility will not affect the existing drainage. No revegetation security is recommended by the County's Vegetation Manager
due to the location of the facility in a paved mini storage facility. B. Section 7-100 GENERAL APPROVAL STANDARDS FOR LAND USE CHANGE PERMITS 1. Section 7-101 Compliance with Zone District
Use Restrictions Staff Comment: Communication Facilities are permitted by Limited Impact Review in the Commercial -Limited Zone District. 2. Section 7-102 Compliance with Comprehensive
Plan and Intergovernmental Agreements Staff Comment: The proposal generally conforms to the Comprehensive Plan. 3. Section 7-103 Compatibility Staff Comment: A communication facility
is a compatible use with activity occurring in the general area. 4. Section 7-104 Sufficient Legal and Physical Source of Water Staff Comment: No water is proposed to be provided since
the facility will be unmanned. 5. Section 7-105 Adequate Water Supply Staff Comment: Not applicable. 6. Section 7-106 Adequate Water Distribution and Wastewater Systems Staff Comment:
Not applicable. 7. Section 7-107 Adequate Public Utilities Staff Comment: The utilities proposed to be provided are adequate. 8. Section 7-108 Access and Roadways Staff Comment: Access
is sufficient for the proposed use. The Applicant has access from CR 154 to the subject parcel and an access easement within the subject property. 9. Section 7-109 No Significant Risk
from Natural Hazards Staff Comment: No significant risk has been identified. 7
H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL C. Section 7-200 GENERAL RESOURCE PROTECTION STANDARDS FOR LAND USE CHANGE PERMITS 1. Section 7-201 Protection of
Agricultural Lands Staff Comment: The Garfield County Important Farmlands identifies this parcel as not being agricultural land. 2. Section 7-202 Protection of Wildlife Habitat Areas
Staff Comment: The entire parcel is paved and covered by buildings. No comments were received by the Colorado Division of Wildlife. 3. Section 7-203 Protection of Wetlands and Waterbodies
Staff Comment: There are no wetlands on-site or in the immediate area. The only drainage feature is a grassed drainage swale that is located outside the subject parcel's security fence
along the east perimeter of the property. The communication facility will be located downhill of this feature and will not impact the ditch. 4. Section 7-204 Protection of Water Quality
from Pollutants Staff Comment: No adverse impacts to water quality will result from this use. 5. Section 7-205 Erosion and Sedimentation Staff Comment: The site is paved. No erosion
or sedimentation is anticipated. 6. Section 7-206 Drainage & Section 7-207 Storm water Run-Off Staff Comment: The site is paved. No erosion or sedimentation is anticipated. 7. Section
7-208 Air Quality Staff Comment: Minimal air quality impacts will result from the proposed use. The site will be required to meet County performance standards throughout the use of the
facility. 8. Section 7-209 Areas Subject to Wildfire Hazards Staff Comment: The Garfield County Wildfire Hazard Map identifies this area as low wildlife hazard. 9. Section 7-210 Areas
Subject to Natural Hazards and Geologic Hazards Staff Comment: There do not appear to be any natural or geologic hazards that would be affected by or impact the proposed facility. 10.
Section 7-211 Areas with Archeological, Paleontological or Historical Importance Staff Comment: The site is paved. 11. Section 7-212 Reclamation Staff Comment: The parcel in which the
site is located is entirely paved and will result in minimal disturbance. The property presently has sufficient drainage and the proposed facility will not affect the existing drainage.
No revegetation security is recommended due to the location of the facility in a paved mini storage facility. D. Section 7-823 ADDITIONAL STANDARDS -COMMUNICATION FACILITIES A. Shared
Facilities. Shared use/co-location of wireless communication facilities on existing structures, towers or buildings in a manner that precludes the need for the 8
H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL construction of a freestanding structure of its own shall be utilized unless it can be demonstrated to the satisfaction
of the Board of County Commissioners that shared use/co-location is not feasible or practical. Staff Comment: AT&T indicates in their application that no suitable structure, tower, or
building exists within the service area was found that they could share use or co-locate their proposed facility. AT&T investigated seven (7) sites to locate their communication facility
and of these sites two (2) had the potential of co-location. These sites include: 1) an existing monopine stealth antenna facility located at 3240 Coryell Ridge Road; and, 2) a KN Energy
facility located off of and adjacent to CR 109 in the Westbank Mesa subdivision. The first facility is approximately 55 feet tall with two (2) arrays of antennas; one at 45 feet; and,
the second at 35 feet in height. Based on the facility's age and design, it was concluded that this structure isn't engineered to accommodate the weight and wind loads associated with
additional equipment. Furthermore, the transmission north from antennas located at 25 feet on this structure is blocked by the nearby two-story residence. The only possible solution
for this site would be to replace the current monopine with a 75 to 80 foot taller pole, resulting in greater visual impacts than would be associated with AT&T shorter proposed design
at the subject site. Co-locating on the second facility in Westbank Mesa is also not desirable since it is located along a hillside and only gets approximately 180 degrees of coverage
unlike the H Lazy Z site which is relatively flat and capable of having 360 degrees of frequency coverage. B. New Towers and Facilities. No new transmission tower or facility shall be
permitted unless the applicant demonstrates to the satisfaction of the County that no existing tower, structure or utility facility can be used by the applicant. To gain approval to
construct a new transmission tower or facility, the applicant must demonstrate that: 1. No existing transmission tower, facility or utility structure is located within a distance which
meets the applicant's engineering requirements; or 2. No existing transmission tower, facility or utility structure is located within a distance which meets the applicant's engineering
requirements and which has sufficient structural strength or space available to support the applicant's telecommunication facility and related equipment; or 3. The applicant's proposed
telecommunication facility will not cause unreasonable electromagnetic or other interference with the antennas on existing towers, structures or utility structures or the antennas of
existing transmission towers, facilities or utility structures or that such existing facilities would interfere with the applicant's uses such that co-location is not possible; or 4.
No owner of existing towers, structures or utility structures, within a distance that meets the applicant's engineering requirements, will allow the applicant to place its telecommunication
facility thereon. 9
H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL Staff Comment: The Applicant has adequately demonstrated compliance with these standards. C. Structural and Engineering
Standards. The applicant shall submit evidence conceming structural and engineering standards prepared by a qualified professional engineer licensed by the State of Colorado. The safety
of the property and the neighborhood shall be protected. Staff Comment: A Structural Design report prepared by a licensed engineer with Black and Veatch (dated 6/10/11) has been provided
in the application regarding the design of the tower. D. Interference. Every transmission tower and telecommunication facility shall meet the regulations of the Federal Communications
Commission (FCC) regarding physical and electromagnetic interference. Staff Comment: This will be regulated by the FCC. Eo Health Standards. Transmission towers and telecommunication
facilities shall meet applicable health and safety standards for electromagnetic field (EMF) emissions as established by the FCC and/or any other federal or state agency having jurisdiction.
Staff Comment: This will be regulated by the FCC. F. Public Utility Structures. Transmission towers or telecommunication facilities mounted on existing structures of public utilities
that have a franchise or other written permission from the County and use concealed transmission towers and telecommunication facilities are permitted in all non-residential zoning districts,
unless otherwise specified by this Code. The County may approve the placement, extension or replacement of a transmission tower or telecommunication facility on an existing public utility
structure up to fifty (50) feet above the highest point on the same; the County may waive public notice and other submittal requirement if the Director believes that the public interest
will not be harmed by such a waiver. Staff Comment: Not applicable. G. DeSign, Materials and Color. Transmission towers and telecommunication facilities shall be designed and maintained
to minimize visual impact; carry gravity and wind loads required by law; and concealment or stealth methods, such as camouflaging transmission Towers to look like light poles or trees
are encouraged. At a minimum, the transmission towers and facilities shall meet the following design standards: 1. Architecturally integrated with existing buildings, structures and
landscaping, including height, color, style, massing, placement, design and shape. Staff Comment: As a monopine the proposed facility is intended to blend into the area's overall tree
canopy especially from vantage points along SH 82. 2. Located on existing vertical infrastructure such as utility poles and public building or utility structures. 10
H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL Staff Comment: AT&T indicates that there are no structures or buildings were found suitable in the area. 3. Roof mounted
antennas shall be located as far away as feasible from the edge of the building. Antennas attached to the building should be painted or otherwise treated to match the exterior of the
building. Staff Comment: Not applicable. 4. Equipment shelters and antennas shall not extend more than ten (10) feet from the top of the building unless expressly approved by the County.
Staff Comment: Not applicable. 5. Located in areas where the existing topography, vegetation, buildings or other structures provide screening. Staff Comment: The facility color and design
will blend with the landscape. H. Landscaping and Screening. The property on which a telecommunication facility or tower is located shall be landscaped and screened, in accordance with
the following standards: 1. A free-standing transmission tower or telecommunication facility shall include landscaping planted and maintained according to a landscaping plan approved
by the County. 2. A freestanding transmission tower or telecommunication facility shall be surrounded by a six (6) foot high wall or fence or other suitable buffer yard. Chain link with
slats shall not constitute acceptable fencing nor shall it satisfy the screening requirement. Staff Comment: AT&T requests a waiver from this requirement since all equipment is housed
in a storage unit, all utility connections are located underground, and the mono pine mimics a tree. Also, the placement of landscaping in a paved area that is used as a driveway isn't
conducive to landscaping. I. Lighting and Signage. Only lighting required by a federal agency is allowed. Only signage that is required by state or federal law is allowed. No advertising
shall be permitted. Staff Comment: The Applicant will comply with these standards. J. Free Standing Transmission Tower or Telecommunication Facility Equipment Bui/ding(s) or Cabinet(s).
Exterior tower or telecommunication facility equipment building(s) or cabinet(s) shall not contain more than four hundred (400) square feet of gross floor area, shall not be more than
twelve (12) feet in height, and shall maintain the minimum setback, landscaping and screening requirements of the zone in which it is located. Staff Comment: All equipment will be located
in a storage unit. 11
H Lazy Z Mini Storage, LLC Communication Facility 09/12/11 BOCC MOL K. Modification or Demolition. Any transmission tower or telecommunications facility being modified, demolished or
rebuilt shall be in compliance with the standards adopted in this Code. Staff Comment: Not applicable. L. Maintenance. Every owner of a transmission tower or telecommunications facility
shall take special care to operate, repair and maintain all such facilities so as to prevent failures and accidents which cause damage, injuries or nuisances to the neighborhood and
public. All wires, cables, fixtures and other equipment shall be installed in compliance with the requirements of the National Electric Safety Code and all FCC, FAA, state and local
regulations, and in such a manner that will not interfere with radio communications, electronic transmissions or all other electromagnetic communications or otherwise cause a safety
hazard. Staff Comment: AT&T states they will sufficiently maintain this facility. M. Review. Each new tower or facility shall be subject to a two (2)-year review by the Director. The
review will determine whether or not the originally approved number of antenna and design are still appropriate and necessary to provide adequate communications services. Staff Comment:
AT&T states that they will make the site available for inspection upon request. N. Abandonment. The wireless telecommunication facility owner shall remove all wireless telecommunications
facilities which are not in use for any six (6)-month period, within three (3) months of the end of such six (6) month abandonment. As a part of such removal, the owner shall re-vegetate
the site so that it is compatible with the neighborhood. The Board of County Commissioners shall only determine abandonment after the owner has had notice and an opportunity to be heard.
Staff Comment: The proposed facility has a lease with the property owner for a period of 25 years and then on a year to year basis. AT&T agrees to removing all telecommunication facilities

has a "determination of no hazard to air navigation". P. Telecommunications Act. All telecommunications facilities shall comply with the standards of this Code, all applicable standards
of the Federal Telecommunications Act of 1996, and all applicable requirements of the Federal Aviation Administration (FAA). Staff Comment: The Applicant has provided in the application
two FAA Determination letters stating that determination of no hazard to air navigation. VI. SUGGESTED FINDINGS Should the BOCC decide to approve the request for H Lazy Z Mini Storage,
LLC Communication Facility, Staff suggests the BOCC make the following findings: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners,
2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all
interested parties were heard at that meeting. 3. That for the above stated and other reasons, the Land Use Change Permit for a Communication Facility is in the best interest of the
health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County if recommended conditions of approval are required. 4. That the application can
be in conformance with the applicable Sections of the Garfield County Unified Land Use Resolution of 2008, as amended, if recommended conditions of approval are required. VII. STAFF
RECOMMENDATION Staff recommends the Board of County Commissioners approve the request for a Land Use Change Permit for a Communication Facility to be operated by AT&T Mobility, LLC on
a property owned by H Lazy Z Mini Storage, LLC located in Section 1, Township 7 South, Range 89 West of the 6th P.M. in Garfield County with the following conditions: 1. That all representations
made by the Applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless specifically altered by the Board
of County Commissioners; 2. The operation of this facility shall be done in accordance with all applicable Federal, State and Local regulations governing the operation of this type of
facility; 3. The facility shall be required to comply with the following standards: a, The facility shall be operated so that the ground vibration inherently and recurrently generated
is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located, b. Site operations shall not emit heat, glare, radiation, dust

comply with the standards set forth in the Colorado Revised Statutes. e. All lighting associated with the property shall be directed inward and downward towards the interior of the property.
VIII. RECOMMENDED MOTION I move to approve a Land Use Change Permit through the Limited Impact Review for a "Communication Facility" on .07 acres, on property owned by H Lazy Z Mini
