ZONING PARCEL ID I SIZE I. REQUEST This application was deemed 'technically complete' before December 31, 2008, and hence is being considered under the 'Old Code', the Zoning Resolution
of 1978. As Amended. The application is to consider a Special Use Permit for a Contractor's Yard whose main purpose is store heavy equipment on a residential property in the A1R/RD Zone
district. The Applicants seek permission to utilize a small portion of their property (11,000 sq. ft.) for parking heavy trucks, trailers, implements, storing straw and utilize an existing
enclosed garage for storage and minor repair. Augustus & Jennifer Hampson operate Rocky Mountain Environmental Concerns (RMEC). No employees work on-site. The employees that are assigned
to drive the equipment to the site arrive and park their personal vehicles or carpool vehicle in an area adjacent to the garage, then drive to job sites with the equipment. (Once the
equipment is on the job, it generally stays on the job site and employees commute to the job site rather than 1177 Jewell Lane.) Special Use Permit to allow a Contractor's Yard in the

shall be approved or denied by the BOCC after holding a public hearing thereon in conformance with all provisions of the Zoning Resolution. III. BACKGROUND OF PROCESS Section 9.02.03
Zoning Resolution of 1978, as amended, states that the BOCC may refer a request for SUP to the Planning Commission for its review and recommendation. A referral memo was generated and
presented to the BOCC; the application was not referred to the Planning Commission. IV. ZONING & ADJACENT USES The parcel is zoned ARRD, as are the surrounding parcels, excepting the
BLM parcel. The subject parcel is 36.36 acres. Map indicates that the adjacent parcels range from 21 to 113 acres in size: • (380) Shepherd-36 acres, • (285) Bailey, occupied by tenant

BOCC 07/6/2009 DD Contractors Yard Definition: "The use of land for the purpose of storing machinery, equipment and supplies for an individual business that provides services to clients
through the use of the machinery, equipment or supplies. Such use may include office and repair facilities. " The application must satisfy the requirements set forth in Sections 5.03,
5.03.07 and 5.05.08. § 5.03 Review Standards (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County
Commissioners shall either be in place or shall be constructed in conjunction with the proposed use; Staff Finding Applicant states that there Will be a minimum of water usage related
to the vehicles as the minor maintenance is generally component replacement and storage of the vehicle onsite. No vehicle washing or major mechanical repairs are proposed on site. The
proposed Contractor's Yard operation will utilize an existing residence for any sanitary or office purposes, and has no employees working on site. The existing well and ISDS are adequate.
(2) Street Improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed
in conjunction with the proposed use; Staff Finding A traffic analysis was provided, compiled by the consultant. It states that the vehicle storage generates a maximum of 10 trips per
day coming from the site, with generation even lower in the winter. The trip generation total did not include trips by one personal vehicle associated with the truck storage use. It
is stated that the trips generated from the site vary; there is more activity during springl summer/fall, and less during winter. During winter it is estimated that the company has 3
staffers, as opposed to the full complement of up to 7 summer seasonal workers. Staff feels that this estimate is low. It is stated that employees travel in their personal to the job
site once the equipment has been delivered there. However, the equipment must be transported to the job-site, and that action requires employee come to the subject parcel and drive the
company vehicles with equipment to the job site. If the average job lasted one week, there would be 5 pickup trips out, 5 back in for two days (20). Employees ride-sharing in 3 vehicles
would travel to the subject parcel at least 3 days, -5 -
BOCC 07/6/2009 DO twice daily (18), and a straw delivery may occur to the subject parcel (2). In addition, the standard residential trip rate of 10 vehicle trips per day for the parcel
needs to be considered (50) less the trips by the residents ferrying their equipment (20). 20+18+2+30=7070 trips per 5-day work-week averages 14 trips per day. The cumulative trip generation
from a residence is estimated at 9.85 trips by the Institute of Traffic Engineers (ITE). The Special Use would increase trip generation, but not with significantly high count totals,
and mitigation measures to address the adverse effects of road surface and dust abatement are recommended by Staff as conditions of approval. Staff referred this application to Garfield
County Road and Bridge Department (Road and Bridge). General Comments: Garfield County Road and Bridge Department has no objections to this application with the following comments. A
driveway access permit shall be provided or proof that one has been issued for the access road leading to the Hampson property. If one cannot be provided a new driveway access permit
shall be applied for. A stop sign shall be installed at the driveway access to Cr. 259 as the driveway access will be used as a commercial access. The stop sign and installation shall
be as reguired in the MUTCD (Manual on Uniform Traffic Control Devices. The stop sign shall be the 3D-inch size. All vehicles hauling eguipment and materials for this operation shall
abide by Garfield County's oversize/overweight system. The legal weight restriction for Cr. 259 is 80. 000 pounds for 5-Axel vehicles and 54.000 for 3-axel vehicles. All vehicles exceeding
this weight limit or the state legal oversize reguirements shall have an oversize/overweight permit from Garfield County. Any vehicles reguiring oversize/overweight permits shall apply
for them at Garfield County Road and Bridge Department. Name of review agency: Garfield County Road and Bridge Dept By: Jake B. Mall Date May 4, 2009 Staff recommends that the recommendations
of Garfield County Road and Bridge be incorporated as conditions for the permit. (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through
installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as
to protect established neighborhood character; Staff Finding Adjacent uses include vacant Federal land (BLM), residences with accessory agricultural use, residences with personal vehicles
for business use (pickup trucks), vacant agricultural parcels, and vacant agricultural parcels with unpermitted habitation and heavy equipment. The operation of a Contractor's Yard on
the subject property is consistent -6-
Boee 07/6/2009 DO with the existing adjacent uses, if adequately mitigated with conditions. There is a minimum of outdoor lighting and no additional lighting is proposed as part of this
permit. The use requested as part of this Special Use Permit is for truck storage onsite, but there is some minor maintenance associated with the trucks, namely minor maintenance and
component replacement. Major work and washing are not performed on-site. Activities that would generate noise, vapor, fumes, glare, vibration, etc. are to be performed to comply with
State, Federal and local standards, and will generally be contained inside the existing garage structure. Screening in the form of an earthen berm exists on site. Straw material that
arrives periodically is directly related to an on-going RMEC project and is generally processed within two weeks. A set of concrete 'Jersey' barriers left from a job have been made available
for sale and are not intended to remain on-site indefinitely. Access comments from GarCo Road & Bridge Department (Exhibit H) shall be considered conditions of approval. Section 5.03.07
Industrial Operation The applicant for a permit for industrial operations shall prepare and submit to the Planning Director ten (10) copies of an impact statement on the proposed use
describing its location, scope, design and construction schedule, including an explanation of its operational characteristics. One (1) copy of the impact statement shall be filed with
the County Commissioners by the Planning Director. The impact statement shall address the following: (1) Existing lawful use of water through depletion or pollution of surface run-off,
stream flow or ground water; Staff Finding There is little or no run-off or water use associated with any vehicle repair and maintenance activity, as washing the vehicles is not permitted
and there are no employees working on-site to require additional sanitary facilities. The standard Spill Containment and Cleanup Management Plan developed by this planner and Jim Rada,
Director, Garfield County Environmental Health Department, shall be required as a condition of approval. Recommendations from GarCo Environmental Health Department (Exhibit I) and Rifle
Fire Protection District (Exhibit K) shall be considered as conditions of approval. (2) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration,
or other emanations; Staff Finding Noise generated by the proposed use must be within the parameters for the existing residential neighborhood to comply with State Statute 25-12-103,
so as to not compromise the residential character of the neighborhood. -7 -
Boee 07/6/2009 DD The residential! agricultural nature of the neighborhood and adjacent uses would allow for a daytime dbA of 55 (7 am to 7 pm) and 50 dbA at night (7 pm to 7 am). Noise
level may exceed the Residential level of 55 daytime by no more than 10 db(A) not to exceed 15 minutes in anyone-hour period. Noise generated by the proposed use is shown to be within
the parameters for the existing residential neighborhood to comply with State Statute 25-12-103. A sound analysis has been performed by the Applicant using the loudest piece of equipment.
The readings were within the Residential noise parameters. The Applicant reports that the equipment does not sit idling on the property asjt is contrary to the wellbeing of the diesel
engine, and wastes fuel. Staff feels that the potential noise source would be the parking area, and the noise generated would be starting, loading or off-loading equipment-a temporary
noise generation. Requirements of the State statute allow fora temporary and short term reading to be beyond the Residential level, and Staff anticipates that conditions of approval
for the operation could be applied so that the operation did not exceed the State statute for noise. It shall be a condition of approval for the permit that this use can be operated
within the parameters of the State statute 25-12-103. (3) Impacts on wildlife and domestic animals through the creation of hazardous attractions, alteration of existing native vegetation,
blockade of migration routes, use patterns or other disruptions; Staff Finding Because the existing truck storage use has been on-going, the Applicant has put in place a storage yard
near the edge of the parcel that allows the rest of the parcel to be managed for agriculture and open space. The parcel's condition and the plan submitted in regard to weed management
has given confidence to Vegetation Management Department Director Steve Anthony that no reclamation security is necessary and their plan is adequate. (Statement is included in Exhibit
J.) No comments were received from the Division of Wildlife (DOW). It is the understanding of Staff that wildlife are more apt to utilize the open area on the property because there
is little human activity there, but more as a corridor through the parcel as there is not much vegetation to sustain them there. The contractor's yard use is centered in, and adjacent
to, the garage building, and the business activity is performed off-site, so there would be little disturbance to wildlife. Because the equipment is being used on a very regular basis,
it does not become an attractant to wildlife seeking shelter, namely rodents. Staff recommends that any new fencing on the parcel comply with the DOW's 'wildlife friendly' fence standards
as a condition of approval. (4) Affirmatively show the impacts of truck and automobile traffic to and from such uses and their impacts to areas in the County; -8 -
eocc 07/6/2009 00 Staff Finding The proposed Contractor's Yard is located off County Road 259 (Jewell Lane). GarCo Road and Bridge Department comments (Exhibit H) state: Regarding access
and signage: A driveway access pennit shall be provided or proof that one has been issued for the access road leading to the Hampson property. I f one cannot be provided a new driveway
access penn it shall be applied for. A stop sign shall be installed at the driveway access to Cr. 259 as the driveway access will be used as a commercial access. The stop sign and installation
shall be as required in the MUTCD (Manual on Unifonn Traffic Control Devices. The stop sign shall be the 3~-in ch size. Regarding vehicle permits and impact assessment: All vehicles
hauling equipment and materials for this operation shall abide by Garfield County's oversize/overweight system. The legal weight restriction for Cr. 259 is 80, 000 pounds for 5-Axel
vehicles and 54,000 for 3-axel vehicles. All vehicles exceeding this weight l imit or the state legal oversize requirements shall have an oversize/overweight penn it from Garfield County.
Any vehicles requiring oversize/overweight pennits shall apply for them at Garfield County Road and Bridge Department. These comments shall be made a condition of approval. Further,
this permit is not being sought to attract additional vehicles to the site (the permit is requested to accommodate only the vehicles listed and described in number as part of the application
(listed in 5.03.0B.4.d.) and the limited carpool vehicles that are used by the employees to get to the site. Staff recommends that as a condition of approval no more than 2 vehicles
be allowed to park on-site for the transport of employees to the Contractor's Yard site. The Applicant states that they have performed ongoing voluntary maintenance to the road surface,
and most of the citizen comments adverse to permitting this use mention potential damage to the driving surface. There is an effect from heavier vehicles traveling on Jewell Lane, and
the County road system. Those owners of property that use heavier vehicles should contribute a greater share for its maintenance, and should work in concert with Road and Bridge to ensure
that their impacts are not to the detriment of the neighborhood. However, as there is no assessment mechanism in place for this at the present time beyond the permits for oversize/overweight,
so that will be the condition recommended by Staff. To help ensure safe operations and courtesy in the residential neighborhood in which the use permission is to be sited, Staff also
recommends that the Applicant hold a safety meeting no less than annually with all employees, with documentation (employee/employer signatures) to be maintained on file for a period
of one year. (5) That sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed users); -9 -
BOCC 07/6/2009 DD Staff Finding While the Contractor's Yard area is separated from the adjacent parcel boundary by a 500-foot distance, it is not separated from the Applicant's residential
structure by that required distance of 300 feet. While the distance does not meet the requirements set forth in the Code, the Applicant is choosing to reside within 300' of the Contractor's
Yard, and it does satsfy the distance requirements from adjacent residences. The operation of a Contractor's Yard is not expected to adversely affect adjacent uses. Letters from potentially
affected residents are included in the application (Exhibits L-S). Permits may be granted for those uses with provisions that provide adequate mitigation for the following: 1) A plan
for site rehabilitation must be approved by the County Commissioners before a permit for conditional or special use will be issued; 2) The County Commissioners may require security before
a permit for special or conditional use is issued, if required. The applicant shall furnish evidence of a bank commitment of credit, bond, certified check or other security deemed acceptable
by the County Commissioners in the amount calculated by the County Commissioners to secure the execution of the site rehabilitation plan in workmanlike manner and in accordance with
the specifications and construction schedule established or approved by the County Commissioners. Such commitments, bonds or check shall be payable to and held by the County Commissioners;
3) Impacts set forth in the impact statement and compliance with the standards contained in Section 5.03.08 of this Resolution. Staff Finding Because the use on-site is limited to minor
maintenance, limited storage of components and equipment that is adequately screened I enclosed, the use is proposed to be administrated by conditions set forth by the BOCC in the SUP,
and there is an annual report letter to the fire service provider required as part of the SCCMP, Staff feels that no additional security or permits are necessary. §5.03.08 Industrial
Performance Standards (1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made; Staff Finding
The use is proposed to be contained within an enclosed structure, with the parking area located at a point approximately 500' from the southern property line and 550' from the western
property line. The operation shall comply with the noise standards cited in -10-
SOCC 07/6/2009 DO Colorado Revised Statutes (CRS) 25-12-103 for the Residential zone. A decibel level is measured at 25 feet from a property line. The residential! agricultural nature
of the neighborhood and adjacent uses would allow for a daytime dbA of 55 (7 am to 7 pm) and 50 dbA at night (7 pm to 7 am). Noise level may exceed the Residential level of 55 daytime
by no more than 10 db(A) not to exceed 15 minutes in anyone-hour period. The Applicant states that all work is performed offsite, so there is no noise associated with the operation.
A study in the application has demonstrated that the noise generated will not exceed the levels or time parameters of CRS 25-12-103.(2), and Staff recommends that this compliance be
a condition for approval. (2) Emission of smoke and particulate matter: Every use shall be operated so as to comply with all Federal, State and County air quality laws, regulations;
Staff Finding All vehicles accessing the site will be licensed and in compliance with County, State and Federal requirements. Comments from Garfield County Road & Bridge include the
requirement that 'Any vehicle exceeding Garfield County oversize/overweight limit shall have an oversize/overweight permit issued by Garfield County Road & Bridge Oepartmenf (Exhibit
H). Staff has included a recommended condition of approval requiring compliance with all applicable air quality laws and regulations, and that a plan for mandatory appropriate road maintenance
and dust abatement to the satisfaction of GarCo Road & Bridge and the Planning Department Project Engineer be required as a condition of approval. (3) Emission of heat, glare, radiation
and fumes: every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes
a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air
pollution control measures shall be exempted from this provision; Staff Finding The Applicant does not represent uses that will generate heat, glare, or radiation. Extended engine idling
associated with 'winter warm-up' is, in fact, dissuaded by diesel engine manufacturers, with an in-tank electric heater preferred to warm the engine fluids. Staff recommends that engine
idling be kept at a minimum of 3 minutes to reduce fumes that could be considered a nuisance. (4) Storage area, salvage yard, sanitary landfill and mineral waste disposal areas: -11

BCCC 07/6/2009 DO a) Storage of flammable or explosive solids or gases shall be in accordance with accepted standards and laws and shall comply with the national, state and local fire
codes and written recommendations/comments from the appropriate local protection district regarding compliance with the appropriate codes; Staff Finding Staff referred this application
to Rifle Fire Protection District for comment. An email arrived 5.14.09 from Jason Clark, Fire Inspector (Exhibit K) stating: I have reviewed the Special Use Permit request for 1177
CR 259. The following comments need to be addressed by the owner /representative: 1. In an effort to ensure safety of both emergency responders and occupants of the facility it is requested
that the owner /representative submit a Hazmat Declaration to the Rifle Fire Protection District. The Hazmat Declaration Forms may be obtained at the Rifle Fire Department or mailed
to a location at the request of the owner /representative. Once the Hazmat Declaration is submitted it will be reviewed and comments /requirements forwarded to the owner /representative
for compliance. 2. Additionally, before approval an inspection of the business portion of the property (11,000 sq. ft contractor yard area, oil storage tank and shop area used for the
business) needs to be completed by the Rifle Fire Protection District. There is some storage of flammable or explosive items in this operation; however it is in levels well below the
threshold where Federal permitting is required. Staff recommends, that because the location is somewhat isolated, and response time from the fire protection provider is somewhat lengthy,
the Applicant should be required to have a fire suppression plan and safety equipment available on-site, and work with the fire protection provider to identify chemicals and flammables
to ensure the safety to the fire fighting responders. All storage of flammable or explosive solids or gases shall comply with all applicable laws at the national, state and local levels.
Staff recommends requiring the Applicant to utilize the Best Management Practices regarding the storage of this material identified in a Spill Containment and Cleanup Management Plan
(SCCMP) to be created by the Applicant as part of the conditions of this permit. MSDS (Material Safety Data Sheets) lists that detail each chemical's safe handling, fire suppression
methods and recommended disposal should be included in the plan. The records should be stored away from the area where the chemicals are stored. This is detail in the SCCMP that is a
condition of approval. All items to be discarded must be properly stored, transported and disposed of in an appropriate facility. It is estimated by the Applicant that no more than 600
gallons of motor oil will be onsite at a given time. The oil onsite is used to keep operative levels in the vehicles; oil changes are done off-site. It arrives in a 50 gallon approved
drum, remains in the drum in a containment basin. Waste oil is returned to a 500-gallon waste oil container in a sealed containment pit, appropriately labeled and stored until disposal
at an approved facility is accomplished by a waste oil recycler. -12 -
soee 07/6/2009 DO The aforementioned activities can be adequately mitigated through conditions that are detailed in the Spill Containment and Cleanup Management Plan (SCCMP) that is
a condition of approval for this Contractor's Yard. This permit has been discussed and the fire service provider is in agreement with its standards. (b) At the discretion of the County
Commissioners, all outdoor storage facilities may be required to be enclosed by fence, landscaping or wall adequate to conceal such facilities from adjacent property; Staff Finding The
subject property is visible when traveling on CR 259, but is partially screened by existing earthen berm. Because the operation is to take place inside an area that is limited in size
(under one acre, behind existing earthen berm, and most of the work performed inside an enclosed structure, and the structure is generally down-grade from the adjacent properties,) limited
screening may be required. Staff recommends that if the Applicant is required to install vegetation or trees to augment the screening in place at this time, that browse-resistant trees

per the conditions set forth in this permit. The permit shall be limited to the equipment listed, and any substantial expansion of those vehicles and equipment shall be considered only
with an application for a Major Impact Review Permit Amendment of the use as per the new Unified Land Use Resolution of 2008, as amended (ULUR). (1) The minimum lot size is five (5)
acres and is not a platted subdivision. Staff Finding The Subject parcel meets the required acreage size for 'Heavy Equipment'. The property is not in a platted subdivision. This condition
has been met. (2) The equipment storage area is not placed any closer than 300 ft. from any existing residential dwelling. Staff Finding Staff conducted a site visit to the subject property.
There are no residential structures closer than 300 feet to the proposed contractor's yard area with the exception of the applicant's own house. (3) All equipment storage will be enclosed
in an area with screening at least eight (8) feet in height and obscured from view at the same elevation or lower. Screening may include berming, landscaping, sight obscuring fencing
or a combination of any of these methods. Staff Finding This standard pertains to storage of heavy equipment, which will be either inside the structure or in an area behind the earthen
berm. (4) Any repair and maintenance activity requiring the use of equipment that will generate noise, odors or glare beyond the property boundaries will be conducted within a building
or outdoors during the hours of 8 a.m. to 6 p.m., Mon.-Fri. Staff Finding Staff has included this requirement as a condition of approval. -14 -
BOCC 07/6/2009 DD (5) Loading and unloading of vehicles shall be conducted on private property and may not be conducted on any public right-of-way. Staff Finding The proposed use is
in compliance with this standard. e) Any storage area for uses not associated with natural resources shall not exceed ten (10) acres in size. Staff Finding The proposed use is in compliance
with this standard. f) Any lighting of storage area shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. Staff Finding
There is no proposed new lighting, but Staff has included this requirement as a condition of approval on any new lighting installed on site in the future. (5) Water pollution: in a case
in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities
may begin. All percolation tests or ground water resource tests as may be required by local or State Health Officers must be met before operation of the facilities may begin. Staff Finding
All Regulations of the Environmental Protection Agency and all other applicable Federal, State and Local regulations shall be complied with at all times. The Applicant is not asking
for water use as part of th is operation. 9.03.05 [Periodic Review of SUPl Pursuant to section 9.03.05 of the Zoning Resolution: Any Special Use Permits may be made subject to a periodic
review not less than every six (6) months if required by the County Commissioners. The purpose of such review shall be to determine compliance or noncompliance with any performance requirements
associated with the granting of the Special Use Permit. The County Commissioners shall indicate that such a review is required and shall establish the time periods at the time of issuance
of a Special Use Permit. Such review shall be conducted in such manner and by such persons as the County Commissioners deem appropriate to make the review effective and meaningful. Upon

Boee 0716/2009 DO completion of each review, the Commissioners may determine that the permit operations are in compliance and continue the permit, or determine the operations are not
in compliance and either suspend the permit or require the permittee to bring the operation into compliance by a certain specified date. Such periodic review shall be limited to those
performance requirements and conditions imposed at the time of the original issuance of the Special Use Permit. Conditions set forth in the SCCMP require ongoing annual reporting for
fire safety and fuel/chemical inventory to the fire service provider, and compliance with standards to ensure this Special Use Permit operates within the requirements set forth in the
permit. Failure to comply with these standards will result in Code Enforcement action and revocation of the permit. Because conditions are in place, Staff feels there is no need for
a required periodic review. VII. SUGGESTED FINDINGS 1.) That proper public notice was provided as required for the hearing before the Board of County Commissioners; 2.) That the hearing
before the Board of County Commissioners was extensive and complete and that all interested parties were heard at that meeting; 3.) The Application is in conformance with §3.02.03, §5.03.07,
§5.03.08 and §9.03.05. of the Gatfield County Zoning Resolution of 1978, as amended; 4.) That for the above stated and other reason, the proposed Special Use Permit is in the best interest
of the health, safety and welfare of the citizens of Garfield County; VIII. STAFF RECOMMENDATION Staff recommends approval of the proposed Special Use Permit allowing a "Contractor's
Yard" with the following conditions: 1. All representation made by the Applicant in the application and as testimony in the public hearing before the Board of County Commissioners shall
be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. The Applicant shall comply with all performance standards identified in §5.03.07 and §5.03.08
of the Garfield County Zoning Resolution of 1978, as amended; 3. The use of the site shall be between the hours of 6 a.m. and 7 p.m. daily. a. Volume and sound generated shall comply
with the standards set forth for residential neighborhoods in the Colorado Revised State Statute (CRS) 25-12-103, except as detailed in (b). -16 -

lighting to be installed shall be downcast and directed to the interior of the property. 5. The truck and equipment storage area shall be limited to that depicted in the application.

by the Applicant. 10. Loading or unloading equipment in the Garfield County right-of-way is prohibited. 11. To help ensure safe operations and courtesy in the residential neighborhood
in which the Special Use Permit is to be sited, the Applicant shall hold a safety meeting no less than annually with all employees, with documentation (employee/employer signatures)

Rifle Fire Protection District that being to schedule an inspection of the facility and completing the Hazardous Materials form provided by the Rifle Fire Protection District. 14. No
more than 600 gallons of oil in conjunction with this use may be stored on site at any time. That accumulation must be stored in compliance with all requirements set forth in all local,
State, County and Federal regulations for the proper storage of used oil and other chemicals. 15. Permits required in the execution of this Special Use Permit shall have be secured from
Garfield County prior to the initiation of the activity requiring a permit. 16.Any new fencing on the parcel shall comply with the 'Wildlife Friendly' Standards set forth by the Colorado
Division of Wildlife (DOW). 17. The Special Use Permit shall be limited to the equipment listed and shall be governed by the conditions of approval set forth by the BOCC. Any substantial

area. This area accessed by County Road 259(Jewel Lane) is in a quiet rural area, along a chip and seal road and not an appropriate location for an industrial activity or use. The road
would not hold up to the heavy equipment involved and is now being damaged by a contractor's heavy equipment kept on a residential lot past the end ofCR 259. There are adequate locations
available along US Hwy 6 that should be used rather than this isolated place along a rural residential road. We live along CR259 -Jewel Lane -and are very disturbed that such a use would

, EXHIBIT June 5, 2009 ..... _-To Garfield County Conunisioners: The traffic to and from the Hampson's property travels on 259 rd. This county road borders our property. Soon after the
Hampson's moved to 1177 co rd 259 we have had problems with additional road dust, traffic noise and speeding traffic. Hampson's and some of their employee's are not considerate to the
people who live near 259 rd. If the use permit is given, people in the area will have more problems with traffic, road damage, and possible hazardous chemical contamination from the
storage of gas field equipment. Hampson's are saying that they have spent approximately $7500.00 each year over the past three years for dust suppression and to grade and plow a 1700
ft section of county road 259.There is no way they have spent $22,500.00 on the road! If they had .the neighbors would have seen the working and improvement of the road. Terry Patrick,
a resident of259 rd. is the only person who has spent money on the road for improvement since the Hampson's have live there. Hampson's should be asked if they have witnesses or photos
of themselves or anyone they hired working on the road. Hampson's road survey is completely incorrect. All of the traffic in the area comes by my residence. Hampson's and their employees
are by far the heaviest users and the semitrucks coming to their yard are loaded or leave loaded. If Hampson's are given a special use permit then every one in Garfield County is entitled

their special use. I understand they are only attempting to go.through the correct (legal) avenue in which they do their business by applying for the permit. I do not perceive any changes
in which they have been doing business, which is not offensive to me. Considering the fact they are an agricultural based business and not an industrial based business, they do not have
a negative impact on the neighborhood. I feel it is important that the facts be kept in perspective. Apparently the Hampson's objective is to legally have a "contractor's yard less than
two acres" which would be located on a 36 acre parcel. I do not see how it will negatively affect the neighborhood. I again support the issuance of the special use permit. Regards, Craig
