HomeMy WebLinkAbout3.0 NTC letter 4.02.13April 2, 2013 Red Rock Gathering Company LLC 2128 Railroad Ave., Suite 106 Rifle, CO 81650 AnN: Tracey Jensen Garfield Co Community Development 108 8th Street, Suite 401, Glenwood Springs, CO 81601 Office: 970-945-8212 Fax: 970-384-3470 RE: Completeness Review Red Rock Gathering LLC -Midway Storage Yard Limited Impact Review (File LlPA-7S08) Dear Tracey: We have reviewed your application and supplemental materials, submitted for the Red Rock Gathering Company LLC, Limited Impact Review for the Midway Storage Yard Facility. Our completeness review has noted a number of items that need to be addressed prior to a determination of technical completeness. In accordance with the Garfield County Unified Land Use Resolution of 2008 (ULUR) as amended, please respond to the following items: 1. The Application submittal does not contain a narrative description of the overall request. This would be an effective way to summarize the proposal and form a basis for other requests contained in the submittal. A narrative for the project should clarify details such as surfacing for the storage yard and access areas, dust control, noise and/or hours of operation issues, fencing, security/gates, lighting, operations plans, employees on site, emergency procedures, relationship to the existing yard and general information on construction schedule. 2. In general, the waiver requests included with the Application need to be supplemented with additional information demonstrating compliance with the waiver criteria contained in Section 4-202 and 4-117. 3, Thank you for providing additional mapping delineating your access routes to the site, however, the electronic version does not print for us with the labels. Please update or submit a hard copy for inclusion in your Application. If access is onto a County Road the Application should address any existing or future county access permits. 4. Information on the access roads is needed demonstrating their adequacy to serve the site. The application should document that they meet the Roadway Standards contained in Table 7-308 or an additional waiver request and justification should be provided if certain standards are not fully met. 5. The submittal does not address the required Erosion and Sediment Control Plan or request a waiver. Information on topography, grading, and drainage improvements need to be provided as part of an Erosion and Sediment Control Plan or as part of the justification for a waiver request. The Application should address whether Colorado Department of Public Health and Environment storm water management permitting is applicable to this site. Given the nature of the use and anticipated grading on the site erosion/sediment controls, re-vegetation, and the potential need for weed control should be addressed. 6. The waiver request from the Traffic Study needs to be supplemented with further clarification on traffic from the current storage location referenced. Basic information on traffic generation should also be provided to support the waiver request (i.e. how often the site will be accessed for delivery or pick-up of stored materials). 7. Review by the County Attorney's Office has noted the following completeness concerns: • Additional information on ownership demonstrating acquisition of the property by Red Rock Gathering Company LLC is needed. • The statement of authority provided needs to be recorded with the County Clerk and Recorder's Office. • The issue of a potential illegal subdivision creating the parcel on which the storage facility is located remains a concern and is not fully addressed by the submittals. Copies of the supporting deeds referred to in the parcel history are needed (including their legal descriptions) for Staff review. Additional documentation or representations based on the additional research undertaken by the Applicant should be provided. Additional information may be needed to resolve this concern. • The Application needs to include documentation of legal access to the property via easements, road sharing agreements or other arrangements. 8. The Application needs to address applicable standards contained in Article 7 including specific standards for Industrial Uses contained in Section 7-1101. 9. The Application should include some technical information and/or findings to support that no hazardous conditions including geology exist on the site. This should include slopes, soils, drainage, and similar concerns. Once the above information/topics are addressed we will finalize our completeness review, schedule a date for your public hearing with the Board of County Commissioners and proceed with the public notice requirements. Also, once determined to be complete, you will need to provide additional copies of the submittal materials to send to referral agencies including a complete copy of the Application on a compact disk. Please note that the Garfield County ULUR requires that the technical completeness issues be resolved within 60-days of the date of this letter, otherwise the application will be deemed withdrawn unless a request for extension is submitted and approved.
