When reviewing a plan and it's discovered that required information has not been provided by the applicant, this will result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor shall be required to provide this information before the plan review can proceed. Other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. TWO (2) SETS OF CONSTRUCTION DRAWINGS & TWO (2) SITE PLANS MUST BE SUBMlTTEDFOR ALL APPLICATIONS. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. Any project with more than ten (10) occupants requires the plans to be sealed by a Colorado Registered Design Professional. To provide for a more understandable plan in order to determine compliance with the building, plumbing and mechanical codes, applicants are requested to review the following checklist prior to and during design. Applicants are required to indicate appropriately and to submit the completed checklist at time of application for a permit. Plans to be included for a Building Permit, must be on drafting paper at least 1S"x24" and drawn to scale. Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with decks, balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line and original grade. A section showing in detail, from the bottom of the footing to the top of the roof, including re-bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation, sheeting, house-rap, (which is required), siding or any approved building material. Engineered foundations may be required. A window schedule. A door schedule. A floor framing plan, a roof framing plan, roof must be designed to withstand a 40 pound per square foot up to 7,000 feet in elevation, a 90 M.P.H. wind speed, wind exposure B or C, and a 36 inch frost depth. All sheets to be identified by number and indexed. All of the above requirements must be met or your plans will be returned. All plans submitted must be in compliance with the 2003 IRC, and 2006 IECC. 1. Is a site plan included that identifies the location of the proposed structure or addition and distances to the propcrty lines from each comer of the proposed structure(s) prepared by a licensed surveyor and has the surveyors signature and professional stamp on the drawing? Properties with slopes of 30% or greater must be shown on the site plan. Summary: Based on the literature review and conversations with manufacturers and iristallers, we are proposing that the cathedral ceilings in the Scheider ADU to be insulated as a NonVented Roof Assembly. The hybrid insulation system of sprayed polyurethane closed cell foam insulation and batt insulation has a sueeessii11 track record in our area and has been accepted within the local building departments. We have attached documents that we have used in our analysis for your review and comment. Analysis: The ceiling /roof assembly will be installed as illustrated and specified in CSK 012 Revised 9.9.10 (attached). The critical eonceD] is vapor condensation on the interior face of the first condensing surface during the winter season. It is during that time of year that the relativc indoor humidity levels arc high and the temperature differential of the ceiling I roof assembly is exposed to create an opportunity for condensation. The hybrid insulation system of 4" of polyurethane closed eell spray foam insulation (R-2S) and tbe 8" ofunfaeed batt insnlation (R-2S) will place the dew point within the polyurethane all the prescribed temperature differential (as engineered by InsuIVail). Additionally, by using the CertainTeed MemBrain vapor retarder, and limiting ceiling penctrations (for example, no recessed lighting or exhaust fans and closed cell spray foam where plumbing vents occur) we have limited vapor into the cavity while at tbe same time allowing for moist air to escape the ceiling assembly. The project site is shown on Figure I. The purpose of the study was to develop recommendations for the foundation design. The study was conducted in accordance with our proposal for geotechnical engineering services to John Schneider dated November 14, 2008. Hepworth-Pawlak Geotechnical, Inc. previously perfonned a subsoil study for foundation design of the residence at Lot 5 and reported oW' fmdings April 30, 2003, Job No.1 03 213. A field exploration program consisting of exploratOlY borings was conducted to obtain information on the subsW'face conditions. Samples of the subsoils obtained dW'ing the field exploration were tested in the laboratory to determine their classification, compressibility or swell and other engineering characteristics. The results of the field exploration and laboratory testing were analyzed to develop recommendations for foundation types, depths and allowable pressW'es for the proposed building foundation. This repOlt summarizes the data obtained during this study and presents oW' conclusions, design recommendations and other geotechnical engineering considerations based on the proposed construction and the subsurface conditions encountered. PROPOSED CONSTRUCTION The proposed ADO will be a two story structure with a wallcout lower level. The lower level will be the garage with a slab-on-grade floor. The second floor will be the main living area with an entrance at the upper level. Grading for the structW'e is assumed to be relatively minor with cut depths between about 2 to 10 feet. We assume relatively light foundation loadings, typical of the proposed type of construction. Ifbuilding loadings, location or grading plans change significantly from those described above, we should be notified to re-evaluate the recommendations contained in this repOlt. Job No. 108630A -2-SITE CONDITIONS The property is occupied with a single family residence and asphalt driveway. The ADU site was vacant of structures and fi'ee of snow cover at the time of our field exploration. Vegetation consists of scattered trees, brush, grass and weeds. The ground surface in the building area is relatively flat with a slight slope down to the nOlth at a grade of about 2 percent. The slope steepens south of the building area and rises at a grade 0 f about 10 percent. Four Mile Creek is located about 60 feet north of the building area and about 5 feet below the site grade. FIELD EXPLORATION The field exploration for the project was conducted on November 20, 2008. Two exploratOlY borings were drilled at the locations shown on Figure I to evaluate the subsurface conditions. The borings were advanced with 4 inch diameter continuous flight augers powered by a truck-mounted CME-45B drill rig. The borings were logged by a representative of Hepworth-Pawlak Geotechnical, Inc. Samples of the subsoils were taken with 1 % inch and 2 inch LD. spoon samplers. The samplers were driven into the subsoils at various depths with blows from a 140 pound hammer falling 30 inches. This test is similar to the standard penetration test described by ASTM Method D-1586. The penetration resistance values are an indication of the relative density or consistency ofthe subsoils. Depths at which the samples were taken and the penetration resistance values are shown on the Logs of Exploratory Borings, Figure 2. The samples were returned to our laboratory for review by the project engineer and testing. SUBSURFACE CONDITIONS Graphic logs of the subsurface conditions encountered at the site are shown on Figure 2. The subsoils, below about 6 inches oftopsoil, consist of silty sand and gravel overlying silty sandy gravel with cobbles and boulders. Drilling in the underlying dense granular soils with auger equipment was difficult due to the cobbles and boulders and drilling refusal was encountered in the deposit. Job No. 108630A ~tech -3 -Laboratory testing perfmmed on samples obtained ji-mn the borings included natural moisture content and gradation analyses. Results of swell-consolidation testing performed on a relatively undisturbed drive sample of the upper sand, presented on Figure 4, indicate low compressibility under existing low moisture content and light loading. The sample showed moderate to high collapse (settlement under constant load) when wetted and high compression under additional loading. Results of gradation analyses perfonned on small diameter drive samples (minus I Yz to 2 inch fraction) of the natural subsoils are shown on Figure 5. The laboratory testing is summarized in Table l. No 1i-ee water was encountered in the borings at the time of drilling or when checked 4 days later and the subsoils were slightly moist. FOUNDATION BEARING CONDITIONS The subsoils encountered below topsoil consisted of 2 to 7 Yz feet ofloose to medium dense silty sand and gravel overlying relatively dense sandy gravel with cobbles and boulders. The upper silty sand and gravel soil is hydro compressive. The lower level floor elevation as planned appears to provide foundations bearing on the lower dense sandy gravel soils. If encountered, the upper silty sand and gravel soils should be removed from beneath proposed footings. DESIGN RECOMMENDATIONS FOUNDATIONS Considering the subsurface conditions encountered in the exploratory borings and the nature ofthe proposed construction, we recommend the building be founded with spread footings bearing on the dense granular soils. The design and construction criteria presented below should be observed for a spread footing foundation system. 1) Footings placed on the undisturbed dense granular soils should be designed for an allowable bearing pressure of2,500 psi Based on experience, we expect settlement of footings designed and constructed as discussed in this section will be about 1 inch or less. Job No.1 08 630A ~tech -4-2) The footings should have a minimum width of 16 inches for continuous walls and 2 feet for iso lated pads. 3) Exterior footings illld footings beneath unheated areas should be provided with adequate soil cover above their bearing elevation for fi'ost protection. Placement offoundations at least 36 inches below exterior grade is typically used in this area. 4) Continuous foundation walls should be reinforced top illld bottom to span local anomalies such as by assuming an unsnpported length of at least 10 feet. Foundation walls acting as retaining structures should also be designed to resist lateral eillih pressures as discussed in the "Foundation and Retaining Walls" section of this repmi. 5) The topsoil, silty sand and gravel soils and any loose or disturbed soils should be removed and the footing bearing level extended down to the relatively dense natural grannlar soils. The exposed soils in footing area should then be moistened alld compacted. Ifwater seepage is encountered, the footing areas should be dewatered before concrete placement. 6) A representative ofthe geotechnical engineer should observe all footing excavations prior to concrete placement to evaluate bearing conditions. FOUNDATION AND RETAINING WALLS Foundation walls and retaining structures which are laterally suppmied alld Call be expected to undergo only a slight amount of deflection should be designed for a lateral earth pressure computed on the basis of an equivalent fluid unit weight of at least 50 pcf for backfill consisting ofthe on-site soils. Cantilevered retaining structures which are separate from the ADU alld can be expected to deflect sufficiently to mobilize the full active eillih pressure condition should be designed for a lateral earth pressure computed on the basis of an equivalent fluid unit weight of at least 45 pcffor backfill consisting of the on-site soils. All foundation and retaining structures should be designed for appropriate hydrostatic and surcharge pressures such as adjacent footings, traffic, construction materials and equipment. The pressures recmmnended above assume drained conditions behind the Job No. 108 630A ~tech -5 -walls and a horizontal backfill surface. The buildup of water behind a wall or an upward sloping backfill surface will increase the lateral pressure imposed on a foundation wall or retaining structure. An underdrain should be provided to prevent hydrostatic pressure buildup behind walls. Backfill should be placed in uniform lifts and compacted to at least 90% of the maximum standard Proctor density at a moisture content near optimum. Backfill in pavement and walkway areas should be compacted to at least 95% of the maximum standard Proctor density. Care should be taken not to overcompact the backfill or use large equipment near the wall, since this could cause excessive lateral pressure on the wall. Some settlement of deep foundation wall backfill should be expected, even if the material is placed con-ectly, and could result in distress to facilities constructed on the backfill. The lateral resistance offoundation or retaining wall footings will be a combination ofthe sliding resistance ofthe footing on the foundation materials and passive earth pressure against the side ofthe footing. Resistance to sliding at the bottoms ofthe footings can be calculated based on a coefficient offhction of 0.50. Passive pressure of compacted backfill against the sides of the footings can be calculated using an equivalent fluid unit weight of400 pcf. The coefficient offhction and passive pressure values recommended above assume ultimate soil strength. Suitable factors of safety should be included in the design to limit the strain which will occur at the ultimate strength, particularly in the case of passive resistance. Fill placed against the sides ofthe footings to resist lateral loads should be a granular material compacted to at least 95% ofthe maximum standard Proctor density at a moisture content near optimum. FLOOR SLABS The natural on-site soils, exclusive oftopsoil, are suitable to support lightly loaded slabon-grade construction. There is some risk of differential settlement for slabs bearing on the upper silty sand and gravel soils. To reduce the effects of some differential movement, floor slabs should be separated fi'om all bearing walls and colul1111s with expansion joints which allow unrestrained veliicalmovement. Floor slab control joints should be used to reduce damage due to shrinkage cracking. The requirements for joint spacing and slab Job No. 108 630A ~tech -6 -reinforcement should be established by the designer based on experience and the intended slab use. A minimum 4 inch layer of fi'ee-draining gravel should be placed beneath basement level slabs to facilitate drainage. This material should consist of minus 2 inch aggregate with at least 50% retained on the No.4 sieve and less than 2% passing the No. 200 sieve. All fill materials for support of floor slabs should be compacted to at least 95% of maximum standard Proctor density at a moisture content near optimum. Required fill can consist of the on-site granular soils devoid of vegetation, topsoil and oversized rock. UNDERDRAIN SYSTEM Although fi'ee water was not encountered during our exploration, it has been our experience in the area that local perched groundwater can develop during times of heavy precipitation or seasonal runoff. Frozen ground during spring llJl10ff can create a perched condition. We recommend below-grade construction, such as retaining walls and lower levels, be protected fi'om wetting and hydrostatic pressure buildup by an underdrain system. The drains should consist of drainpipe placed in the bottom of the wall backfill sUlTounded above the invert level with fioee-draining granular material. The drain should be placed at each level of excavation and at least I foot below lowest adjacent fmish grade and sloped at a minimum 1 % to a suitable gravity outlet. Free-draining granular material used in the underdrain system should contain less than 2% passing the No. 200 sieve, less than 50% passing the No.4 sieve and have a maximum size of2 inches. The drain gravel backfill should be at least I II, feet deep. SURFACE DRAINAGE The following drainage precautions should be observed during construction and maintained at all times after the ADU has been completed: 1) Inundation ofthe foundation excavations and underslab areas should be avo ided during construction. Job No. 108 630A ~tech -7 -2) Exterior backfill should be adjusted to near optimum moisture and compacted to at least 95% ofthe maximum standard Proctor density in pavement and slab areas and to at least 90% 0 f the maximum standard Proctor density in landscape areas. 3) The ground surface sUiTounding the exterior of the building should be sloped to drain away 1i-om the foundation in all directions. We reconunend a minimum slope of 12 inches in the first 10 feet in unpaved areas and a minimum slope of3 inches in the first 10 feet in paved areas. Free-draining wall backfill should be capped with about 2 feet of the onsite soils to reduce surface water infiltration. 4) Roof downspouts and drains should discharge well beyond the limits of all backfill. 5) Landscaping which requires regular heavy inigation and sprinkler heads should be located at least 5 feet 1i-om foundation walls. LIMITATIONS This study has been conducted in accordance with generally accepted geotechnical engineering principles and practices in this area at tlus time. We make no wananty either express or implied. The conclusions and reconunendations submitted in this report are based upon the data obtained 1i-om the exploratory borings drilled at the locations indicated on Figure I, the proposed type of constmction and our experience in the area. Our services do not include detennining the presence, prevention or possibility of mold or other biological contaminants (MOBC) developing in the future. If the client is concerned about MOBC, then a professional in this special field ofpractice should be consulted. Our fmdings include interpolation and extrapolation ofthe subsurface conditions identified at the exploratory borings and variations in the subsurface conditions may not become evident until excavation is perfonned. If conditions encountered during constmction appear different from those described in this report, we should be notified so that re-evaluation ofthe reconunendations may be made. This report has been prepared for the exclusive use by our client for design purposes. We are not responsible for technical interpretations by others of our information. As the Job No. 108 630A ~tech -8 -project evolves, we should provide continued consultation and field services during constmction to review and monitor the implementation of our recommendations, and to verify that the reCOllli11endations have been appropriately interpreted. The exploratory boring locations and elevations should be considered accurate only to the degree implied by the method used. 5. The lines between materials shown on the exploratory boring logs represent the approximate boundaries between material types and transitions may be gradual. 6. No free water was encountered in the borings at the time of drilling or when checked 4 days later. Fluctuation in water level may occur with time. 7. The purpose of our review was to conform to Garfield County Regulatory Requirements (7-104B) as part of the ADU permit process. It is our opinion that the water supply has adequate quality, quantity, and dependability for the proposed use. In support of our work we are attaching the following documents; • Well permit 68451-F and supporting water contract documents • Well construction log and pump installation report • Well drawdown and recovelY graphs for 24-hour pump test • Water quality laboratory results for inorganics, bacteria, radioactivity Legal Supply The well is permitted as a fee well with the Colorado Division of Water Resources under Permit No. 68451-F. The fee well is augmented through a contract with the West Divide Water Conservancy District. The permit limits include a maximum pumping rate of 15 gallons per minute (gpm), use in a single family house, and the irrigation of up to Yz acre. Well Constmction The well was constmcted to a depth of xx feet by Shelton Drilling Company. The static water level was measured to be 15-feet below the top of the casing. The well was constructed into the colluvium of Fommile Creek and the Roaring Fork River. A variable speed pump was installed by J&M Pump Company. Pump Test A pump test was observed by Colorado River Engineering on November 24, 2009. The well was pump tested for 24-hours with monitoring of drawdown, recovelY, and the collection of water quality samples. The average pumping rate over the study period was approximately 4.5-gpm which totaled over 6,000 gallons pumped dUling the I-day test. P.O. The water level in the well only dropped 1'-2" during the test which shows that well has significant more yield and has characteristics of an alluvial well. Recovery data showed the well is recharged and will provide a dependable supply. No impacts to surrounding ground water resources will occur based on the location and aquifer characteristics. Water Quality Use of the well at a single family home does not prompt any water quality testing and monitoring by the State Health Department as part of the Colorado Primary Drinking Water Regulations. However, tests were conducted to meet items identified in the county code Section 7-104B.2.c which includes inorganic contaminants (heavy metals), asbestos, nitrate/nitrite, sulfate, bacteria, and radiological. Secondary standards for items such as taste and Qdor were not tested. The water quality is excellent for this well. All use of this well will be curtailed unless the water allotment contract or a plan for augmentation is in effect. This well is known as Schneider ADU Well. The pumping rate of this well shall not exceed 15 GPM. The average annual amount of ground water to be appropriated shall not exceed 1.64 acre-foot (534,394 gallons). The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. Water Rights: Applicant shall own water rights at the point of diversion herein lawfully entitling Applicant to divert water, which will be supplemented and augmented by water leased herein. If Applicant intends to divert through a well, it must be understood by Applicant that no right to divert exists until a valid well permit is obtained from the Colorado Division of Water Resources. 2. Quantity: Water applied for by the Applicant in the amount setforth above shall be diverted at Applicant's point of diversion from the District's direct flow water rights, and when water is unavailable for diversion pursuant to administration by the Colorado State Engineer during periods when said direct flow water right is not in priority, the District shall release for the use of Applicant up to said quantity in acre feet per year of storage water owned or controlled by the District. It is Wlderstood that any quantity allotted from direct flow, storage or otherwise, to the Applicant by the District will be limited by the priority of the District's decrees and by the physical and legal availability of water from District's sources. Any quantity allotted will only be provided so long as water is available and the Applicant fully complies with all of the tenns and conditions of this Contract. The District and the Applicant recognize that some of the District's decrees may be in the name of the Colorado River Water Conservation District, and the ability of the District to allot direct flow right to the Applicant may be dependent on the consent of the Colorado River Water Conservation District. If at any time the Applicant detennines it requires less water than the amount herein provided, Applicant may so notify the District in writing, and the amount of water allotted under this Contract shall be reduced pennanently in accordance with such notice. Rates shall be adjusted accordingly in following water years only. 3. Beneficial Use and Location of Beneficial Use: Any and all water allotted Applicant by the District shall be used for the foHowing beneficial use or uses: industrial. municipal. domestic and related uses, or commercial (except for commercial use from Alsbury Reservoir and except to the extent that Ruedi Reservoir water may not be available for commercial as that tenn is defined on Page 5 of Contract No. 2·07·70· WQ547 hetween the United States and the West Divide Water Conservancy District). Applicant's beneficial use of any and all water allotted shall be within or through facilities or upon land o'.¥ned, leased, operated, or under Applicant's control. 4. Decrees and DeH~ety: Exchange releases made by ~he District out of storage from Ruedi Reservoir, Green Mountain Reservoir, Alsbury Reservoir, or other works or facilities of the District, or from other sources available to the District, shall be delivered to the Applicant at the outlet works of said storage facilities or at the decreed point of diyersion for said other sources, and release or delivery of water at such outlet or points shall constitute perfonnance o~the District's total obligation. Delivery of water by the District from Ruedi Reservoir or Green 1 Mountain Reservoir shall be subject to the District's lease contracts with the United States Bureau of Reclamation. Releases from other facilities available to District shall be subject to the contracts, laws~ rules, and regulations governing releases therefrom. Furthennore, the District hereby expressly reserves the right to store water and to make exchange releases from structures that may be built or controlled by the Disttict in the future, so long as the water service to the Applicant pursuant to this agreement, is not impaired by said action. Any quantity of the Applicant's allocation not delivered to or used by Applicant by lbe end of each water year (October I), shall revert to the water supplies ofthe District. Such reversion shall not entitle Applicant ~o any refimd of payment made for such water. Water service provided by the District shall be limited to lbe amount of water available in priority at the original point of diversion of the District's applicable water right, and neither the District, nor those entitled to utilize the District's decrees, may call on any greater amount at new or alternate points of diversion. The District shall request the Colomdo Division of Water Resources to estimate any conveyance losses between the o.riginal point and any alternate point, and such estimate shall be deducted from this amount in each case. Water service provided by the District for properti~s located within the Bluestone and Silt Water Conservancy Districts is provided pursuant to Agreements with said Districts. The Intergovernmental Agreement between the District and the Si1t Water Conservancy District; dated January 25, 2001, is recorded as Reception No. 575691, Garfield County Clerk and Recorder's Office. The Intergovernmental Memorandum of Understanding between the District and the Bluestone Water Conservancy District. dated April 26. 200 1, is recorded as Reception No. 584840, Garfield County Clerk and Recorder's Office. 5. Alternate Point of Diversion and Plan of Augmentation: Decrees for alternate points of diversion ofthe District's water rights or storage water may be required in order for Applicant to use the wat~r service contemplated hereunder. Obtaining such decree is the exclusive responsibility of Applicant. The District reserves the right to review and approve any conditions which may-be attached to judicial approval of said alternate point of diversion as contemplated or necessary to serve Applicant's facilities or lands. Applicant acknowledges and agrees that it shall be solely responsible for the procedures and legal engineering costs necessary for any changes in water rights contemplated herein, and further agrees to in~eIIll1ify the District from any costs or losses related thereto. Applicant is solely responsible for providing works and facilities necessary to obtain/divert the waters at said alternate point of diversion and deliver them to Applicant's intended beneficial use, Irrespective of the amount of water actually transferred to the Applicant's point of diversion, the Applicant shall make annual payments to the District based upon the amount of water allotted under this Contract. In the event the Applicant intends to apply for an alternate point of diversion ana to develop an augmentation plan and institute legal proceedings for the approval of such augmentation plan to allow the Applicant to utilize the water allotted to Applicant hereunder, the Applicant shall give the District written notice of such intent. In the event the Applicant develops and adjudicates its own augmentation plan to utilize the water allotted hereunder, Applicant shall not be obligated to pay any arnountunder Paragraph 19 below. In any event, the District shall have the rightto approve or disapprove lbe Applicant's augmentation plan and the Applicant shall provide the District copies of such plan and of all pleadings and other papers filed with the water court in the adjudication thereof. 6. Contract Payment: Non-refundable. one time administrative charge. in the amount detennined by the Board of Directors ofthe District from time to time, shall be submitted with the app1ication for consideration by -the District. 2 , , Annual payment for the water service described herein shall be determined by the Board of Directors of the District. The initial annual payment shall be made in full, within thirty (30) days after the date of notice to the Applicant that the initial payment is due. Said notice will advise the Applican~ among other things, ofthe water delivery year to which the initial payment shall apply and the price which is applicable to that year, Annual payments for each yearthereafter shall be due and payable by the Applicant on or before each January 1. If an annual payment is not made by the due date a flat $50 late fee· will be assessed. Final written notice prior to cancellation will be sent certified mail, return receipt requested, to the Applicant at such address as may be designated by the Applicant in writing or set forth in this Contract or Application. Water use for any part of a water year shall require payment for the entire water year. Nothing herein shall be construed so as to prevent the District from adjusting the annual rate in its sole discretion for future years only. Ifpayment is not made within fifteen (15) days after the date of said written notice, Applicant shall at District's sole option have no further righ~ title or interest under this Contract without further notice, and delivery may be immediately curtailed. The allotment of water, as herein made, may be transferred, leased, or otherwise disposed of at the discretion of the Board of Directors of the District. Upon cancellation of this water allotment Contract with the District. the District shall notify the Division of Water Resources offices in Denver and Glenwood Springs. The Division of Water Resources may then order cessation of all water use. 7. Additional Fees and Costs: Applicant agrees to defray any expenses incurred by the District in connection with the allotment of water rights hereunder, including, but not limited to, reimbursement of legal and engineering costs incurred in connection with any water rights and adjudication necessary to allow Applicant's use of such allotted y.rater rights. 8. Assignment: This Contract shall not inure to the benefit of the heirs, successors or assigns of Applicant, without the prior written consent of the District's ~oard of Directors. Any assignment of Applicant's rights under this Contract shall be subject to, and must comply wit~, such requirements as the District may hereafter adopt regarding assignment of Contract rights and the assumption of Contract obligations by assignees and successors. Nothing herein shall prevent successors to a portion of Applicant's property from applying to the District for individual and separate allotment Contracts. No assignment shall be recognized by the District except upon completion and filing of proper forms for assignment and change of ownership. In the event the water allotted pursuant to this Contract is to be used for the benefit ofland which is now or will subsequently be subdivided or held in separate ownership, the Applicant may only assign the Applicant's rights hereunder to: 1) No more than three separate owners all of whom shall be party to a well sharing agreement satisfactory to the District; or 2) A homeowners association, water district, water and sanitation district or other special district properly organized and existing under the laws of the State of Colorado, and then, only if such parties, association or special district establishes to the satisfaction of the District that it has the ability and authority to perfonn the Applicant's obligations under this Contract. In no event shall the owner of a portion, but less than all, of the Applicanes property to be served under this Contract have any rights hereunder, except as such rights may exist pursuant to a well sharing agreement or through a homeowners association or special district as provided above. Upon the sale of the real property to which this Contract pertains, Applicant shall make buyer aware ofthis Contract and proper forms for assignment and change of ownership must be completed. 3 9. Other Rules: Applicant shall be bound by the provisions of the Water Conservancy Act of Colorado; by the rules and regulations of the Board of Directors of the District; and all amendments thereof and supplements thereto and by all other applicable law. IO. Operation and Maintenance Agreement: Applicant shall enter into an uOperation and Maintenance Agreement" with the District undertenns and conditions determined by the hoard of Directors of the District, if and when, the Board of said District detennines in its sole discretion that such an agreement is required. Said, agreement f!1ay contain, but shall not he limited to, provisions for additional annual monetary consideration for extension of District delivery services and for additional administration, operation, and maintenance costs; or for other costs to the ~istrict which may arise through services made available to the Applicant. 11. Change of Use: The District reserves the exclusive right to review, re-approve or disapprove any proposed change in use of the water al10tted hereunder. Any use other than that set forth herein or any lease or sale of the water or water rights allotted hereunder without the prior written approval of the District shall be deemed to be a material breach of this Contract. 12. Use and Place of Use: Applicant agrees to use the water in the manner and on the property described in the documents submitted to the District at the time this Contract is executed, Of in any operation and maintenance agreement provided by Applicant. Any use other than as set forth thereon or any lease or sale ofthe water or water rights herein, other than as permitted in paragraph 8 above, shaH be deemed to be a material breach of this agreement. 13. Title: It is understood and agreed that nothing herein shall be interpreted to give the Applicant any equitable or legal fee title interest in or to any water or water rights referred to herein. 14. Conservation: Applicant shall use commonly accepted conservation practices with respect to the water and water rights herein, and hereby agrees to be bound by any conservation plan adopted hereafter by the District for use of District owned Of controlled water or water rights. 15. Restrictions: Applicant shall restrict actual diversions to not exceed the contract amount for ordinary household purposes, the watering of domestic livestock, fire protection, and the irrigation of lawn and garden as specified in the Application. Applicant shall also comply with all restrictions and limitations set forth in the well pennit obtained from the Colorado Division of Water Resou~ces. Watering of livestock shall be restricted to Applicant's domestic animals not to be used for commercial purposes unless Applicant obtains approval from the Colorado Division of Water Resources for commercial usellivestock watering, provided that in no event shall actual diversions exceed the amount of water provided by this Contract. Violation ofthis paragraph 15 shall be deemed to be a material breach of this Contract. 16. Well Permit: If Applicaut intends to divert through a well, then Applicant must provide to District a copy of Applicant's valid well pennit before District is obligated to deliver any water hereunder. 17. Measuring Device or Meter: Applicant agrees to provide, at its own expense, a measuring device deemed acceptable by the District's Engineer after consultation, or a totalizing flow meter with remote readout to continuously and accurately measure at all times all 4 1 ," water diverted pursuant to the tenus of Applicant's water right and the terms ofthi.s Contract. Applicant agrees to provide accurate readings from such device or me~er to District upon District's request. Applicant acknowledges that failure to comply with this paragraph could result in legal action to terminate Applicant's diversion of water by the State of Colorado Division of Water Resources. By signing this Contract, Applicant hereby specifically allows District, through its authorized agent, to enter upon Applicant's property during ordinary business hours for the purposes of detennining Applicant's actual use of water. 18. Representations.: By executing this Contract, Applicant agrees that it is not relying on any legal or engineering advice that Applicant may believe has been received from the District. Applicant further acknowledges that it has obtained all necessary legal and engineering advice from Applicant's own sources other than the District. Applicant further acknowledges that the District makes no guarantees, warranties, or assurances whatsoever about the quantity or quality of water available pursuant to this Contract. Should the District be unable to provide the water contracted for herein, no damages may be assessed against the District, nor may Applicant obtain a refund from the District. 19. Costs of Water Court Filing and Augmentation Plan: Should the District, in its own discretion, choose to include Applicant's Contract herein in a water court filing for alternate point of diversion or plan of augmentation, then Applicant hereby agrees to pay to the District, when assessed, an additional fee representing the District's actual and reasonable costs and fees for Applicant's share of the proceedings. Applicant shall be assessed a pro-rata share of the total cost incurred by the District in preparing, filing and pursuing to decree the water court case. The pro-rata share shall be calculated by dividing such total cost by the number of contractees included in the ftling. To the extent that the District is caused additional costs because of objection filed specifically d':le to the inclusion of Applicant's Contract in the filing. such additional costs may be charged specifically to Applicant and not shared on a pro-rata basis by all contractees. 20. Binding Agreement: This agreement shal1 not be complete nor binding upon the District unless attached hereto is the form entitled ItApplication to Lease Water From West Divide Water Conservancy District" fully completed by Applicant and approved by the District's engineer. Said attachments shall by this reference thereto be incorporated into the terms of this agreement. All correspondence from the District to Applicant referring to or relating to this agreement is by this reference incorporated into this agreement as further terms and conditions of this agreement. 2 J. The property is located outside of Cardiff, in an area where OWS and wells are necessary. SITE CONDITIONS A single-family residence presently exists and is utilizing a separate OWS. A 2-bedroom ADU is proposed as indicated on the site plan. The ADU will have approximately 1000 square feet (SF). The proposed drain field area is relatively flat, and vegetation consists of a moderate cover of grasses. Water is provided by a well, which is located near the main residence and is 100+ feet from the proposed ADU septic system. SUBSURFACE The subsurface was investigated by hand digging three percolation holes and evaluating the profile boring drilled by HP Geotech, as indicated. The materials encountered in tl1e profile pit consisted of 1-foot of a clayey root zone, underlain by sandy clay to the maxinlUm depth evaluated of 8 feet. Groundwater or bedrock was not encountered. Percolation rates ranged from 20 to 40 minutes per inch (MFI). A 27 MPI rate will be used to design the OWS. DESIGN SPECIFICATIONS The OWS design is based on 2-bedTOoms and an average sewage load of 300 GPD. The installation must include a 1250-gaUon, two-compattment, precast concrete septic tank with a Biotube pump vault. One gravelless chamber bed, using ' Quick-4' Infiltrator™ chambers, must be installed as indicated. The bed must have 3 rows of 12 chambers, for a total of356 square feet (SF) of infiltrative area, and 36 total chambers. A 1.5-inch perforated PVC lateral must be suspended within each row of Onsite Wastewater Systems Page 2 chambers. The lateral must have \/,i-inch holes on 3.5-foot centers with the holes facing up. One hole must face down for drainage. A level manifold must be used to distribute effluent. Construction must be according to the Garfield County Environmental Health Department OWS regulations, the OWS Constmction Permit provided by the county, and this design. This design for the subject property, noted above, is valid only in conjunction with the approved Garfield County Environmental Health Department. OPERATION INFORMATION AND MAINTENANCE The surface of the drain field should be seeded upon completion. Vegetation is an important factor in drain field performance. Erosion control should be practiced prior to and during re-vegetation. Geofabrics or plastics should not be used over the drain field. No heavy equipment, machinery, or materials should be placed on backfilled drain field. Livestock should not graze on the drain field. Plumbing fixtures should be checked to ensure that no additional water is being discharged to OWS. For Example, a mm1ing toilet or leaky faucet can discharge hundreds of gallons of water a day and halm a drain field. The homeowner should pump the septic tank every two years and clean the effluent filter as needed. Garbage disposal use should be minimized, and non-biodegradable materials should not be placed into the OWS. Grease should not be placed in household drains. Loading from a water softener should not be discharged into the OWS. No hazardous wastes should be directed into the OWS. Mechanical room drains should not discharge into the OWS. The OWS is engineered for domestic waste only. ADDITIONAL CONSTRUCTION NOTES If design includes a pump, air release valves and weep holes should be installed to allow pump lines to drain to minimize risk of freezing. Excavation equipment must not drive in excavation of drain field due to the potential to compact soil. Extensions should be placed on all septic tank components to allow access to them from existing grade. Precast concrete tanks and distribution boxes should be used, unless plastic or fiberglass is required. Access to all tank compartments and distribution devices is optimal. INSTALLA TION OBSERVATIONS ALL SERVICE septic, LLC, and the county must view the OWS during construction. The OWS observation shonld be performed before backfill, after placement of chambers and distribution pipes. Septic tanks, distribution devices, pumps, dosing siphons, and other plumbing, as applicable, must also be observed. ALL SERVICE septic, LLC should be notified 48 hours in advance to observe the installation. LIMITS: Onsite Wastewater Systems Page 3 The design is based on infOlmation submitted. The Association may maintain errors and omissions insurance for its officers and directors in addition to liability and casualty insurance coverage, all of which shall be asses~ed to the Owners as a common expense of the Association. 5. Lot Development Regulations. (a) Building Envelopes. (I) Number and Location of Buildings. The Architectural Committee shall mean the Board of Directors of the Prehm Ranch Owners Association, Inc. as said Board of Directors is' presently constituted and shall be constituted from time to time in the future or Committee members appointed from time to time by the Board of Directors. Said Architectural Committee shall have and exercise all of the powers, duties and responsibilities set out in this instrument. Architectural Committee members may, but need not be, Owners. (2) Approval by Architectural Committee. No improvements of any kind, including but not limited to dwelling houses and structures, barns, stables, outbuildings, swimming pools, tennis courts, ponds, parking areas, fences, walls, garages, drives, antennae, flag poles, curbs and walks, shall ever be erected, altered or permitted to remain on any lands with the Prehm Ranch, nor shall any excavating, clearing or landscaping be done in conjunction therewith on any lands within the Prehm Ranch, unless complete architectural plans and specifications and a site plan showing the location and orientation thereof and proposed site improvements, grading and clearing plans for such erection or alteration and landscaping are approved by the Architectural Committee prior to commencement of such work. The Architectural Committee shall consider the materials to be used on the external features of said buildings or structures, including exterior colors, harmony of external design with existing structures within the Prehm Ranch, location and height with respect to topography and finished grade elevations and harmony of landscaping with the natural setting and native trees, brushes and other vegetation within the Prehm Ranch. The complete architectural plans and specifications must be subrnitted in at least two (2) complete sets, and must include at least four (4) different elevation views. One (1) complete copy of plans and specifications shall be signed for identification by the Owner and left with the Architectural Committee. In the event 'the Architectural Committee fails to take any action within forty-five (45) days after complete architectural plans for such work have been submitted to it, then all of such submitted architectural plans shall be deemed to be approved. In the event the Architectural Committee shall disapprove any architectural plans, the person or legal entity submitting the same may appeal the matter at the . next annual or special meeting of the members of the Prehm Ranch Owners Association, where an affif11)ative vote of at least a majority of the members' votes entitled to be cast at said Members' (meeting shall be required to change the decision of the Architectural Committee. REOUEST Mr. John Schneider requests a pennit for an Accessory Dwelling Unit (ADU) in the Rural Zoning District on Lot 5 at The Preserve at Prehm Ranch. This parcel is 35.751-acres, with water provided via a second well approved by the Colorado Division of Water Resources and property tested for quality and quantity under the provisions of the Unified Land Use Resolution of 2008, as amended. An Individual Sewage Disposal System has been designed to accommodate this use. 2. DESCRIPTION OF THE PROPOSAL The applicant requests an Administrative Pennit to allow for an Accessory Dwelling Unit (ADD) on Lot 5 at The Preserve at Prehm Ranch. The ADD will be a new residential structure containing less than 1,500 square feet of finished floor area and the minimum lot size requirement has been met. 3. APPLICABLE REGULATIONS The Land Use Table contained in Alticle III of the Land Use Resolution of 2008 (ULUR), as amended designates an ADU as a Use Permitted Subject to Administrative Review. Section 7-801 stipulates requirements that must be met in order to apply for the General Administrative Permit. Those requirements include a minimum lot size of 2 acres or twice the minimum lot size in zone districts where the minimum lot size is less than 2 acres. The subject property is 35.751 acres therefore compliant with this requirement. In addition, the maximum square footage for an ADU in the rural zone district is 1,500 square feet which is not exceeded in the current request. . Section 4-104 stipulates the Administrative Review Process and Section 7-801 provides applicable standards for an ADU. All requirements have been met, including the requirement for notice to the adjacent properties, which the applicant has completed; submitting certified return receipts for that notice. 4. REFERRAL COMMENTS The Glenwood Springs Fire Department commented on the proposed Accessory Dwelling Unit and offered recommendations for constrution of the residence to driveway distance and landscaping considerations to reduce wildfire hazard. A copy of these recommendations have been forwarded to the applicant and is attached as Exhibit A. Garfield County Road and Bridge recommended conditions for proper permitting of oversize/overweight vehicles during condition which is attached as Exhibit B. A condition has been added for proper pennitting of oversize/overweight vehicles utilizing the County's roadway network. 5. RECOMMENDATION Staff finds that the proposed ADU is in compliance with Article III, §4-104, §4-501 and §7-801 of the Garfield County Unified Land Use Resolution of 2008 as amended and recommends that the Director approve the General Administrative Permit to allow an ADU on a property legally described as Lot 5 at The Preserve at Prehm Ranch, with the following conditions: 1.
