prev iously, we are in the process of preparing the Limited Impact Review application for th is existing fac ility and are in studies and coordination with the Colorado Department of

Co., LLC will be making application to Garfield County for building permits for each of the buildings. These installations are being conducted as a normal course of maintenance of the
facility and are necessary for the effic ient operation of the fac ility , The materials to be stored are not in excess of the maximum allowable quantity limits for control areas set
forth in I BC 2009-Tables 307.1 (I) and 307, I (2), The occupancy for each has been determined to be Section 311.3 Low-hazard storage, Group S-2. The nine buildings are accessory to
the ex isting use of the property and do not result in a new use of the propelty and no new ground di sturbance will occur for this installation, Page I of3
I have conducted a review of the Garfield County Unified Land Use Resolution of2008, as amended. Section 4-107-Amendments to an Approved Land Use Change Permit. My assertion is that
this requested change is "No substantial modification". Please find below my response to each item of criteria that must be satisfied. Section 16-101 of the ULUR defines Non-substantial
change. Non-substantial Change. A non substantial amendment may be made to an approved Land Use Change Permit if it meets all of the following criteria as determined by the Director:
I. Is consistent with action(s) taken during previous Land Use Change Permit approval. Reply: The proposed structures are consistent as this facility is a pre-existing facility that
has been in operation since the 1980' s. The installation of these buildings to serve the site is appurtenant to this type of use and is in support of the operations of the water handling
facility. 2. Does not change the use category of the proposed development between residential, commercial and industrial uses; Reply: The use category will not be changed. 3. Does not
change the basis character of the approved use ofland on which the activity occurs, including basis visual appearance and method of operation; Reply: The visual appearance will not be
changed with the addition of the buildings as each will be painted Desert Tan to match the color scheme of the area and the facility. 4. Does not constitute a new land development activity;
Reply: This use does not constitute a new land development activity as this is appUltenant to the operation of the Parachute Water Handling facility. 5. Does not violate any Land Use
Code standard; Reply: The proposed buildings do not violate any Land Use Code standard. 6. Does not substantially increase off-site impacts (including but not limited to increased traffic,
water use, wastewater generation, etc.) in the surrounding neighborhood; Reply: Off-site impacts are not substantially increased 7. Does not substantially increase the need for on-site
parking or utilities; Reply: On-site parking or utilities needs will not be substantially increased. 8. Does not increase the floor area of the use by more than five (5) percent or decrease
the open space on the site by more than five (5) percent; and Reply: The floor area will be increased by more than 5 percent. The open space of the site will not be decreased by more
than 5 percent. As noted in our conversation on 1/26111 at your office, "Storage Areas", as each of these proposed buildings are storage, are technically exempted from the Garfield County
Unified Resolution of2008, as amended, thus we are in compliance with this condition. 9. Does not endanger the public health, safety or welfare. Reply: Public health, safety and welfare
will not be endangered. (Resolution 20 I 0-30) Please consider this letter a summation of the project and a request for planning clearance so that the building permits can be issued.
