HomeMy WebLinkAbout2.0 Resolution 2011-83STATE OF COLORADO )ss County of Garfield 1111 INIIIIIINAVILIVI , d 61/414141VP111.I 1A 11111 Reception #: a12270 12120/2011 02 ;26:32 PM Jean Alberico i of 4 Rep Fee:$0,00 Doo Fee:0.03 GRRFIELD COUNTY CO At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday the 19th of December, 2011, there were present: John Martin Mike Samson Tom Jankovsky Andrew Gorgey Carey Gagnon Ed Green a4s.f� Jean Alberico , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Assistant County Attorney , County Manager Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2011- 83 A RESOLUTION CONCERNED WITH THE APPROVAL OF A TEXT AMENDMENT TO AMEND SECTIONS 8 -102 OF THE UNIFIED LAND USE RESOLUTION OF 2008, AS AMENDED, THAT ADDRESS THE APPLICABILITY OF THE AFFORDABLE HOUSING REGULATIONS Recitals A. The Board of County Commissioners of Garfield County, Colorado, was the applicant for a Text Amendment to amend the Unified Land Use Resolution of 2008, as it pertains to Section 8 -102, Applicability of the Affordable Housing regulations. B. On December 14, 2011 the Garfield County Planning and Zoning Commission held a public hearing and forwarded a recommendation of a 5 -2 vote to approve the proposed text amendment. C. On December 19, 2011, the Board of County Commissioners opened a public hearing at which hearing the public and interested persons were given the opportunity to express their opinions regarding said text amendment. D. The Board of County Commissioners closed the public hearing on December 19, 2011 to make a final decision. E. The Board of County Commissioners on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That the hearings before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard; and 3. That the application has met the requirements of the Garfield County Unified Land Use Resolution of 2008, as amended. 4. The proposed text does not conflict with State statutory provisions regulating land use. That the proposed text amendment is determined to be in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Garfield County Unified Land Use Resolution of 2008, and as subsequently amended by this Board, shall be and hereby is amended and said language will be incorporated into the codified Garfield County Unified Land Use Resolution as shown on the attached Exhibit A. These requirements for affordable housing shall apply to all land use change applications in Garfield County, such that 4-5 10% of the lots proposed in the development shall be developed with affordable housing units. This regulation shall apply to all developments proposing 15 five -(5-) or more lots in and that are located within Area 1, as shown in Figure: 8 -1, These requirements shall apply to residential applications including rental housing, not commercial applications. In computing this requirement, any fraction of a unit lot above .501 will be rounded up and any fraction of a unit lot less than .50 will be rounded down.
