HomeMy WebLinkAbout6.0 Resolution 2004-611 11111 11111 1111111 111 1111111 11111 11111 Ill 11111 1111 1111 657205 08/04/2004 11:58A B1610 P634 M ALSDORF 1 of 4 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO )ss County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commmissioners' Meeting Room, Garfield County Plaza, in Glenwood Springs on, Monday, the 19" day of July A.D. 2004, there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Tresi Houpt , Commissioner Don DeFord , County Attorney Mildred Alsdorf , Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2 00A - A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR A GROUP RESIDENTIAL FACILITY FOR CHILDREN AND YOUTH A PROPERTY OWNED BY ROBERT LAY LOCATED AT 1359 COUNTY ROAD 294 Parcel ID: 2177 - 104 -00 -008 WHEREAS, the Board of County Commissioners of Garfield County, Colorado ( "Board "), received an application from Robert Lay for Group Residential Facility for Children and Youth which is contemplated as a Special Use within the A/R/RD (Agricultural / Residential / Rural Density) zone district; and WHEREAS, the Special Use Permit includes the conversion of a single- family dwelling on a 5 -acre parcel into a Group Residential Facility for Children and Youth which will provide a residential treatment center and special education school for up to 14 emotionally disturbed females between the ages of 9 and 18 that are enrolled in the Emily Griffith Center program; and WHEREAS, the Board held a public hearing on the 1911' day of duly, 2004, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the 1 1 11111 1111 1111111 1 11 3111 1111 11111 111 11111 1111 111 657205 08/04/2004 11:588 B1610 P635 M ALSDORF 2 of 4 R 0.00 D 0.00 GARFIELD COUNTY CO aforementioned hearing, has made the following determination of fact as listed below: 1. Proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. The meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of Special Use (Sections 2.02.283, 3.02.03, 5.03, 5.03.023 and 9:03) the Garfield County Zoning Resolution of 1978, as amended. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Special Use Permit is hereby approved subject to compliance with all of the following specific conditions; 1. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. All uses shall continually be consistent with the definition of a Group Residential Facility as defined by the Board of County Commissioners. 3. The Applicant shall provide the Planning Staff with an activated augmentation contract from the West Divide Water Conservancy District and amended well permit from the Division of Water Resources prior to the issuance of a Special Use Permit. 4. The Applicant shall obtain a septic permit from the Garfield County Building and Planning Department prior to the issuance of a Special use Permit. This system shall be installed by a licensed contractor. 5. The Applicant shall complete the following improvements prior to the release of any building permit for the property. The Applicant shall provide the Planning Staff with an approval from the Road and Bridge Department indicating the following has been completed to their satisfaction; A. Relocate the existing driveway 220 feet to the west to reduce safety hazards presented by the sharp curve in the County Road; B. Install a 40' long culvert that is of 18" diameter to go under the driveway entrance to allow road ditch drainage to pass; C. The remainder of the driveway shall consist of a gravel surface at least 100 feet back into the property; and E. The existing driveway has been abandoned and reseeded to be incorporated into the lawn of the property. 6. The Applicant shall submit proof of all required state and/or federal licenses, as applicable to the services provided and population served by the facility prior to the issuance of a Special Use Permit. 7. The residential structure shall be obligated to connect to the City of Rifle's central sewer system when service becomes available. 8. The Applicant shall form a "Neighborhood Advisory Committee" to communicate with the neighbors on a regular basis to hear problems and resolve issues. The Applicant shalt return to the Board of County Commissioners in six months (on January 3, 2005) where the Applicant shall present a status of the operations that includes comments from local law enforcement agencies . including the City of Rifle Police Department and the Garfield County Sheriff's Office as well as the Neighborhood residents regarding complaints. ,,,Lailiuu+kr,,� Dated this 2nd day of August , A.D. 20 04 . ••'•• t • C.4 i.
