BASALT WATER CONSERVANCY DISTRICT
RESOLUTION NO.
WHEREAS, the Basalt Water Conservancy District (hereinafter
the "District") possesses numerous conditional water rights and
administer such water rights adjudicated to the Basalt Project;
and
WHEREAS, the District has been formed for the purpose of
planning and implementing water resource development projects
for the benefit of the citizenry of said District and has been
designated as the - repayment entity for the Basalt Project; and
WHEREAS, the District recognizes that it must undertake
efforts to apply such water rights to beneficial use or lose
said conditional water rights for failure to diligently pursue
the development thereof; and
WHEREAS, the District has petitioned the Colorado River
Water Conservation District (hereinater the "River District ")
for the supply of quantities of water impounded within Ruedi
Reservoir; and
WHEREAS, the District recognizes that the supply of water
from Ruedi Reservoir by the District and River District should
be by,means consistent with local government land use plans; and
WHEREAS, the District recognizes that the supply of water
from Ruedi Reservoir by the District and River District should
be consistent with its surface recreational, stream recreational
uses, and releases of Ruedi Reservoir water should further be
consistent with minimum stream flow purposes; and
WHEREAS, the District acknowledges and states that it
neither purports to be nor desires to be a public utility
pursuant to the provisions of C.R.S. 1973, Secs. 40 -3 -101, et
seq., as amended; and

WHEREAS, the District cannot be compelled to serve water
other than by action of the District; and
WHEREAS, the District does not desire to hold itself out as
serving or ready to serve all members of the public who may
require water.
NOW, THEREFORE, in consideration of the above - stated
statements and principles and the following terms and condi-
tions, the District establishes the following operating criteria
and policy for the utilization and development of the water
rights owned and administered by the District:
1. The District will undertake and secure all actions
necessary and appropriates to preserve its conditional water
rights;
2. The District will not act in a manner such that it may
be compelled to provide water serve to any and all parties,
except by specific investigations and determinations by the
Board of Directors of the District;
3. The District will not hold itself out as serving or
ready to serve any and all parties requesting service within
District boundaries;
4. The District will not acknowledge and represent its
ability and desire to provide water service to new municipal and
industrial developments until requested by applicable local
governments;
S. The District shall request applicable local governments
to review all new municipal and industri1 developments and
establish and adopt guidelines, consistent with local land use
plans, for requests of water service by the District;
6. The District will not request releases of any Ruedi
Reservoir water pursuant to its water contracts when such
releases would cause a reduction in the surface area of Ruedi
Reservoir and, therefore, its use for recreational purposes;

7. The District will not request releases of any Ruedi
Reservoir water pursuant to its water contracts except as such
releases are consistent with established minimum stream flow
appropriations.
8. The District will request the Colorado Water Conser-
vation Board, the United States Bureau of Reclamation, and the
River District to establish a method of operation of Ruedi
Reservoir consistent with the terms of this Resolution.
