Unfortunately, the information that you provided on October 3, 2013 didn't satisfy what was needed under "Authorization" of the technically incomplete letter dated August 9, 2013. An "Amendment To Collocation Site Agreement" was provided but in order to be a valid agreement this document has to be signed by both parties. Also, the narrative addressing 4 -106.0 was received after the given 60 days to correct the submittal's deficiencies. Give me a call if you have any further questions. Thanks, Molly 1 AM* Garfield County October 16, 2013 Attention: Matthew Fillmore JAB Wireless DBA Skybeam 619 14th Street SW Loveland, CO 80537 RE: Richard and Karen Rhoades — Amendments to an Approved Land Use Change Permit (LPPA 7648) Dear Matthew, I am writing this letter regarding the Richard and Karen Rhoades application for Limited Impact Review for an amendment to a Land Use Change Permit. At this time the application does not include all required information per Garfield County Regulations. The application is therefore deemed incomplete and withdrawn. As per Article 4, Section 4 -101 (B)(2)(a) of the Land Use and Development Code (LUDC), "If the application is not complete, the Director shall inform the Applicant of the deficiencies in writing and shall take no further action on the application until the deficiencies are remedied. If the Applicant fails to correct the deficiencies within 60 calendar days, the application shall be considered withdrawn and returned to the Applicant." Should the applicant desire to submit (re- submit) this application they are able to do so pursuant with the regulations contained within the LUDC. However, there is no guarantee that the same planner will be assigned to the new application. Please note that a new application fee will be charged with this submittal.
