The purpose of this letter is to inform you that the application has been deemed technically complete. Please understand that a determination of technical completeness by this office shall not be deemed a recommendation of approval, finding of adequacy of the application, or a finding of general compliance with any goal or objective of the Garfield County Land Use Resolution of 2008, as amended or the Comprehensive Plan of 2030. The Applicant is requesting to waive submittal requirements 4 -203 (F) Landscape Plan. The Director reviewed the waiver request and determined that this item may be waived. As per Section 4 -117 Waiver of Standards, the Applicant can request a waiver of standards in Article 7, excluding those in Division 1, as part of Land Use Change Permit process. The Applicant is requesting to waive 7 -1101 (E) Storing and 7 -1203 Landscape and Screening standards. This request will be documented in the staff report but final approval of this waiver shall be the responsibility of the Decision- Making Body of the Land Use Change application. The application will be reviewed by Staff, a staff report will be generated and sent to you, and the Board of County Commissioners will discuss and review the application at a public hearing which has been scheduled for Monday, June 17, 2013, on the Board of County Commissioner's public hearing agenda which begins at 1:00 PM. The public hearing will be held in the County Commissioners Meeting Room, Garfield County Plaza Building, 108 8th Street, Glenwood Springs, Colorado, 81601. As a matter of process, the BOCC shall hold an advertised public hearing on the proposed action at a regularly scheduled meeting. The Applicant shall be solely responsible for the 1 publication, property posting, and mailing of all notices. The Applicant shall present proof of publication and mailing at or before the meeting. The item cannot be heard if correct noticing requirements have not been met. Notice for the meeting shall be given as follows: 1. Notice by Publication. At least 30 but not more than 60 calendar days prior to the date of a scheduled public hearing before the Planning Commission or BOCC, the Applicant shall publish notice of a public hearing in a newspaper of general circulation (Rifle Citizen Telegram is the official newspaper), unless otherwise specified by the Colorado Revised Statutes. 2. Written /Mailed Notice to Adjacent Property Owners. a. Written notice shall be provided at least 30 but not more than 60 calendar days prior to the date of a scheduled public hearing. b. The Applicant shall send written notice by certified mail or by a nationally recognized overnight courier, return receipt requested. c. Written notice shall be provided to the owners of record of all adjacent property within a 200 -foot radius of the subject parcel, as shown in the office of the County Clerk and Recorder or Assessor, at least 30 calendar days prior to sending notice. Within the same time period, written notice shall be provided to owners of mineral interests in the subject property (other than construction materials as defined in C.R.S. § 34- 32.5 -1, as amended) in accordance with C.R.S. § 24- 65.5 -101, et seq., as amended. 3. Posting of Notice. At least 30 and not more than 60 calendar days prior to the date of a scheduled public hearing, the Applicant shall post a notice of the public hearing on the property. Posted notice shall consist of at least 1 sign facing each adjacent road right - of -way, and located so as to be fully visible from the road right -of -way generally used by the public. The notice signs shall be provided to the Applicant by the Planning Department. Two signs have been included with this letter. 4. Contents of Notice. The notice shall follow a form prescribed by the County. 5. Applicant Responsibility. It shall be the responsibility of the Applicant to provide the names and mailing addresses as shown in the office of the County Clerk and Recorder or Assessor pursuant to Section 4-101.E.2.(3) as part of their application. 6. Proof of Notice. At the public hearing, the Applicant shall provide proof of publication, proof of notification or attempt of notification of Adjacent Property Owners, and proof of posting notice on the property. The Applicant shall provide proof of notification or attempt to notice owners of mineral interest in the subject property. 2 I have enclosed a suggested public notice which I will also email to you in MS Word format so you can add necessary information such as the legal description of the subject site. A poster will be necessary to meet the requirement for posting of the property and is included in this hardcopy mailing to you. These posting and public notice documents for the BOCC public hearing are provided as a courtesy. The Applicant must verify that all information provided in these documents is correct. As always, it is the obligation of the Applicant to correct any deficiencies such that proper notice in form and substance can be established. NOTE: Please submit 9 copies of the completed application and 11 complete applications on compact disk to this office no later than Monday, May 13, 2013. The digital version should include a pdf of the entire application and a Microsoft Word version of the narrative and supporting analysis. If the copies have not been submitted by this date, your public hearing may be jeopardized. Please delivery this material to the Glenwood Springs Planning Department. The site is located within the Rural zoning district. All persons affected by the proposed Limited Impact Permit to allow a Compressor Station are invited to appear and state their views, protests or support. If you can not appear personally at such hearing, then you are urged to state your views by letter, as the Board of County Commission will give consideration to the comments of surrounding property owners, and others affected, in deciding whether to grant or deny the request.
