The well was approved for conversion to an injection well by Resolution 2012 -45 and the Land Use Change Permit issued on June 18, 2012 (File No. LIPA - 7168). The site is located north of the Town of Debeque off of County Road 213. The site is located in Section 4, T6S, R97W and is part of the property known by Assessor's Parcel No. 2169 - 214 -00 -026. The application for an Amendment to an Approved Land Use Change Permit requests the allowance for two additional 400 bbl water storage tanks. As indicated on the site plan these tanks will be placed within the existing containment area. Your Application has been reviewed in accordance Section 4 -106 of the Unified Land Use Resolution of 2008 as amended (ULUR), Amendment to an Approved Land Use change Permit. Said provisions require a Decision by the Director as to whether the proposed amendment is a Minor or Substantial Modification. Based on the criteria found in Section 4- 106.C, the Director has found your amendment request to be a Minor Modification and has therefore approved your requested amendment subject to the following conditions: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 1 2. Prior to the issuance of the amended Land Use Change Permit associated with the additional storage tanks the Applicant shall provide the County with verification from a licensed professional engineer that the containment and Spill Prevention Containment and Countermeasures (SPCC) Plans for the site are designed to include and accommodate the additional tanks and storage volume. 3. All previous conditions of approval contained in Resolution No. 2012 -45 shall remain in effect. Prior to issuance of the amended Land Use Change Permit associated with the additional storage tanks the Applicant shall provide the County with confirmation that in accordance with Condition No. 14 of Resolution No. 2012-45, the site is in compliance with the recommendations of the Erosion and Sediment Control report completed by Olsson Associates dated 2/27/12, including but not limited to, installation of two additional sediment traps. In accordance with Section 4- 106(B)(1)(a) and this Director's Decision Letter, an Amended Land Use Change Permit will be issued by the Director.
