Airway Road Lebanon, Oregon 97355 Dear Mr. Knox: Airspace Case No. 2010 -ANM- 773 -NRA Northwest Mountain Region Denver Airports District Office Colorado, Idaho, Montana 26605 East 66th Ave., Suite 224 Oregon. Utah. Washington, Denver, Co 80249 - 6361 Wyoming (303) 342 -1251 An airspace analysis of the proposed private use Juniper Hills Airstrip, Parachute, Colorado, has been completed. Based on this study, the Federal Aviation Administration (FAA) objects to the proposal based on the close proximity of the private use Dry Pen Airport. The Air Traffic Office will remove this objection provided you enter into a signed Letter of Agreement (LOA) with the owner of the Dry Pen Airport, which at a minimum should contain the following: (1) Common frequency to be monitored by all aircraft using these airports. (2) Description dead' airport's traffic pattern (the Air Traffic Office recommends Dry Pen establish right traffic pattern for Runway 27 and Juniper Hills establishes right traffic for Runway 12. (3) The altitude of each airport's traffic pattern. (4) Aeronautical operations at the airport. Once this agreement is initiated by and signed by both you and the owner of the Dry Pen Airport, please provide a copy to this office, and reference the above airspace case number. 1f acceptable to the Air Traffic Office, the objection will be removed, and a revised determination letter will be issued. This is a determination with respect to the safe and efficient use of airspace by aircraft and with respect to the safety of persons and property on the ground. In making this determination, the FAA has considered matters such as the effect the proposal would have on the existing or planned traffic patterns o neigi+oring airports, the effects it wou + lave on the existing airspace structure an projectes program of the FAA, the effects it would have on the safety or persons and property on the ground, and the effects that existing or proposed than -made objects (on file with the FAA) and known natural objects within the affected area would have on the proposal. Airway Road Lebanon, Oregon 97355 Dear Mr. Knox: Airspace Case No. 2010 -ANM- 773 -NRA Denver Airports District Office 26805 East 68th Ave., Suite 224 Denver, CO 80249 -6361 (303) 342 -1250 A revised airspace analysis has been completed for the proposed private use Juniper Wills Airport, Parachute, Colorado, at the location as submitted on Form 7480 -1. Based on this study, the Federal Aviation Administration (FAA) has no objection, provided the Letter of Agreement you entered into with the existing Dry Pen Airport dated November 30, 2010, is complied with, Operations should be conducted in accordance with the communications requirements and restrictions of the overlying class of airspace. We recommend that a clear 20:1 approach slope be established and maintained. Please check the performance capabilities oldie aircraft you intend to operate at your airport to ensure you have adequate runway length. All users of the airport should be briefed on operating conditions at the airport. This determination does not mean FAA approval or disapproval of the physical development involved in the proposal. It is a determination with respect to the safe and efficient use of airspace by aircraft and with respect to the safety of persons and property on the ground. This determination does not relieve the proponent of responsibility for compliance with any local law, ordinance or regulations, or state or other Federal regulations. In making this determination, the FAA has considered matters such as the effect the proposal would have on the existing or planned traffic patterns of neighboring airports, the effects it would have on the existing airspace structure and projected program of the FAA, the effects it would have on the safety of persons and property on the ground, and the effects that existing or proposed man -made objects on file with the FAA) and known natural objects within the affected area would have on the proposal. The FAA cannot prevent the construction of structures near an airport. The airport environs can only be protected through such means as local zoning ordinances or acquisition of property rights. It is up to you, as the owner, to provide for this protection. No evaluation of the environmental aspects of the proposal was made in reaching this determination. Therefore, this determination is not to be construed as approval of the proposal from an environmental standpoint under Public Law 91 -190 (National Environmental Policy Act of 1969). Airspace Use Agreement as per request by FAA Denver District Office. This document constitutes an agreement between: Donald Throm, Owner of Dry Pen Airport at 1689 Co. Rd. 300, Parachute, CO 81635 And, Larry D. Knox, Owner of (Proposed) Juniper Hills Airport at 1000 Juniper Hills Drive, Parachute, Colorado, 81635 The above Owners have agreed to; 1) Monitor the common airport traffic frequency of 122.9 2) Dry Pen will establish a right traffic pattern for their Runway 27 3) Juniper Hills will establish a right traffic pattern fur Runway 12 4) Dry Pen will establish a pattern altitude of 6200 Ft MSL 5) Juniper Hills will establish a pattern altitude of 6500 Ft MSL 6) Aeronotical Operations on both Airports are Private Use with usage by others upon approval by Owners Signed this of Nove F t er, 2010 by, Donald Throm, Owner of Dry Pen Airport Larry D.
