The purpose ofthis letter is to inform you that your request for a special use permit will be heard
before the Board of County Commissioners at a public hearing on Monday, April 14, 2003, at
1: 15 p.m. in the Garfield County Plaza Building, Commissioners Hearing Room, Suite 100, 108
8th Street, Glenwood Springs, Colorado. Should this date be inconvenient for you, please contact
me for a different meeting date.
The Friday prior to the meeting date, a staff report and agenda, which will indicate the
approximate order of items to be heard at the meeting, will be available for you to pick-up in the
Building and Planning Department, or a copy can be mailed to you upon request.
The applicant is solely responsible for the publication, posting, and mailing of all notices and shall
present proof of publication and mailing at the hearing. Pursuant to Section 9.03.04(1-3) of the
Garfield County Zoning Resolution, notice for the hearing shall be given as follows:
( 1) Notice by publication, including the name of the applicant, description of the subject lot, a
description of the proposed use and nature of the hearing, and the date, time and place for the
hearing shall be given once in a newspaper of general circulation in that portion of the County
in which the subject property is located at least thirty (30) but not more than sixty (60) days
prior to the date of such hearing, and proof of publication shall be presented at hearing by the
applicant.
(2) Notice by mail, containing information as described under paragraph (I) above, shall be
mailed to all owners ofrecord as shown in the County Assessor's Office oflots within two
hundred feet (200') of the subject lot and to all owners of mineral interest in the subject
property at least thirty (30) but not more than sixty ( 60) days prior to such hearing time by
certified return receipt mail, and receipts shall be presented at the hearing by the applicant.
(3) The site shall be posted such that the notice is clearly and conspicuously visible from a public
right-of-way, with notice signs provided by the Planning Department. The posting must take
place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the
sole responsibility of the applicant to post the notice, and ensure that if remains posted until
and during the date of the hearing.

Please use the attached public notice for the publication and mailings. A copy of the public notice
sign, to be posted on the property, will be available for you to pick up in the Building and
Planning Department, 108 gth Street, Suite 201, Glenwood Springs. Failure to comjJlete the
above stated noticing requirements will require re-noticing for a future hearing. It is your
responsibility to ensure the legal description you provided to this office, included in this notice, is
accurate.
Please submit 10 additional copies of a complete application by Monday, March 17, 2003.

PUBLIC NOTICE
TAKE NOTICE that Bruce and Betty Collins have applied to the Board of County Commissioners,
Garfield County, State of Colorado, to request a special use permit, pursuant to Sections 3.01.03 and
5.03 of the Garfield County Zoning Resolution ofl 978, as amended, in connection with the following
described property situated in the County of Garfield, State of Colorado; to-wit:

Practical Description: The subject property is an approximately 11 acres tract ofland located at
4941 County Road 346, Silt.
Request Description: The special use permit would allow for a structural steel fabrication shop and
storage yard on the subject property.
All persons affected by the proposed special use are invited to appear and state their views, protests
or support. If you can not appear personally at such hearing, then you are urged to state your views
by letter, as the Board of County Commissioners will give consideration to the comments of
surrounding property owners and others affected in deciding whether to grant or deny the request for
the special use. The application may be reviewed at the office of the Building and Planning
Department located at 108 8th Street, Suite 201, Garfield County Plaza )3uilding, Glenwood Springs,
Colorado between the hours of8:30 a.m. and 5:00 p.m., Monday through Friday.

The public hearing on the application has been set for the 14th day of March, 2003, at 1:15
p.m., in the County Commissioners Chambers, Garfield County Plaza Building, Suite 100, 108 8th

Re: Fritzlan/Hangs (Collins) Special Use Permit
Dear Betty and Bruce:

As you are aware, at the public hearing this afternoon, the Board of County Commissioners
moved to approve the Special Use Permit application for a structural steel fabrication shop, office
and storage yard, subject to the following conditions:
1. All representations of the Applicant, either within the application or stated at the meeting
before the Board of County Commissioners, shall be considered conditions of approval,
unless specifically altered by the Board.
2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning
Resolution of 1978, as amended.
3. The Applicant shall comply with all State and Federal regulations and standards, such as
Noise Abatement, Water and
Air Quality.
4. The Applicant shall comply with the Garfield County Noxious Weed Management Plan.
5. Building permits are required for the new structures.
6. The area of the storage ofraw materials will be screened with appropriate berm (minimum
4' in height) and trees, and/or fencing on the north and trees or other vegetative growth
on the east and west. The berm and trees, and/or fencing, and other vegetative growth
shall be installed within 6 months of the issuance of the Certificate of Occupancy.
7. All lighting fixtures shall be designed and placed to prevent direct reflection on adjacent
properties, Interstate 70 and County Road 346.
8. The Applicant shall comply with the following recommendations from the Garfield County
Road and Bridge Department:
a. No off-loading or parking shall take place on County Road 346.

b. A stop sign shall be installed on the property to the entrance to County Road 346.
The sign shall be installed in conformance with standards set forth in the Manual on
Uniform Traffic Control Devices.
9. Vibration, emission of smoke and particulate matter, and the emission of heat or radiation
shall comply with applicable Federal, State, and County laws, regulations and standards.
10. The Applicant shall comply with all Local, State and Federal Fire Codes that pertain to the
storage of oxygen, acetylene and mineral spirits.
11. The Applicant shall obtain and provide the Planning Department a copy of an exempt
commercial well permit. Shall water usage exceed 113 acres feet, the Applicant shall
obtain the additional contract water from West Divide Conservancy District.
12. Any uses in addition to the steel fubrication shop, office and storage yard shall obtain the
appropriate special use or conditional use permit, if applicable.
13. Garfield County shall enforce appropriate noise regulations which may require the
Applicant to meet the "Residential' zone noise level (55 db(A)) pursuant to Colorado
State Statue 25-12-130.
Once condition # 11 above has been met, the special use permit can be issued. No building permit
will be issued until the special use permit is issued. Please do not hesitate to contact me if you

I have scheduled the Resolution of approval before the Board of County Commissioners on
Monday, May 5, 2003, at 8:15 a.m. in the Garfield County Plaza Building, Commissioners
Hearing Room, Suite 100, 108 8th Street, Glenwood Springs. These items have been placed on
the consent agenda for the Chairman's signature. You are not required to attend this meeting.
