I. APPLICATION SUBMITTAL REQUIREMENTS
As a minimum, specifically respond to all the following items below and attach any additional information to
be submitted with this application:
1. Please submit, in narrative form, the nature and character of the Special Use requested.
Submit plans and supporting information (i.e. letters from responsible agencies). Include
specifications for the proposed use including, but not limited to, the hours of operation, the
number and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and
the size and location of any existing and/or proposed structures that will be used in conjunction
with the proposed use, and provisions for electric power service and any other proposed utility
improvements. Be specific.
2. If you will be using water or will be treating wastewater in conjunction with the proposed use,
please detail the amount of water that would be used and the type of wastewater treatment. If
you will be utilizing well water, please attach a copy of the appropriate well permit and any
other legal water supply information, including a water allotment contract or an approved water
augmentation plan to demonstrate that you have legal and adequate water for the proposed
use.

Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all
existing and proposed structures on the property, and the County or State roadways within one
( 1) mile of your property. If you are proposing a new or expanded access onto a County or
State roadway, submit a driveway or highway access permit.
Submit a vicinity map showing slope I topography of your property, for which a U.S.G.S.
1 :24,000 scale quadrangle map will suffice.
Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing all
mineral rights owners of the subject property and public and private landowners adjacent to
your property (which should be delineated). In additional, submit a list of all property owners
and their addresses adjacent to or within 200 ft. of the site. This information can be obtained
from the Assessor's Office.
//6. Submit a copy of the deed and a legal description of the subject property.
I 7. If you are acting as an agent for the property owner, you must attach an acknowledgement
from the property owner that you may act in his/her behalf.
8. Submit an statement that specifically responds to each of the following criteria from Section
5.03 of the Zoning Regulations:
(1) Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Board of County Commissioners shall either
be in place or shall be constructed in conjunction with the proposed use.
(2) Street improvements adequate to accommodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either be in place or
shall be constructed in conjunction with the proposed use;
(3) Design of the proposed use is organized to minimize impact on and from adjacent
uses of land through installation of screen fences or landscape materials on the periphery
of the lot and by location of intensively utilized areas, access points, lighting and signs in
such a manner as to protect established neighborhood character;
9. Depending on the type of Special Use Permit requested, you may need to respond to
additional review standards in the Garfield County Zoning Resolution Section 5.00
[Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 &
5.03.08], Accessory Dwelling Units (section 5.03.21], Utility line/Utility Substations, etc. Specific
sections of the Zoning Resolution which can be located on the Garfield County web site at
http://www.garfield-county.com/building and planning/index.htm, or information can be
obtained from this office
10. A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment" form and provide the
fee with the application.
11. Submit 2 copies of this completed application form and all the required submittal materials to
the Building and Planning Department. Staff will request additional copies once the Special
Use Permit application has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(The following steps outline how the Special Use Permit Application review process works in
Garfield County.)
1. Submit this completed application form, base fee, and all supplemental information to the
Garfield County Planning Department. It will be received and given to a Staff Planner who
will review the application for technical completeness.
2. Once the application is deemed technically complete, the Staff Planner will send you a
letter indicating the application is complete. In addition, Staff will also send you a "Public
Notice Form(s)" indicating the time and date of your hearing before the Board of County
Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum
regarding your requested Special Use. (If Staff determines you application to be deficient,
a letter will be sent to you indicating that additional information is needed to deem your
application complete.)
3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested Special Use and the public hearing. If proper notice has not occurred, the
public hearing will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed special use and nature of the hearing, and the
date, time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.
b. Notice by mail, containing information as described under paragraph (1) above,
shall be mailed to all owners of record as shown in the County Assessor's Office of
lots within two hundred feet (200') of the subject lot and to all owners of mineral
interest in the subject property at least thirty (30) but not more than sixty (60) days
prior to such hearing time by certified return receipt mail, and receipts shall be
presented at the hearing by the applicant.
c. The site shall be posted such that the notice is clearly and conspicuously visible
from a public right-of-way, with notice signs provided by the Planning Department.
The posting must take place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applicant to post the
notice, and ensure that it remains posted until and during the date of the hearing.
4. The Applicant is required to appear before the Board of County Commissioners at the time
and date of the public hearing at which time the Board will consider the request. In addition,
the Applicant shall provide proof, at the hearing, that proper notice was provided.
5. Once the Board makes a decision regarding the Special Use request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board. Following
the Board's approval, this office will issue the Special Use Permit to the applicant. If the
Board's approval includes specific conditions of approval to be met, this office will not issue
the Official Special Use Permit certificate until the applicant has satisfied all conditions of
approval. The Special Use Permit approval is not finalized until this office has issued the
Official Special Use Permit certificate signed by the Chairman of the Board of County
Commissioners.

2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the
administration of the fee structure.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reiml:>urse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision plan.

1) This well shall be used In such a way as to cause no material injury to existing water rights. The issuance of this permit does not assure the
applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil
court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 16.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well, appropriating ground water tributary to the Colorado River, as an
alternate point of diversion to the Avalanche Canal and Siphon, on the condition that the well shall be operated only when the West Divide
Water ConseJVancy District's substitute water supply plan, approved by the State Engineer, is in effect, and when a water allotment contract
between the well owner and the West Divide Water Conservancy District for the release of replacement water from Ruedi Reservoir is in effect,
or under an approved plan for augmentation. WDWCD contract #030612-BC(a).
4) Approved for the change in use of an existing well constructed September 1, 1984 to a depth of 60 feet, under permit no. 125776 (canceled).
The issuance of this permit hereby cancels permit no. 125n6.
5) Approved as a well on a tract of land of 11.70 acres described as that portion of the NW 1/4 of the NW 1/4, Sec. 17, Twp. 6 South, Rng. 92
West, 6th P.M., Garfield County, more particularty described on the attached exhibit A. Further identified as 0442 County Road 346, Silt, CO
81652.
6) The use of ground water from this well is limited to ordinary household purposes inside~(1) single family dwellin~. drinking an~ta.!Y,,,
facilities for a commercial business (structural steel fabrication shop),lhe Irrigation of not morelhan 6,000 square feet (0.14 of an acre) of
h·ome gardens and lawns, and the watering of not more than twenty (20) head of non-commercial domestic animals. All use of this well will be
curtailed unless the water allotment contract or a plan for augmentation is in effect. This well is known as Collins Weil.
7) The maximum pumping rate of this well shall not exceed 15 GPM.
6) The average annual amount of ground water to be appropriated shall not exceed 1.326 acre-foot (432,0n gallons).
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as
appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of ail diversions must be
maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
11) This well shall be located not more than 200 feet from the location specified on this permit.
NOTICE: This permit has been approved for the physical address noted above, as identified by the Garfield County Assessor. You are hereby
notified that you have the right to appeal the issuance of this permit, by filing a written request with this office within sixty (60) days of the date
of issuance, pursuant to the State Administrative Procedures Act. (See Section 24-4-104 through 106, C.R.S.)

Requirement #I for Special Use Submittal:
Nature and Character of Log Timber Framing Business:
The special use being requested is to permit a log timber framing business and staging
area on the property located at 4941 Co. Rd. 346. Top Notch Log Works is a 4 year old
business based out of Gypsum, their present facility is 5 miles West of Gypsum on Hwy
6 . Their raw materials consist of timber & logs which arrive on semi-tractor trailers
from Utah and Idaho wholesale distributors. These log timbers will be stored and formed
outside into finished products until they are ready for final installation into various
residential and commercial projects up and down the I-70 corridor. To reach customer
specifications fabrication entails the following processes: unloading from trucks with a
forklift or boom truck , cutting with gas powered chain saws, electric circular saws, and
electric band saw mills, drilling with electric hole hog drills, sanding with 7' hand held
grinders. The finished product is a natural looking log timber that is ready to be
incorporated into the framework of a house primarily as a support member but
occassionaly as decorational pieces. We approximate utilizing 3-5 acres for this
operation.

7am-5:30 pm, M-F with occasional weekends, i.e. 8 hours on a Saturday once a month.

the existing mobile home. Irrigation for any green space would come from the property's
2 shares of the Loesch Craun Ditch which runs through the property year round. (see well
permit and ditch rights attached)

Response:
(I) Adequate water and sanitation improvements to be constructed that are necessary
in conjunction with the proposed use.
(2) Adequate street improvements, such as widening access, flattening, and additional
road base or black top to be constructed which may be necessary in conjunction
with the proposed use.
(3) All activities conducted on the site, with the exception of the vehicle travel noted
above and loading and unloading of delivery trucks via a forklift, will be
conducted outside. Design of the proposed use shall be organized to minimize
impact on and from adjacent uses ofland through screening with an appropriate
berm (minimum 4' in height) and trees, and/or fencing on the north and trees or
other vegetative growth on the east and west and by locating intensively utilized
areas, access points, lighting and signs in such a manner as to protect established
neighborhood character. The warehouse and propane tanks are already painted in
earth tones. Any and all service vehicles that may be parked at the site will be
screened from view by the landscaping and/or fencing. Lighting will be placed
only as necessary for nighttime safety and security purposes and will be directed
downward and inward to the property. Signage will be used as required to comply
with safety standards for the proposed operations and trade signage will be placed
closest to I -70 on the north side of the lot.
Section 5.03.07 (1) Industrial Operations: Industrial Operations, including extraction,
processing, fabrication, industrial support facilities, mineral waste disposal, storage, sanitary
landfill, salvage yard, access routes and utility lines, shall be permitted, provided:
(1) The applicant for a permit for industrial operations shall prepare and submit to the Planning
Director ten (10) copies of an impact statement on the proposed use describing its
location, scope, design and construction schedule, including an explanation of its
operational characteristics. One (1) copy of the impact statement shall be filed with the
County Commissioners by the Planning Director. The impact statement shall address the
following:
(A) Existing lawful use of water through depletion or pollution of surface run-off, stream

the execution of the site rehabilitation plan in workmanlike manner and in accordance
with the specifications and construction schedule established or approved by the County
Commissioners. Such commitments, bonds or check shall be payable to and held by the
County Commissioners;
Response. We agree to provide such evidence or bonding as may be applicable or required
by the board.

Response. We have responded to all of these to the best of our ability.
Section 5.03.08 Industrial Operations. All industrial operations in the County shall
comply with applicable County, State and Federal regulations regulating water, air,
and noise pollution and shall not be conducted in such a manner constituting a public
nuisance or hazard. Operations shall be conducted in such a manner as to minimize
heat, dust, smoke, vibration, glare and odor and all other undesirable environmental
effects beyond the boundaries of the property in which such uses are located, in
accord with the following standards:
(1) Volume of sound generated shall comply with the standards set forth in the
Colorado Revised Statutes at the time any new application is made.
Response. Other than the sounds of the vehicle travel & unloading hereinabove noted
there will be noise generated from chain saw, saw mill, and sander operations. All
equipment to be used was measured on the "A" scale of a standard sound level meter,
when wind velocity was less than 5 mph by Paul Straw, a partner in Top Notch Log
Works. Test results were as follows:

All proposed operations within the site shall comply with maximum standards established
for residential zone districts under Colo. Rev. Stat. 25-12-103 (2001).

(2) Vibration generated: every use shall be so operated that the ground vibration
inherently and recurrently generated is not perceptible, without instruments, at
any point of any boundary line of the property on which the use is located.
Response. None of these sought herein or accessory thereto will generate on a
recurring basis, vibrations which would be perceptible in the absence of instruments.
(3) Emissions of smoke and particulate matter: every use shall be operated so as to
comply with all Federal, State and County air quality laws, regulations and
standards.
Response. The site will contain no point sources subject to regulation under the
Colorado Air Pollution Prevention and Control Act, Colo. Rev. Stat. 25-7-101 et. Seq.,
and as such no permits (APEN) or other approvals from Division of Administration
(CDOH&E)/ Air Quality Control Commission /Colorado Department of Health and
Environment shall be required as a condition precedent to the special use permit sought
herein.
(4) Emissions of heat, glare, radiation and fumes: every use shall be so operated that
it does not emit heat, glare, radiation or fumes which substantially interfere with
the existing use of a<{joining property or which constitutes a public nuisance or
hazard. Flaring of gases, aircraft warning signals, reflective painting of storage
tanks or other operations which may be required by law as safety or air pollution
control measures shall be exempted from this provision.
Response. Apart from the emissions from the vehicle travel hereinabove noted,
Applicants' proposed facilities /operations will not emit any heat, glare, radiation or
fumes.
(5) Storage area, salvage yard, sanitary landfill and mineral waste disposal areas:
(A) Storage of flammable or explosive solids or gases shall be in
accordance with accepted standards and laws and shall comply with
the national, state and local fire codes and written
recommendations/comments from the appropriate local protection
district regarding compliance with the appropriate codes.
Response. Less than 120 gallons of diesel and gasoline will be stored above ground
and used onsite. After checking with the Silt Fire Dept. we have found that any storage of
these materials must be done at least 25' from property lines, 5' from any storage area, or
5' from any streets or alleys. We shall comply with this and all storage of flammable or
explosive solids or gases shall be in accordance with accepted standards and laws and
shall comply with the national, state and local fire codes and written
recommendations/comments from the appropriate local protection district regarding
compliance with the appropriate codes.

(B) At the discretion of the County Commissioners, all outdoor storage
facilities may be required to be enclosed by fence, landscaping or wall
adequate to conceal such facilities from adjacent property.

(C) No materials or wastes shall be deposited upon property in such form
or manner that they may be transferred off the property by any
foreseeable natural causes or forces.
Response. All generated garbage will be stored within standard garbage receptacles
provided by the servicing carrier to be located next to the existing metal building.
(D) Storage of Heavy Equipment will only be allowed subject to (A) and
(C) above and the following standards:

subdivision.

private property and may not be conducted on any public right-of-
way.

2) The construction of this well shall be in compliance wHh the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well, appropriating ground water tributary to the Colorado River, as an
alternate point of diversion to the Avalanche Canal and Siphon, on the condition that the well shall be operated only when the West Divide
Water Conservancy District's substitute water supply plan, approved by the State Engineer, is in effed, and when a water allotment contract
between the well owner and the West Divide Water Conservancy District for the release of replacement water from Ruedi Reservoir is in effect,
or under an approved plan for augmentation. WDWCD contract #030612-BC(a) (amended 6121/03).
4) Approved for the change in use of an existing well constructed September 1, 1964 lo a depth of 80 feet, under permit no. 125776 (canceled)
and later permitted for expanded use under permit no. 59894-F (canceled). The issuance of this permit hereby cancels permit no. 59694-F.
5) Approved as a well on a tract of land of 11.70 acres described as that portion of the NW 1/4 of the NW 1/4, Sec. 17, Twp. 6 South, Rng. 92

6) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family dwelling, and drinking and
sanitary facilities for six (6) COf!1Merciallindustrial businesses. Furthennore ground water from this well may service a maximum of seven (7)
commerciaVindustlial businesses if the one (1) single family dwelling is removed or converted to an individual commercial/industrial business.
Water from this well shall not be used for any other purpose outside single family dwelling or the commercial/industrial businesses buiJding
structure(s). All use of this well will be curtailed unless the water allotment contract or a plan for augmentation is in effect. This well is known
as
Col_li~s Well.
7) The maximum pumping rate of this well shall not exceed 15 GPM.
8) The average annual amount of ground water to be appropriated shall not exceed 1.411 acre-foot (459,774 gallons).
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as
appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be
maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
11) This well shall be located not more than 200 feet from the location specified on this permit.

THE STATE ENGINEER FINDS:
The well pennit was issued on July 18, 2003, with an expiration date of July 18, 2004. A well
construction report and pump installation report were submitted on October 22, 1984, indicating that the
well \Vas constructed on September 1, 1984, to a depth of 80 feet, and that a pump was installed
September 21, 1984, under permit no. 125776 (Caneeled). Additionally the well was re-permitted under
permit no. 59894-F expanding the use of the existing well and canceling permit no. 125776.
On August 28, 2003, the current well owner (Betty J. Collins) submitted an application to further expand
the use of the existing well permit no. 59894-F (permit no. 125776 canceled). The new permit (pennit
no. 60317-F) allows for the expanded use of the well (Collins Well) in accordance with the amended
West Divide Water Conservancy District contract no. 030612-BC(a), amended August 21, 2003.
The well permit is hereby canceled and is of no further force or effect.

INTRODUCTION
The proposed development for the Collins Property is located along County Road 346,
approximately 0.8 miles east of Mamm Creek in Garfield County, Colorado. The
proposed development consists of an existing trailer, existing shop building, a timber
framing area, timber storage, an office building, a new shop building and parking areas
situated on approximately 12 acres. See the enclosed Vicinity Map for site location.
HYDROLOGY
The hydrologic methods for this study are outlined in the United State Department of
Agriculture (USDA) Natural Resources Conservation Service (NRCS) publication
"Urban Hydrology for Small Watersheds TR-55" and the computer program AutoCAD
Hydrology SCS TR-55 Tabular Method. Existing site soils consist of Type C soils with a
vegetative cover of sagebrush and grasses in poor condition. See the enclosed NRCS
Soils Map for hydrologic determinations.
DRAINAGE PLAN
The 100-yr stormwater runoff from the development will be, in general, unconcentrated
sheet flow and shallow channel flow. Existing general flow patterns will be maintained
as shown on the enclosed Drainage Plan. The proposed development will not
adversely affect these drainage patterns. Stormwater detention has been proposed
near the upper parking areas and along the northerly property boundary. The site
contains a low point within the northwest corner which will be maintained. Each
detention pond will be drained by a perforated standpipe and infiltration. Site oils will be
contained within these ponds.
SUMMARY
Stormwater runoff for the 100-yr storm event will be contained within the property
boundaries and will not adversely affect adjacent properties. Existing drainage patterns
will be maintained and directed into specifically located detention facilities to mitigate
flooding and oil dispersions as required by the conditions of the Special Use Permit.
