Attached is the application, the resolution and a drawing as you requested. This is for the proposed install of
a paint booth, which is a tool to this persons trade., It will be located in the same building that the truck,
equipment storage, parking, repair operation used to occupy. Silver Start Auto Repair, which is a body shop,
would be within the same footprint and less usage. He contemplates working on up to 10 vehicles per month,
primarily body work, with himself and one other employee. Tenant is eager to move in and I have approved
his credit application . Can I go ahead and move him in ? It has been very difficult to refill this unit, I had to
drop the rent by 700 just to start getting some interest. We struggle to make the mortgage payments as it is,
since our business that occupies the same property is not doing so well either. We just had to ask our lendor a
few months ago, the SBA, to modify the loan as we were 3 months behind on the mortgage payment, and
they did, thank goodness, but then we lost one of our tenants the end of December. It is not making it any
easier to have that building empty. Time is of the essence here. Thank you for your help in promoting business
in a very difficult time. I will be out of town, but if you have further questions for the tenant, please call him at

Thanks for sending over the description of the proposed use and resolution 2003-82. After reviewing the staff report,
resolution and application, as long as the car repair and painting take place indoors and in accordance with the
conditions of approval in 2003-82, then the use appears to fall within the purview of your approved Special Use Permit.
Any enlargement of the buildings or intensification of any of the uses beyond what was described to the BOCC back in
2003 would require additional permitting. If you have not already, please review the conditions of approval identified in
resolution 2003-82 to ensure that your new tenant can operate within those parameters. As you know you, as the
property owner, are ultimately responsible for ensuring compliance with this permit. Of course, the painting facility and
any other structural modifications will need to obtain a separate building permit and conform to all other state and
federal requirements.
If you have not already, I would suggest contacting David Bartholomew or Andy Schwaller here in Community
Development about submitting the necessary building permit.

In April of this year, a Special Use Permit was granted to Ralph Fritzlan and Kathy Hangs, than
property owners, for a structural steel fabrication shop and storage for Bruce and Betty Collins,
business owners. The actual Special Use Permit for this use was signed by the Board on
September 2, 2003, (see attached). The only individuals listed on the permit were Bruce and
Betty Collins, at that time the representatives I business owners. The Clerk and Recorders Office
requested that the property owner I application be listed on the permit as well for proper recording
of the documents associated with the subject property. The attached Special Use Permit includes
the than property owners, as well as the business owners that applied for the permit.

RE: Special Use Permit for a log timber framing business
Dear Betty and Bruce:
Thank you for the valid development application submitted to this office on July 22, 2003. The
purpose of this letter is to notify you that the application has been deemed teclmically non-
compliant for the following reasons:
I. Staff understands that this Special Use Permit request is for a log timber framing business.
Clarification is needed regarding this proposed use. There appears to be some overlap in the
application regarding the use of existing structures for the two uses (the steel fabrication
operation and the log timber framing business) on-site, however, it is not clearly outlined in the
application.
a. Will there be any structures associated with the log timber framing business, i.e. an
office? Or will the existing trailer that will be utilized for an office for the steel
fabrication business be used for the office for the log timber framing business?
According to the application, this appears to be the case, however, it is not clearly
explained.
b. The 500 gallon propane tank has been identified as a source of heat for the office of
the steel fabrication operation, please explain how this tank will be utilized for the
proposed log timber framing business.
c. Under "Operating Hours" please explain what is meant by "occasional weekends".
d. How many total employees will be associated with the log timber framing business?
e. It appears that raw material will be delivered to the site 2 times of month. How, often
are the homes, once assembled, transported off site and how?
f. There is reference to a 'warehouse' on site. Staff understood that the existing
shop/warehouse will be utilized for the steel fabrication shop. Will this warehouse
now be utilized by the log timber framing business?
g. Will the leveled graveled parking area adjacent to County Road 346 affect the Loesch
Crann Ditch?
h. Noise tests have been provided with the application. Please explain who conducted
these sound tests and their qualifications.

2. In accordance to Item 2 under Section I of the application, a copy of a well permit, No.
59894, was submitted with the application. It appears that the well permit issued by the State is
for "a commercial business (structural steel fabrication shop) ... ". It is indicated in the application
that the proposed log timber framing business will utilize the existing well as well, however, this
uses is not identified on the well permit. An updated well permit shall be obtained by the Division
of Water Resources to allow for the new use.
It has been identified in the application that the proposed use will utilize the existing septic
system. It is unclear as to whether the existing septic system can support two commercial uses.
Please provide additional information on the existing septic system, i.e. size, capacity, etc.
Once the items listed above have been submitted, the application may proceed through the review

Please attach this as an addendum to clarify your questions:
Responses:
a. There will not be any structures associated with the log timber framing business. They
will only be utilizing the existing trailer for bathroom purposes. The steel fabrication
business will not be utilizing existing structures at this time, intentions are to build new
facilities for that purpose when able.
b. The propane tank will not be utilized at all for the log timber framing business.
c. Occassional weekends means a Sat. or Sun. from 7-5:30 once a month.
d. Six employees will be associated with the log timber Framing business.
e. The finished logs usually move out about once a month on a semi trailer.
f. Existing warehouse will not be used by the log timber framing business or structural
steel fab shop at this time, but the possibility of one or the other or both using it at some
time in the future exists.
g. The leveled graveled parking will not affect the Loesch Crann Ditch.
h. Noise test were conducted by Paul Straw a partner in Top Notch Log Works, he bought
a sound meter from Radio Shack, and read the instructions.
2. We will add the additional use to the commercial well permit. I will be submitting
applications to West Divide and CDWR immediately, in the mean time we would like to
request that the business be able to store some logs for a large upcoming project at the
end of September contingent upon approval of this special use and proof of our submitted
applications to West Divide Water Conservancy and Colorado Dept. of Water Resources
in case it takes them longer than that to get their paperwork done. It would be very costly
to have to handle and move these logs again. Janet at West Divide has informed that we
have enough water for this additional use but we still need to add the additional use,
which we cost 110 with them and another $460 with the CDWR.
Thank you Tamara for assisting me in looking up the original septic permit and checking
with the Building and Sanitation dept. as you know we found that the existing septic is
capable of supporting two commercial uses, their use is less than what a domestic
residence would use.

before the Board of County Commissioners at a public hearing on Monday, October 6, 2003, at
1: 15 p.m. in the Garfield County Plaza Building, Commissioners Hearing Room, Suite 100, 108
8th Street, Glenwood Springs, Colorado. Should this date be inconvenient for you, please contact
me for a different meeting date.
The Friday prior to the meeting date, a staff report and agenda, which will indicate the
approximate order of items to be heard at the meeting, will be available for you to pick-up in the
Building and Planning Department, or a copy can be mailed to you upon request.
The applicant is solely responsible for the publication, posting, and mailing of all notices and shall
present proof of publication and mailing at the hearing. Pursuant to Section9.03.04(1-3) of the

RE: Fritzlan I Hangs (Collins) Special Use Permit
Dear Betty and Bruce,
Guidelines for the administration of the base fee structure for each type of subdivision or
land use review process are established in Resolution No. 98-09. According to this
Resolution, the Board of County Commissioners recognizes that the subdivision and land
use application processing time vary and that an Applicant should pay for the total cost of
the review which may require additional billing.
Attached is an invoice for the review of the above-mentioned application. I have also
attached a copy of the Planning Department's Time Tracking Sheet used.
Please make checks payable to the Garfield County Treasurer and mail the check to our
department.

We have a few questions about this agri/ Industrial zoned property and the special use
pennit submitted for our welding shop.
I. As the special use pennit states, was it your intent to that we have to berm the
North side (faces J. 70) ? Originally, my husband thought that you had intended us
to bcnn the south side and the east and west. Was there a mistake somewhere?
2. Why do you require a commercial well permit, when this is industrial land ?? Just
wondering why it wouldn't be a industrial well permit, as there were several
occasions on my well pennit applications that I had to choose commercial or
industrial and I wasn't quite sure what to put down except that you told me we
needed a commercial well pennit. It doesn't seem to matter to the water
departments, usage equates to the same, but I can't help but wonder if at some
point you are going to require me to change this to an industrial well pe1mit.
3. Ifwe were able to re-zone this to all industrial what would the minimum lot splits
be???
4. Under the All regulations I read that the mimimum lot split is 2 acres, except as
otherwise approved in a Cluster Option.(2003-17) . Can you tell me what that
entails and if we might be able to do this on our property ? After talking to a
planner he sketched out a design of sub dividing into an optimum of7 lots, the
smallest being .8 ac. , then 3-1.5 acre and 3-1 ac. lots. Is there a way that we
could do this??? How?
5. Under this special uses can we lease to anyone mlllling a structural steel fab shop
or is specifically for us?? How about the Log Timber Framer or any additional
uses we may request and get approved ???

This letter is in response to your fax dated August 21, 2003. Your questions verbatim are in
italics and my responses follow.
1. As the special use permit states, was it your intent to that we have to berm the North side

Response: With respect to screening, the Board approved the Special Use Permit with the
following condition, "The area of the storage of raw materials will be screened with appropriate
berm (minimum 4' in height) and trees, and/or fencing on the north and trees or other vegetative
growth on the east and west. " It does not appear that the Board required any screening along the
south side of the property along CR 346.
2. Why do you require a commercial well permit, when this is industrial land?? Just
wondering why it wouldn't be an industrial well permit, as there were several occasions on my

Response: It is my understanding that commercial I industrial uses should not operate under a
residential well permit, therefore a change in well status is required. You may apply for a either
commercial or industrial well permit depending on your needs. Unfortunately, the County has
utilized commercial well permit a generic term. Either type of permit would be appropriate.
3. Jfwe were able to re-zone this to all industrial what would the minimum lot splits be???
Response: The only "all industrial" zone district in the county is L/I (Light I Industrial).
However, this zone district is only located in one area of the County, near Carbondale. Rezoning
your property from
A/I to another zone district would not be supported by Staff or the County.
Your property is encompassed by the A/I Zone District and rezoning the property to any other
zoning would be considered "spot" zoning, which is illegal.

Respons~. ·waste oil will be stored in a 55 gallon disposal barrel to be emptied 011 a
periodic basis by appropriate local wai.ic disposal company. Fresh Oil "Rotella" shall be
stored in a 55 gallon dispenser drum. After che¢king with the Silt Fire Dept. they
recommended that any storage of these rnateriahi most be done at least 25' from property
lines, 5' from any storage area, or 5' from any streets or alleys. We shall comply with this
and all storage of flammable or explosive solids or gases shall be in accordance with
accepted standards and laws and shall comply with the national, state and local fire codes

b. Ai thi discretion of the County Commissioners, all outdoor storage
facilities may be required to be enclosed by fence, landscaping or wall
