I. GENERAL PROJECT DESCRIPTION
Applicants own a 5. 72-acre property in joint tenancy. Site currently contains three dwelling units -
all of which are legal, as some are considered pre-existing non-conforming units.
The proposal is to split the property into two lots -one lot at the north that would contain one unit,
and one lot to the south which would contain two units. The applicant would be required to
demonstrate that an adequate and legal water supply exists and that the three existing septic
systems provide adequate wastewater treatment to the units. Access to the site is from Four Mile
Road and there is an existing driveway that provides two access points to the County Road.
The Minor Subdivision process is administrative with the Director of Community Development
acting as the decision-maker on the request. Notice is required to be completed by the applicant -
a 30-day adjacent property notice by certified mail, return receipt. Notice is provided post-decision
to the Board of County Commissioners who has the ability to 'call-up' the application for a public
hearing.

It is our desire to divide this 4.7 acre property into two parcels equaling 2.35 acres each. our
survey of 2005 found a discrepancy from the county books that indicated originally 5. 7 acres.
This "wedge• shaped piece of property was the result of the realigning of County Road 117 in
1952 (see the attatched map.) All of the land surrounding was the "George Summers Ranch.•
The realignment of the road created a little over 4 acres to become available for sale of which
Ray and Margaret Morgan purchased.
On this 4 or so acres , was a small trailer used by Bus Abshire and the "log cabin• the Morgans
lived in. The water well we recently replaced was also commissioned in the early 1950's. In
April of 1991, Ray Morgan obtained permits to replace the "old trailer" with a 1991 Magnolia
UBC modular that sits on a foundation and is considered an improvemenL The title was purged
into the realestate. In 1972 Catherine Lucas obtained permits to put a 1968 Marlette mobile
home on the same 4 acres. This home is not an improvement, but is considered a non-
conforming structure that can be replaced.

the deed to the property is held by the Bank of Colorado.
All three dwellings have existing adequate septic systems. Currently there are two working
water wells of which each newly created parcel will have one each according to the boundry
line drawn.
Water quality analysis was completed May 13, 2012 by Accutest Laboratories out of
Wheatridge, Colorado. Testing results for uranium and alpha/beta radio activity pending.
We met with our neighbor, Robert McGregor on May 18, 2013, to discuss the conveyance of
the set back infringement concerning the 1991 Magnolia. Mr. McGregor indicated a willingness
to work with us as a condition for approval.

2. The Applicant understands and agrees that Ga1field Countv Resolution l~o. 98-09, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of thE costs
involved in processing the applkation. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, Wilen they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of anv cosi. for publication or cost of
consulting service determined necessary by the Board of County Commissioners for thE

the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pav

in favor of the Proposed Insured named In Schedule A, as owner or mortgagee of the estate or
interest in the land described or referred to in Schedule A, upon payment of the premiums and
charges and compliance with the Requirements; all subject to the provisions of Schedules A and
B and to the Conditions of this Commitment.
This Commitment shall be effective only when the identity of the Proposed Insured and the
amount of the policy or policies committed for have been inserted in Schedule A by the Company.
All liability and obligation under this Commitment shall cease and terminate 180 days after the
Effective Date or when the policy or policies committed for shall Issue, whichever first occurs,
provided that the failure to Issue the policy or policies Is not the fault of the Company.
The Company will provide a sample of the policy form upon request.
This Commitment shall not be valid or binding until countersigned by a validating. officer or

CONDITIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other
security Instrument.
2. If the proposed Insured has or acquired actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interest or mortgage
thereon covered by this Commitment other than those shown In Schedule 6 hereof, and
shall fall to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to
the extent the Company Is prejudiced by failure to so disclose such knowledge. If the
proposed Insured shall disclose such knowledge to the Company, or If the Company
otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse
claim or other matter, the Company at its option may amend Schedule 6 of this
Commitment accordingly. but such amendment shall not relieve .the Company from
liability previously Incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to .the named proposed
Insured and such parties included under the definition of lns.ured in the form of policy or
policies committed for and only for actual loss incurred in reliance hereon In undertaking
in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions
shown in Schedule 6, or (c) to· acquire or create the estate or interest or mortgage
thereon covered by this Commitment. In no event shall such liability exceed the amount
stated in Schedule A for the policy or policies committed for and such liability Is subject to
the Insuring provisions and Conditions and Stipulations and the Exclusions from
Coverage of the form of policy or policies committed for In favor of the proposed Insured
which are hereby incorporated by reference and are made a part of this Commitment
except as expressly modified herein.
4. This Commitment is a contract to Issue one or more title insurance policies and Is not an
abstract of title or a report of the condition of title. Any actions or actions or rights of
action that the proposed Insured may have or may bring against the Company arising out
of the status of the title to the estate or Interest or the status of the mortgage thereon
covered by this Commilment must be based on and are subject to the provisions of this
Commitment.
5. The policy to be issued contains an arbitration clause. All arbitrable matlers when the
Amount of Insurance is $2,000,000 or less shall be arbitrated at the option of either the

The uu of ground water from this well is limited to fire protection, ordinary househokt purposes inside not more than two (2) single famity
dwelling(s), the watering of poultry, domestlc animals and livestock on a fann or ranch and the irrigation of not more than one (1) acre of home
gardens and lawns.
The pumping rate of this wall shall not exceed 25 GPM.

The subject application for a permit to construct a well is being returned for
additional information concerning the parcel of land on which the proposed well will
be located. In order to properly evaluate the application, this office must have
evidence Indicating when the subdivision or this particular parcel of land was
created. Please provide one of the following:
1) If the subdivision or particular parcel was in existence prior to June 1, 1972,
please provide a copy of a deed, subdivision plat, or other document to verify
that fact.
2) If the subdivision or particular parcel was exempted from the county
subdivision regulations, please provide all of the following:
a~! A copy of the county conmissioners resolution.
A copy of a survey plat showing the original tract and all exempted tracts.
Information concerning the existence of any wells and their uses on the
original tract and on the exempted tracts.
d) Copies of documents showing when the original tract was created (this is
required only if the original tract was less than 35 acres In size, or
if it was involved in a previous exemption).
e) Copies of any other agreements concerning this tract executed with the
county.

4) Approved as a well on a tract of land of 5.72 acres described as that portion of the SW 1/4 of the WI 1/4, Sec. 27, Twp. 6 South, Rng. 89
West, 6th P.M., Garlleld County, mora particularly described on the attached exhibit A. Further identified as 1501 County Road 117, Glenwood
Springs, CO 81601.
5) The date of first beneficial use, as claimed by the applicant, Is June 23, 1956.
6) This well shall be located not more than 200 feet from the location specified on this permit and not more than 200 feet from the location
decreed for Morgan Well in case no. W-1094 (decreed location is 1999 feet from the North section line and 1098 feel from the West section
line).
NOTE: This weH was decreed as Morgan Well In OMslon 5 Water Court case no. W-1094. This well was decreed for0.055 els (25 gallons per
minute). The total depth of this wel ls decreed as 131.5 feet. At the date of the entry of this decree with the court on Januaty 8, 1973, the well
owner was: R.A. and Margaret 0. Morgan.
Note: Case no. W-1094, Identified State Engineer's permit number 22636 for the Morgan Well, which was In error. The number 22636 was
the map and file number for case no. W-1094, Morgan Well. Additionally it was determined the a State Engineer's permit had not been
Issued at the time of decree for the Morgan Well.
NOTE: Penn it no. 152042 was previously Issued for a portion of this parcel.
