Mr. Leavenworth has requested that the Board allow the inclusion to occur and not consider it to be a major modification of the Districfs service plan. Normally, the Board has to approve a service plan for the formation of a special district pursuant to CRS § 32-1-204.5. CRS § 32-1-207 (2) allows the Board to approve modifications to a service plan provided that they consider the modification not be a material modification. The proposed annexation of the Cerise Ranch into the District will result in the provision of central sewer service to the development, replacing the approved Individual Sewage Treatment Systems (ISTS). If the Board makes a determination of no material modification, the Cerise Ranch Developers will have to amend the Cerise Ranch Preliminary Plan approval to reflect the new method of treating sewage There will be some houses in the development that will have ISTS since they were built prior to this proposal. These system owners will be allowed to hook into the District system at a future date, should they desire to do so. RECOMMENDATION: The Board make a motion approving the inclusion of Cerise Ranch Subdivision into the Mid Valley Metropolitan District as a non-material modification to the District Service Plan with the following findings: 1. The proposed modification does not result in a material change to the basic services provided to residents of the District. 2. The development will be required to receive approval of the amendment of the Subdivision Preliminary Plan and Final Plat approval. 3. The proposed modification is in the best interest of the residents of Garfield County and the water quality of the affected area.
