COMMENTS: Don: Afi.:r uur conversation this morning, I am faxing you the first page from a letter outlining the conditions that were placed upon the grants of Conditional and Special Use Permits sought by our client, Altenbem & Sons, in connection with proposed timber hauling through Garfield County. The condition to which our client talces exception is found at paragraph 1.e., which purport.q to require the upgrade of a bridge crossing and haul roads located solely on their ranch property. The bridge crossing and haul roads ar~ suk!y private and not incorporated into the County road system. Accordingly, we question the County's authority to place conditions upon roads that are not open to the public. For your information, the County has given our clients until April 2, 2002 to satisfy the cundiliuns outlined in !h1:: !1::tt.:r. I look forward lo ht:aring from you. The conditions placed on the approval are as follows: l. That all representations made by the applicant in the application, timber harvest plan, or at the public hearing shall be conditions of approval, unless specified otherwise by the Board of County Commissioners. Said representations include, but are not limited to: a) Dust will be controlled with water or dust control chemicals so that it does not become a nuisanc~ If these are not sufficient means of dust control, the number of truck trips per day, and the speed of the trucks, shall be reduced as necessary. b) The appearance of a mature, high forest will be maintained c) Slopes of 50+% slopes shall be harvested with helicopters. d) 5,000 to I 0,000 tons will be harvested using selective cutting. e) The existing Carr Creek bridge crossing will be upgraded to handle haul loads and haul roads on private lands will be improved or constructed to minimum haul standards. f) Intermittent drainages shall be crossed at right angles, with 18" steel or ADS culverts placed on a 2-4% grade, covered with at least I' of dirt, and provided with a rock apron for spillage. g) Landing slash will be burned during favorable conditions, with the proper permits. Burn areas and skid trails will be disked and re-seeded. Culverts will be placed to prevent erosion along abandoned roads. Cut/fill slopes will be stabilized. Noxious weeds will be monitored and treated. h) Subsequent saies wiil obtain the appropriate new or expanded permits. i) All operations will cease during spring run-off(typically March-May) and during big game hunting season (October to early November). j) Chainsaws shall be equipped with spark arrestors and all motorized equipment shall carry at least one shovel and one fire extinguisher; Phone: 945-8212 /Fax: 384-3470 109 8th Street, Suite 303 Glenwood Springs, CO 81<101
