D.~P.JJ.t.Y. ............... , Cle<k of the Bo<rrd when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 82-86 A RESOLUTION CONCERNED WITH AMENDING RESOLUTION NO, 82-73. WHEREAS, the Board of County Commissioners, upon application of A & K Leasing and Robert, Edward, and Wanda Templetion, adopted its Resolution No. 82-73, granting a special use permit in Section 11, Township 6 South, Range 93 West of the 6th Principal r-1eridian, and WHEREAS, the Board has been advised that its Resolution No. 82-73 is, in certain respects, in error, NOii, THEREFORE, BE IT RESOLVED that this Board's Resolution No. 82-73 be and hereby is amended to read in its entirety as follows: A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY ROBERT, EDWARD, AND WANDA TEMPLETON AND A & K LEASING. WHEREAS, The Board of County Commissioners of Garfield County has received an application from Robert, Edward, and Wanda Templeton and A & K Leasing for a special use permit for a commercial park with three uses; specifically, 2 units of employee housing, storage and maintenance facility for a refuse trucking operation and a business offjce for same on the following described tract of land: A portion of land situated in the SW~ NE~ Section 11, Township 6 South, Range 93 West of the 6th Principal Meridian in Garfield County, Colorado containing 8.18 acres, more or less. WHEREAS, pursuant to required public notice, the Board conducted a public hearing on the 22nd day of March, 1982, upon the question of whether the above described special use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said special use permit; and WHEREAS, the Board on the basis of the evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That the proposed use is compatible with the uses existing and permitted in the district in which it is to be located, provided that certain hereinafter contained conditions be complied with. 2. That neither the impact on traffic volume and safety or on utilities, or any other impcat of the special use will be injurious to the establish~d neighborhood or zone district in which the special use is to be located. NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado, that a special use permit be and hereby is authorized permitting the use of the above described tract of land for a commercial park with three uses; specifically, 2 units of employee housing, storage and maintenance facility for a refuse trucking operation and a business office for same, upon the following specific conditions: ' 1. That the ~se of the tract of land comply with all present and future reg- ulations of Garfield relating to a commercial park in the zone district in which the property is now or may later be located; 2. That, prior to the issuance of the authorized special use permit, the above described tract of land shall be severed from any other tract of land upon which there may exist a principal use, unless such other such principal use has been terminated at the time of the issuance of the special use permit; 3. All proposals of the applicant shall be considered conditions of approval unless stated otherwise; 4. The special use may be subject to review by the County Commissioners once ~very six months; 5. The applicant shall submit reconunendations from the Rifle Fire Protection District to the Planning Department prior to the Public Hearing and shall abide by these reconnnendations as a condition of approval of the special use permit; 6. The existing driveway will be abandoned and access to the dwelling units will be provided off the common access drive; 7. The applicant shall provide appropriate dust abatement measures for the gravelled access; 3. All outside storage areas with a six foot chain-link fence. required; for truck parking s~all be fenced and screened If vehicles are parked inside, no fencing is 9. The new 24 foot access drive shall also provide for utility easements; 10. Easements shall be designated for the existing irrigation ditches; 11. Screening and landscaping shall be developed along the eastern boundary of the property (paralleling the dr1veway), and immediately to the south of the e:;ervicc center. This screening and landscaping plan shall be subject to review by the Planning Department; 12.
