Attached herewith are signed letters from Frank 0 . and Dorotheye E.
McGown, Betty M. Hollenbaugh, and W. F. Clough which pennit the
Department of Highways to make application for special use permits
on their respective properties.
These letters were requested by Mr . Hartert, County Attorney , at
the County Commissioners' meeting held February 19.

'l'his letter is in reply to your letter to Marv Smith dated
Oct. 27, 1975 regarding your companiea plan to extract gravel
for the I-70 project on the s. w. Anderson and Gordon Loy properties.
I am familar with -chis area and because of 'the heavy development
of housing, other gravel pits and Interstate 70, the area has
already been deminished as wildlife habitat. In fact, the Division
of Wildlife has approved the construction of a deer proof fence
on the south side of I-70 to prevent deer from using this area
and reduce the number of vehicle-deer accidents in this area.
I feel that the site that your company has selected for the gravel
pit would be better than destroying more virgin riverbottom.
Your recommendation to stockpile topsoil for reclamation
and reseed with appropriate grasses would certainly be beneficial to
wildlife, 'l'he only change that l would like to suggest is that
you slope the banks to 31 l instead of 211. I feel that 'this will
be more beneficial to dabbling ducks and geese and it will also
make the area more attractive for recreational purposes. Also,
I would like to recommend that you leave as many cottonwood trees
as possible.

I have reviewed the applications of S. W. Anderson for a special use to
extract natural resources, (sand and gravel), from a parcel of property owned
by the applicant South of Rifle.
Anderson Pit designated as No. 1 will be used for construction of I-70 in
that area. The pit will then be used for Rifle Village So uth sewage lagoon.
Pit No. 1 is zoned Agricultural I Residential I Rural Density, and will require
a Spec ial Use Permit.
Pit designated as No. 4 will be used for aggregate for concrete in construc-
tion of Rifle Village South. This pit will require access either under I-70
when completed or an access road to the North of I-70. Mr. Anderson said that
the Highway Department has agreed to an underpass of 10' x 10' or an access to
County Road 320, which would require use of a county road and maybe should be
reviewed. Pit No. 4 is zoned Agricultural I Industrial and requires a Condi-
tional Use Permit. 1IT-. Anderson already had it advertised when he presented
the application, but due to the access routes, it probably should be handled as
a Special Use.

After we received your request for the County Commissioners
to sign a letter to the Mined Land Reclamation Board, we
asked our county building official, Bud Milner, to look into
the matter and see that there were no problems.
1'here is a problem, however. The perrni t the county issued
to \~oody Anderson for that g-ravel pit expi~ed in November
of 1976. Mr. Anderson had requested an extension of the
permit in January, 1976, and that extension was granted. It
was understood that there would not be access to the pit after
I-70 was completed.
If you wish to, you may re-apply for a special use permit to
operate this pit, assuming you have the necessary access.
Please contact Mr. Milner at 945-8241 if you have an questions.
