GENERAL SUBMITTAL REQUIREMENTS [The following general application materials are required for all Major Impact Review Applications in Garfield County. Application materials and review standards that are specific to an individual use (Mass Transit Facility, Extraction, Solid Waste Facility , etc,) are detailed in Sections 3-301 of Article III and Article VII of the Unified Land Use Resolution (ULUR) of 2008.] A. Submit a completed and signed Application Form, an application fee, and a signed Agreement for Payment form. B. A narrative explaining the purpose of the application and supporting materials that address the standards and criteria found in Articles III and VII of the Unified Land Use Resolution of 2008. C. Copy of the deed showing ownership. Additionally, submit a letter from the property owner(s) if the owner is being represented by another party other than the owner. If the property is owned by a corporate entity (such as an LLC, LLLP, etc.) Please submit a copy of recorded "Statement of Authority" demonstrating that the person signing the application has the authority to act in that capacity for the entity. D. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing the subject property and all public and private landowners adjacent to your property (which should be delineated). In addition, submit a list of all property owners, private and public, and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the County Assessor's Office. You will also need the names (if applicable) of all mineral interest owners of the subject property, identified in the County Clerk and Recorder's records in accordance with §24-65.5-101, et seq. (That information may be found in your title policy under Exceptions to Title). E. Vicinity map: An 8'/ x 11 vicinity map locating the parcel in the County. The vicinity map shall clearly show the boundaries of the subject property and all property within a 3 -mile radius of the subject property. The map shall be at a minimum scale of 1"=2000' showing the general topographic and geographic relation of the proposed land use change to the surrounding area for which a copy of U.S.G.S. quadrangle map may be used. F. A copy of the Pre -Application Conference form completed during the original Pre -Application Conference. G. Submit 3 copies of this completed application and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the application has been deemed technically complete. I. Major Impact Review Process The following section outlines and describes the Major Impact Review process for the variety of uses that are governed by the Board of County Commissioners by the Unified Land Use Resolution of 2008 (ULUR). Please refer to Articles III and VII in the regulations themselves for a higher level of detail. [The following process is required for applications for land use changes that are subject to Major Impact Review as defined in Table 3-501 or 3-502 in Article 111.] A. Outline of Process. The Major Impact Review process shall consist of the following procedures: 1. Pre -Application Conference (4-103 (A)) 2. Application (4-103 (B)) 3. Determination of Completeness (4-103 (C)) 4. Evaluation by the Director/Staff Review (4-103 (E)) 5. Public Hearing and Recommendation by the Planning Commission (4- 103 (G)) 6. Public Hearing and Decision by the Board of County Commissioners (4-103 (G)) B. Submittal Materials: The following materials shall be submitted with a Limited Impact Review application and are more fully defined in Section 4-502 of Article IV of the ULUR. The Director may waive or alter any of these requirements if they are determined to be inappropriate or unnecessary to determining if the application satisfies applicable standards. 1. Major Impact Review Amendment Process Any proposal to change conditions of approval or a site plan approved under these Regulations as a Major Impact Review permit shall require application to the Director for Amendment of a Major Impact Permit Approval. The Director shall review the application to determine whether the proposed change constitutes a substantial change to the Major Impact Permit approval pursuant to Section 4-107 of Article IV. A. Outline of Process. The review process for a proposed Amendment of an Approved Major Impact Review shall consist of the following procedures. 1. Pre -Application Conference (4-103 (A)) 2. Application (4-103 (B)) 3. Determination of Completeness (4-103 (C)) 4. Evaluation by the Director/Staff Review (4-103 (E)) 5. Decision by Director (4-104(6)(5)) 6. Public Hearing and Decision by the Board of County Commissioners (4-103 (G)) B. Submittal Materials: The following materials shall be submitted with a Major Impact Review Amendment application and are more fully defined in Section 4-502 of Article IV of the ULUR. The Director may waive or alter any of these requirements if they are determined to be inappropriate or unnecessary to determining if the application satisfies applicable standards. 1. Application Form 2. Supporting documents necessary to evaluate the proposed revision(s) 3. Written Statement of proposed amendment(s) which includes how the requested amendment does not result in a substantial change defined here: Substantial Change. A change to and existing approved land use resulting in one or more of the following: 1. A change in land use category. 2. A change in site design which increases a. The number of dwelling units. b. The maximum square footage of structures less than 10,000 sq. ft. over 100% and structures over 10,000 sq. ft. by 10%, if a maximum has been specified in a permit or approval. c. Projected traffic such that a highway access permit or an amendment to a highway access permit is required as a result of the change. d. The size of the land which is the subject of the permit or approval 3. A change in land use which creates or increases the incompatibility of the use. I have read the statements above and have provided the required attached information which is correct and accurate to the best of my knowledge. a May 26, 2009 (Signature of Property Owner) Date GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT FEE SCHEDULE Garfield County, pursuant to Board of County Commissioners ("Board") Resolution No. 98-09, has established a fee structure ("Base Fee") for the processing of each type of subdivision and land use applications. The Base Fee is an estimate of the average number of hours of staff time devoted to an application, multiplied by an hourly rate for the personnel involved. The Board recognized that the subdivision and land use application processing time will vary and that an applicant should pay for the total cost of the review which may require additional billing. Hourly rates based on the hourly salary, and fringe benefits costs of the respective positions combined with an hourly overhead cost for the office will be used to establish the actual cost of County staff time devoted to the review of a particular project. Actual staff time spent will be charged against the Base Fee. After the Base Fee has been expended, the applicant will be billed based on actual staff hours accrued. Any billing shall be paid in full prior to final consideration of any land use permit, zoning amendment or subdivision plan. If an applicant has previously failed to pay application fees as required, no new or additional applications will be accepted for processing until the outstanding fees are paid. Checks, including the appropriate Base Fee set forth below, must be submitted with each land use application, and made payable to the Garfield County Treasurer. Applications will not be accepted without the required application fee. Base Fees are non-refundable in full, unless a written request for withdraw from the applicant is submitted prior the initial review of the application materials. Applications must include a Payment Agreement Form ("Agreement") set forth below. The Agreement establishes the applicant as being responsible for payment of all costs associated with processing the application. The Agreement must be signed by the party responsible for payment and submitted with the application in order for it to be accepted. The following Base Fees shall be received by the County at the time of submittal of any procedural application to which such fees relate. Such Base Fees shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board for the consideration of any application or additional County staff time or expense not covered by the Base Fee, which have not otherwise been paid by the applicant to the County prior to final action upon the application tendered to the County. All applications shall be submitted with a signed Agreement for Payment form set forth below. 2. County staff shall keep accurate record of actual time required for the processing of each land use application, zoning amendment, or subdivision application. Any additional billing will occur commensurate with the additional costs incurred by the County as a result of having to take more time that that covered by the base fee. 3. Any billings shall be paid prior to final consideration of any land use permit, zoning amendment, or subdivision plan. All additional costs shall be paid to the execution of the written resolution confirming action on the application. 4. Final Plats, Amended or Corrected Plats, Exemption Plats or Permits will not be recorded or issued until all fees have been paid. 5. In the event that the Board determines that special expertise is needed to assist them in the review of a land use permit, zoning amendment, or subdivision application, such costs will be borne by the applicant and paid prior to the final consideration of the application. All additional costs shall be paid prior to the execution of the written resolution confirming action on the application. 6. This SUP was approved by Garfield County on March 17, 2008 (Resolution 2008-43). This request is being submitted pursuant to Article IV, Section 4-107 of the Garfield County Unified Land Use Resolution. As documented below, BBC believes that the requested amendment does not constitute a substantial change to the approved SUP. The following material is submitted in support of this request — 1. Written statement of proposed amendment — provided in the narrative below. This statement also provides a discussion of the criteria for determining whether this amendment would be considered to be a substantial change to the approved SUP. 2. Supporting documents necessary to evaluate the proposed revision — the following supporting documents are enclosed with this supplement: a. Revised site plan showing the proposed amendment b. Agreement with the surface owner demonstrating acceptance of the proposed amendment Statement of Proposed Amendment The subject SUP approved the construction and operation of a facility on the GGU Rodreick 21B-31-691 well pad for the storage and handling of produced water from nearby natural gas wells. The facility approved by this SUP and currently in operation consists of nine (9) 500 barrel (bbl) tanks and one (1) 400 bbl tank used for the storage and handling of produced water. These tanks are located adjacent to the west perimeter of the location and are surrounded by lined secondary containment. The proposed amendment is to install an additional ten (10) 500 bbl tanks near the northwest perimeter of the location (see enclosed site plan). The additional tanks will also be surrounded by lined secondary containment and will serve the identical function as the tanks approved in the SUP. No additional surface disturbance will be required for the installation of the additional tanks. All other equipment on the location will remain unchanged. The Garfield County Unified Land Use Resolution describes three criteria to be evaluated when determining if a proposed amendment constitutes a substantial change. Each of these criteria and their relationship to the proposed amendment are described below — 1. A change in land use category. No change in land use category is proposed. 2. A change in site design which increases a. the number of dwelling units. Not applicable to this amendment. b. the maximum square footage of structures less than 10,000 sq. ft. over 100% and structures over 10,000 sq. ft. by 10%, if a maximum has been specified in a permit or approval. Not applicable to this amendment. The proposed change does not create or increase the incompatibility of the use approved by Garfield County under the original SUP. The additional tanks proposed under this amendment serve the identical purpose and will operate identically to the tanks approved under the SUP. The size of the existing well pad where this facility is located will not be increased to accommodate the additional tanks, and no other new equipment will be installed and no existing equipment will be modified as part of this amendment. This facility serves an important purpose in its ability to collect water for disposal in an adjacent underground injection well. This water would otherwise be placed into trucks for transportation to distant disposal facilities, therefore, the operation of this facility significantly reduces truck traffic on Garfield County and other public roads. The installation of the additional tanks on this facility will enable BBC to collect a larger volume of water transported through pipelines for disposal at this location further reducing truck traffic on public roads. In summary, BBC believes that the proposed amendment is not a substantial change to the approved SUP and is requesting Garfield County's approval of the proposed amendment as expeditiously as possible. Each of the comments included in your email are addressed below. Absence of Lined Pond As noted during your site visit, BBC did not construct a lined pond (pit) for the storage of water at this location. All water storage is being and will continue to use closed -top tanks. The site plan included with the application to amend the approval for this facility is accurate in that it does not include a lined pond, and the approval for this amendment should reflect that BBC has not and will not construct a lined pond at this location. Truck Traffic Due to BBC's existing pipeline infrastructure used to transport water to and from their operations, the addition of the 10 tanks requested in the amendment application will not increase truck traffic above current levels nor will it alter the truck traffic patterns or hours of use. BBC personnel involved with the operation of this facility indicate that the current average daily truck traffic to this facility is approximately 10 trucks per day. The majority of these trucks travel to this facility during daylight hours, however approximately 2 trucks per day may be required to travel to the location at night. Air Emissions BBC staff responsible for obtaining air emissions permits from the Colorado Department of Public Health and Environment (CDPHE) Air Pollution Control Division (APCD) have evaluated emissions from the existing tanks at this facility and these emissions have not met the thresholds established by APCD for requiring emission notices, controls (e.g., combustor), and/or permitting. As was discussed during the site visit, BBC voluntarily installed a vapor collection and control system (combustor) to destroy vapors vented from the tanks even though there were no odor complaints specific to this facility and tank emissions had not exceeded the APCD thresholds that required reporting, permitting or installation of controls. In addition the combustor was not required by any Colorado Oil and Gas Commission (COGCC) rules. As noted during the site visit, the flare is currently out of service. Also, as noted during the site visit, all pumps and other equipment located at this facility are electrically driven so there are no generators or other equipment utilizing internal combustion engines operating on the facility. In light of the information provided in the amendment application and in this letter, BBC still believes that the proposed amendment does not constitute a substantial change to the approved SUP. This letter provides additional information to address the concerns you raised in an email to Doug Dennison on June 24, 2009. 1 In regard to your traffic concerns, the letter dated June 22, 2009 stated that the current and historic average daily truck traffic to this location since it began operations is approximately 10 trucks. This estimate was provided by BBC personnel who are familiar with the day-to-day operation of the facility. BBC has not maintained, and was not required by the original SUP approval to maintain, records regarding numbers of trucks accessing this facility, therefore, more detailed data regarding truck traffic are not available. Additionally, this would be very difficult information to collect as the facility is not manned at all times. As was stated in the June 22, 2009 letter, BBC's pipeline infrastructure will allow the operation of the additional 10 tanks at the site with no increase in the amount of truck traffic (above that already approved for the facility -30 tpd average as specified by the original SUP approval) accessing the facility . BBC will continue to comply with the conditions of the original SUP approval and will not allow night deliveries via truck to this facility. 2. In regard to air emissions from the facility, a copy of the evaluation of the facility's 2008 operating year emissions is included in Attachment A. Emissions were evaluated under the Colorado Department of Public Health and Environment, Air Quality Control Commission Regulations that were effective during 2008. CDPHE revised several of the APEN exemptions in December 2008 and the rules became effective In 2009. As shown in this attachment the 2008 actual emissions for the equipment at the Rodreick SWD 1099 18TH STREET SUITE 2300 DENVER, CO 80202 P 303 293 9100 F 303 291.0420 and co -located production site were Air Pollution Emission Notice (APEN) Exempt and no notices or permit application filings were required by the CDPHE. BBC is currently evaluating APEN notice and permitting requirements due to these rule changes and the proposed facility expansion. Due to these rule changes, APENS for the produced water tanks will be required (trigger is 2 ton per year or greater emissions). However, these tanks are permit exempt per the revised CDPHE regulation. When BBC's evaluation of the projected emissions due to the project expansion is complete, BBC will submit the applicable notices or applications to the CDPHE Air Pollution Control Division (APCD). Here is a summary of our discussion and what is needed to finalize a determination for an administrative approval or a recommendation hearing before the Planning Commission and a final decision by the BoCC for the Rodreick SUP Amendment (MPAA6009). In both cases this request will be considered under the Major Impact Review process detailed in the Unified Land Use Resolution of 2008. The first issue to resolve is the discussion of a lined "pond" discussed in the original Special Use Permit approved by the BoCC on April 7, 2008 under Resolution Number 2008-43. During our meeting and my site visit we confirmed that a pond to contain Produced Water was never constructed. I've attached the pages in the original narrative for your reference. We also discussed impacts to the roads with increased truck traffic due to the addition of ten five hundred gallon storage tanks to the approved ten tank operation. You indicated you will provide some documentation for the total trips/day for the site since beginning operation. Please include a breakdown based on time of day. Your amended narrative should include a discussion on the historic trips since operation began and how the addition of ten more storage tanks will not increase truck traffic beyond the 30 trips/day discussed in the traffic narrative in the original SUP approval. The final concern is VOC emissions from the current operation and any increased emissions that may result from the addition of ten new Produced Water storage tanks. You mentioned that the Bill Barrett office indicated that the original assessment for the site was below the minimum threshold for a permit from the Colorado Department of Public Health and Environment. Some documentation showing that you have complied with the CDPHE both with the current operation and that the proposal for ten additional storage tanks will not place the site at a tipping point where CDPHE permitting is required. The Unified Land Use Resolution has specific timelines for a "Technically Compete" application. The TC determination must be made within 30 working days of submittal of the application and supporting documents and the Rodreick SUP amendment application was received on June 5, 2009. The end of the TC review period is July 17, 2009 so a timely submittal of the above documentation would expedite a determination. Firstly, the traffic is a concern. I requested a summary of all daily traffic since beginning operation and that was not provided. The original traffic impact reported that the site would experience no more than 30 tpd and you are at 20 tpd as noted in your addendum. How does the addition of 10 tanks stay within the 30 tpd total approved with the original permit? In addition, you mentioned 2 night trips. The conditions attached to the SUP do not allow for night deliveries. The Director has no authority to administratively approve a change to the BoCC conditions. If it is your intent to add night trips then this must be a new application fir Major Impact Review under the Unified Land Use Code. The statements from BB Corporation concerning emissions is inadequate. I need numbers showing the analysis and how the current operation is below the threshold and the additional 10 tanks will not exceed the threshold determination for an air quality permit. The first paragraph addressing the "pond" will suffice. Based on the additional information you submitted for administrative review, the decision I would recommend to the Director is denial due to the "Substantial Change" to the original permit (i.e., night truck traffic). If you request for Administrative Approval is denied you always have appeal rights to the BoCC but the correct course based on the current information is to apply for a new Major Impact Review to alter the site operation. Please note that the information I requested in my past email will still apply to the new permit application. Without the requested information this application will be deemed "Not Technically Complete" on July 17, 2009. Each of the comments included in your email are addressed below. Absence of Lined Pond As noted during your site visit, BBC did not construct a lined pond (pit) for the storage of water at this location. All water storage is being and will continue to use closed -top tanks. The site plan included with the application to amend the approval for this facility is accurate in that it does not include a lined pond, and the approval for this amendment should reflect that BBC has not and will not construct a lined pond at this location. Truck Traffic Due to BBC's existing pipeline infrastructure used to transport water to and from their operations, the addition of the 10 tanks requested in the amendment application will not increase truck traffic above current levels nor will it alter the truck traffic patterns or hours of use. BBC personnel involved with the operation of this facility indicate that the current average daily truck traffic to this facility is approximately 10 trucks per day. The majority of these trucks travel to this facility during daylight hours, however approximately 2 trucks per day may be required to travel to the location at night. Air Emissions BBC staff responsible for obtaining air emissions permits from the Colorado Department of Public Health and Environment (CDPHE) Air Pollution Control Division (APCD) have evaluated emissions from the existing tanks at this facility and these emissions have not met the thresholds established by APCD for requiring emission notices, controls (e.g., combustor), and/or permitting. As was discussed during the site visit, BBC voluntarily installed a vapor collection and control system (combustor) to destroy vapors vented from the tanks even though there were no odor complaints specific to this facility and tank emissions had not exceeded the APCD thresholds that required reporting, permitting or installation of controls. In addition the combustor was not required by any Colorado Oil and Gas Commission (COGCC) rules. As noted during the site visit, the flare is currently out of service. This letter provides additional information to address the concerns you raised in an email to Doug Dennison on June 24, 2009. 1. In regard to your traffic concerns, the letter dated June 22, 2009 stated that the current and historic average daily truck traffic to this location since it began operations is approximately 10 trucks. This estimate was provided by BBC personnel who are familiar with the day-to-day operation of the facility. BBC has not maintained, and was not required by the original SUP approval to maintain, records regarding numbers of trucks accessing this facility, therefore, more detailed data regarding truck traffic are not available. Additionally, this would be very difficult information to collect as the facility is not manned at all times. As was stated in the June 22, 2009 letter, BBC's pipeline infrastructure will allow the operation of the additional 10 tanks at the site with no increase in the amount of truck traffic (above that already approved for the facility -30 tpd average as specified by the original SUP approval) accessing the facility . BBC will continue to comply with the conditions of the original SUP approval and will not allow night deliveries via truck to this facility. 2. In regard to air emissions from the facility, a copy of the evaluation of the facility's 2008 operating year emissions is included in Attachment A. Emissions were evaluated under the Colorado Department of Public Health and Environment, Air Quality Control Commission Regulations that were effective during 2008. CDPHE revised several of the APEN exemptions in December 2008 and the rules became effective in 2009. As shown in this attachment the 2008 actual emissions for the equipment at the Rodreick SWD 1099 18TH STREET SUITE 2300 DENVER. CO 80202 P 303 293 9100 F 303 291.0420 and co -located production site were Air Pollution Emission Notice (APEN) Exempt and no notices or permit application filings were required by the CDPHE. BBC is currently evaluating APEN notice and permitting requirements due to these rule changes and the proposed facility expansion. Due to these rule changes, APENS for the produced water tanks will be required (trigger Is 2 ton per year or greater emissions). However, these tanks are permit exempt per the revised CDPHE regulation. When BBC's evaluation of the projected emissions due to the project expansion is complete, BBC will submit the applicable notices or applications to the CDPHE Air Pollution Control Division (APCD).
