HomeMy WebLinkAbout3.0 Resolution 99-073110110111 IIII1I III1I III IIII IIIIIIII III IIIII IIII III 548062 ..x/29/1999 02:58P B1137 P725 M ALSDORF 1 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At are ul r meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on _Monday the 28th day of June A.D. 19 99 there were present: John Martin Commissioner Chairman Walt Stowe Commissioner Larry McCown Commissioner Don DeFord County Attorney Mildred Alsdorf Clerk of the Board Ed Green County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 90_n73 A RESOLUTION CONCERNED WITH THE EXTENSION OF CONDITIONS OF A SPECIAL USE PERMIT APPROVAL IDENTIFIED AS RESOLUTION 99-055 FOR AMERICAN SODA WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from American Soda LLP for the extension of permit deadlines for a Special Use Permit as conditionally approved by Resolution 99-055: WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned regular meeting, has made the following determination of fact: That publication and public notice was not required for the consent agenda item before the Board of County Commissioners. 2. That the review by the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. That the application is in compliance with the terms and conditions of approval of Resolution #99-055. For the above stated and other reasons, the proposed extension of permit deadlines is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the extension of permit deadlines for the aforementioned conditional approval of a Special Use Permit be and hereby is approved to allow for the extension of permit dead lines as follows: That the Endangered Species Act (Section 7) Compliance to be issued by the US Fish and Wildlife Service submittal deadline be extended to August 15, 1999, and That the Roadway/Highway Permit to be issued by the Colorado Public Utilities Commission submittal deadline be extended to August 15, 1999; and That the Section 112 Reclamation Permit to be issued by the Colorado Department of Natural Resources Division of Mining and Geology deadline be extended to August 15, 1999; and That the Cultural Resources Compliance to be issued by the US Department of Interior submittal deadline be extended to August 15, 1999.
