Please submit, in narrative form, the nature and character of the Special Use requested. Submit plans and supporting information (i.e. letters from responsible agencies). Include specifications for the proposed use including, but not limited to, the lwurs of operation, the number and type of vehicles accessing th e site 011 a daily, weekly and/or monthly basis, and the size and location of any existing and/or proposed structures that will be used in conjunction with the proposed use, and provisions for electric power service and any other proposed utility improvements. Be specific. EnCana Oil & Gas (USA) Inc . (EnCana), acting on behalf of American Soda LLP, requests a Speci a l Use P ermit fo r a te mporary emp loyee offi ce (TEO) associated with dri llin g operations in Garfield County. The TEO will be lo cat ed in th e north e nd of the Am e ric an Soda L L P p arkin g lo t. EnCana currently leases a large portion of the property including the office facility from Americaµ Soda LLP. EnCana h as e ntere d a s ur face u se agreement wi th Ame rican Soda LLP fo r the porti on..of the parking l ot on which th e TEO w ill be located (see Surface Use Agreement Tab). The TEO w ill be u sed 10 -12 ho urs a day . The TEO uni t is a pre-fabri cat ed, t hree modul ar unit s meas uring l3 '4" X 60' for a total ot:. 42 ' X 60' th at will have IO office spaces, 2 h a nd icapped accessible restroom s, a conferen ce roo m , sm a ll k itch enette, an d a storage room. The Unit wi ll be handicap access ibl e throughout faci lity. The TEO units are ce1tified by the Stat e of Colorado Division of Housing and a re rated as R2 fo r nonresidential us e. The fac ility wi ll be powered from existing power from th e American Soda LLP Warehouse locat ed directly t o the west, approx imate ly 75 feet. Refer to the narrative and supportin g documentation for addit ional information on the TEO. 2. If you will be using water or will be treating wastewater in co11junctio11 with the proposed use, please detail the amount of water that would be used and th e type of wa s te water treatment. If you will be utilizing well water, please attach a copy of th e appropriate well permit and any other legal water s upply information, including a water allotment contract or an approved water augmentation plan to d emonstrate that you have legal and adequate water for the proposed use. Special Use Perm it Applic ation Ja n umy 2008 ) Temporary Employe e Office Volume of potable water u sed and wastewater produced is based on calculations from CDPHE data. EnCana estimates that potable water consumed is approximately 15 gallons per person per day and the wastewater produced is also a iproximate l y 15 gallon s per person per day. Based on the 13 person average occupancy rate, daily water use and wastewater produced is approx imately 195 gallons per day per TEO facility . T here is no water well located at thi s location, nor are any water supply wells planned in th e future. Potable water is provided at the TEO facility and includes bottled water and potable water stored in potable water tanks. The TEO facility will have a minimum of one potable water storage tank which is filled as ne eded. EnCana uses CDPl:;IE-certified potable water hau ler , A rtesian Water Services-Mark Hudson 970-858-3479, to haul potable water to th e TEO iacility. Potable water so urces include a gro undwate r well in Mesa County and municipa l sources from Ute Water. The TEO facility will have a minimum of one wastewater storage tank. Black a nd g rey water will be contained in thi s tank. EnCana will use Mountain West Oil Field Services-Cal H ar low 970-858-8859, to empty the wastewater tanks. Tanks wi l l be empti ed as needed. Sewage is di sposed of at the City of Rifle disposal faci lity. Refe to the application narrative for additi onal information on wastew ater and potable w ater. 3. Suh mit a s ite plan /map drawn to scale that portrays the boundaries of the subject property, all existing mu/ propose</ structures 011 the property, and the Co unty or State roadways within one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. A site plan for the loc ation of the TEO north of Parachute is included in th e Map Tab. The s urvey package includes a location map, detailed driving directions fr om the Town of Parachute, and a detailed s ite plan with distances between s tru ctures, water tank s, and trash receptacles . This s ite do es not require a driveway acce ss permit. EnCana will utili ze existing driveway to the office. 4. S uh mit a vicinity map s howing slope I topography of your property, for which a U.S. G.S. 1:24,000 scale quadrangle map will suffice. A map of the s urrounding lo cation is included in the Maps Tab. 5. Suh mit a copy of the appropriate portion of a Garfield County Assessor's Map showing all th e subject property and public amt private lam/owners atljacent to your property (which s h ould b e delineated). /11 addition, submit a list of all property owners, public and private landowners and their addresses adjacent to or within 200 ft. of tile site. This i11formatio11 can he obtained from tile Assessor's Office. We will also need the names (if applicable) of all mineral right own ers of the s ubjec t property. (That information can he found in your title policy under Exceptions to Titl e). 2 Spec ial Use Permit Application J a1111a1y 2008 ) ) Te111pora1y Employee Office The Ownership Tab includes the names and addresses of adjacent landowners and the applicable Garfield County Assessor 's Maps delineating the subject property and adjacent landowner. American Soda LLP surface rights description is also included in the Ownership Tab. 6. Sub mil a copy of the deed aml a legal description of the subject property. The Deed and Legal Description of the property are included in the Deed and Legal Description Tab. 7. If you are acting as an agent for the property owner, you must attach an acknowledgement from the property owner that you may act in his/her behalf. Surface dam age agreements between American Soda LLP and EnCana specifically authorize th e installation of this temporary office and are provided in the Surface Use Agreement Tab. 8. Submit a statement that specifically responds to each of tlzefollowing criteria from Section 5.03 of the Zoning Regulations: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standar<ls and approve</ by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Ut ilities will be provided at the TEO locati on . Utilities will consist of a 4,500 gall on potable water storage ta nk and a 4 ,5 00 ga ll on wastewater storage t ank. Utilities (i.e. storage tanks) will be temporary in nature and will be moved from this si te upon non-use of fac ilit y. Volume of potable water used and wastewater produced is based on calculations from CDPHE data. EnCana estimates that potable water cons umed is approximately 15 ga llons per person per day and the wastewater produced i s al so approximately 15 gallons per person per day. (2) Street improvements adequate to accommodate traffic volume generated by tlte proposed use and to provide safe, convenient ac cess to tlte use sltal/ eitlter be in place or shall be constructed in conjunction witlt tlte proposed use; Access to the TEO w ill be provided by County Road 215 , an exi sting paved access road w ill be leading to the TEO that provides safe, conven ient, year-round access to the office fac ility. This drive way access is in use at the present time b y American Soda LLP and EnCana employees. (3) Des ign of til e proposed use is organized to minimize impact on and from adja cent uses of land tit rough installation of screen fences or landscape materials on tile periphe ry of til e lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; The propose d faci lity is a one story office compl ex. The impac t should be minimal for th e surrounding ne ighborhood. B ecause of th e locati o n of th e fac ili t y, la ndscap e or fe n ci ng is no t necessary as i t is an exis ting fe nce d park in g lot. 9. Depen din g on the typ e of Special Use P ermit reques ted, you may n eed to respond to additional revie w standards in th e Garfield County Zoning Resolution Section 5.00 [Supplementary Regulations]. This may include uses suclz industrial uses [section 5.03.07 & 5.03.08], Accessory Dwelling Units [s ection 5.03.21], Utility line/Utility Substations, etc. Specific sections of tlte Zoning R esolution wlticlz can be lo cate d on tlze Garfield County web site at ltttp:!lwww.gar{ieldcounty.com!building and planni11g/imlex.l1tm, or information can be obtained from tltis office. 5.03.07 lndustria l Op eration s : Industrial Op erations, including extraction, processing, fabrication, industrial s upport facilities, mineral waste di sposal, storage, sanitary /mu/fill, salvage y ard, a ccess routes and utility lines, sltal/ be p ermitted, provided: (1) Tlze applicant for a permit for industrial operations shall prepare mu/ submit to the Planning Direc tor ten (10) copies of an impact state m ent on tlze propo sed use describin g its lo cation, scope, design mu/ construction sclz e dule, including an explanation of its operational chara cteristics. Potable water w ill be provided from groundwater we ll s or municipal sources stored on s ite in t a nlc s. Wastewater will be collected and disposed of a t an approved di sposal facility. There are no anticipated impac ts to gro undwater or surface water. The location of the TEO is in a n existing parking lot and w ill not need a stromwater or reclamation plan in pl ace. (B) Impacts 011 adjac ent land from the gen eration of vapor, dust, smoke, noise, glare or vibration, or other emanations; There are no re sidences within one mile of the property and the geographical relief is sub stantial in nature . Adjacent prop erty owners w ill not be affected by any fo rm of emi ssion emanating from thi s s ite. (C) Impacts on wildlife and dom estic animals through the creation of hazardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions; T h e location is an existing parking lot and will not have any affects on ex is ting vegetation o r wildlife. (D)Affirmatively show th e impacts of truck and automobile traffic to am/from such uses and their impacts to areas in th e County; Traffic a lready ex ists to th e existing park ing lot; therefore traffic wi ll not in crease d ue to th e TEO fac ilit y. (E) That sufficient distan ces shall separate such use from abutting prop erty which might otherwis e be damaged by operations of the proposed use(s); Special Use Permit Applica tion Ja1111a1J' 2008 The proposed si te is isolated from any a butting uses. Th ere are no residences w ithin one mile of the property a nd the geographical re li ef i s s ub s tantia l, caus in g th e effects t o be n e gligib le. 5 Ten1porary Etnployee Office 6 (F} Mitigation measures proposed for all of the foregoing impacts identified and for the standards identified in Section 5. 03.08 of this Resolution. No mitigation measures are proposed. (2) Permits may be granted for those uses with provisions that provide adequate mitigation for the following: (A) A plan for site rehabilitation must be approved by the County Commissioners before a permit for conditional or special use will be issued; The proposed area is an existing parking lot and will not need to be rehabilitated. (B) The County Commissioners may require security before a permit for special or conditional use is issued, if required. The applicant shall furnish evidence of a bank commitment of credit, bond, certified check or other security deemed acceptable by the County Commissioners in the amount calculated by the County Commissioners to secure the execution of the site rehabilitation plan in workmanlike manner and in accordance with the specifications and construction schedule established or approved by the County Commissioners. Such commitments, bonds or check shall be payable to and held by the County Commissioners; Due to the nature of this application, the temporary office will be removed upon completion of use. Each unit is a modular unit and the parking lot will be returned to its original intended use. (C) Impacts set forth in the impact statement and compliance with the standards contained in Section 5.03.08 of this Resolution. (A. 93- 06I) 5.03.08 Industrial Performance Standards: All industrial operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with the following standards; (1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. (2) Vibration generated: every use sltall be so operated that lite ground vibration inlterently and recurrently generated is not perceptible, wit/tout instruments, at any point of any boundary line of tlte property on wlticlt tlte use is located; None anticipated. (3) Emissions of smoke and particulate matter: every use shall be operated so as to comply witlt all Federal, State and County air quality laws, regulations and standards; None anticipated. (4) Emission of !teat, glare, radiation and fumes: every use sltall be so operated that it does not emit !teat, glare, radiation or fumes wlticlt substantially intelfere with tlte existing use of adjoining property or wlticlt constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or otlter suclt operations which may be required by law as safety or air pollution control measures sltall be exempted from this provision; None anticipated. (5) Storage area, salvage yard, sanitary landfill and mineral waste disposal areas (A97-112) Installation of the TEO facility will not include storage areas, salvage yards, sanitary landfills, or mineral waste areas. A) Storage of flammable or explosive solids or gases shall be in accordance with accepted standards and laws and shall comply witlt the national, state and local fire codes and written recommendations and/or comments from the appropriate local protection district regarding compliance with the appropriate codes; (A97-112) Storage of flammable or explosive solids or gases will be in accordance with accepted standards and laws and will comply with the national, state and local fire codes and written recommendations/comments from the appropriate local protection district regarding compliance with the appropriate codes. Special Use Pennit Application January 2008 7 ) ) Temporwy Employee Office 8 (BJ At tile discretion of the County Commissioners, all outdoor storage facilities may be required to be enclosed by fence, landscaping or wall tu/equate to conceal sucll facilities from adjac ent prop erty; (A97-J 12) There is no storage facility associated with the TEO facility. (CJ No materials or wastes sllall be deposited upon a property in such form or manner that they may be transferred off til e property by any reasonably foreseeable natural causes or forces; (A97-112) No materials or wastes will be depo sited in a form or manner that will a ll ow off-site transport. The TEO facility will have a minimum of three thirty- gall on, bear-proof refuse receptacle. E nC ana will use We stern Colorado Waste to empt y the refuse receptacles. Receptacles will be emptied as needed , with a minimum removal once per week. Refuse is di sposed of at the Garfield County landfills. (D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above and tile following standards: (A97-112) 1. Tile minimum lot size is five (5) acres and is not a platted subdivision. 2. Tile equipment storage area is not placed any closer than 300 ft. from any existing residential dwelling. 3. All equipment storage will be enclosed in an area witll screening at least eight (8) feet in height and obscured from view at tlte same elevation or lower. Screening may include berming, landscaping, sigltt obscuring f encing or a combination of any of tltes e methods. 4. Any repair and maintenance activity requiring tlte use of equipment tltat will generate noise, odors or glare beyond the property boundaries will be conducted within a building or outdoors during th e !tours of 8 a.m. to 6 p.m., Mon.-Fri. 5. Loading and unloading of vehicles shall be conducted 011 private prop erty and may not be conducted on any public right-of-way. The TEO fac ility will no t require s torage of heavy equi pment. (E) Any storage area for uses not associated witlt natural resources sllall not exceed ten (JO) acres in size. (A97-112) The TEO facility will not require stora ge areas fo r u ses not assoc iated with natura l resource s. Special Use Penn i! (6) Water pollution: in a case in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities may begin. All percolation tests or ground water resource tests as may be required by local or State Health Officers must be met before operation of the facilities may begin. The TEO facility will not create water pollution hazards. JO. A $400.00 Base Fee: Applicant shall sign the ''Agreement for Payment" form and provide the fee with the application. 11. Submit 2 copies of this completed application form and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the Special Use Permit application has been deemed technically complete. Special Use Penni! Application January 2008 9 Ten1pora1y En1ployee Office II. PROCEDURAL REQUIREMENTS (The following steps outline how the Special Use Permit Application review process works in Garfield County.) J. Submit tltis completed application form, base fee, and all supplemental information to tlte Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical completeness. 2. Once tlte application is deemed technically complete, tlte Staff Planner will send you a letter indicating the application is complete. Jn addition, Staff will also send you a "Public Notice Form(s)" indicating tlte time and date of your !tearing before the Board of County Commissioners. Prior to tlte public hearing, Staff will provide you with a Staff Memorandum regarding your requested Special Use. (lf Staff determines you application to be deficient, a letter will be sent to you indicating tltat additional information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding tlte requested Special Use and the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including tlte name of the applicant, description of the subject lot, a description of tlte proposed special use and nature of the hearing, and the date, time and place for the !tearing shall be given once in a newspaper of general circulation in that portion of tlte County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described under paragraph (J) above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200? of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such !tearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. c. Tlte site shall be posted such tltat the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. Tlte posting must take place at least tltirty (30) but not more than sixty (60) days prior to tlte hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the !tearing. 4. The Applicant is required to appear before tlte Board of County Commissioners at the time and date of the public hearing at wlticlt time the Board will consider tlte request. Jn addition, the Applicant sltall provide proof, at tlte hearing, that proper notice was provided. JO Once tlte Board makes a decision regarding tlte Special Use request, Staff will provide tlte Applicant with a signed resolution memorializing the action taken by tlte Board. Following Special Use Permit Application January 2008 Tetnporaty Employee Office the Board's approval, this office will issue the Special Use Permit to the applicant. If the Board's approval inclu<les specific conditions of approval to be met, this office will not issue the Official Special Use Permit certificate until the applicant has satisfie<l all conditions of approval. The Special Use Permit approval is not finalized until this office has issued the Official Special Use Permit certificate signed by the Chairman of the Board of County Commissioners. EnCana is in need of 10 office spaces for employees associated with the drilling in t he North Parachute Ranch. 1.2 Purpose and Need The TEO is needed to alleviate the overcrowded office spaces curr_ently occupied by American Sod a LLP and EnCana. T he purpose of the TEO is to hold 12-15 employees to conduct necessary work in relation to the drilling operations in Garfield County. 1.3 Locatio n and Ownersh ip The TEO location is to the north of Parachute off of County Road 2 15. Surface Use Agreement Provides letter from American Soda LLP for permission to act on their behalf. 2.0 PROJECT DESIGN TEO will be required at the American Soda LLP location. Duration of the TEO is determined by the amount of time it will take EnCana to design and complete an office complex. The TEO will be used 10-12 hours a day for the duration of time needed not to exceed two years (Contingent upon approval of this permit application). The TEO unit will be a three section modular pre-fabricated unit, which will contain IO office spaces, two restrooms, one storage closet, a kitchenette, and a conference room. TEO units have been constructed in accordance with all applicable federal, state, and county regulations; including the International Building Code 1991. All units associated with the TEO on the proposed site are certified by the State of Colorado Division of Housing rated as R2 for nomesidential use, (Certificate #00525). Utilities associated with TEO are of a temporary nature due to the short duration the facility is located on the proposed site. Wastewater tanks, potable water tanks, and bear-proof trash receptacles will be provided at the TEO facility. The TEO will be powered by existing electrical drops from a nearby warehouse. 2.1 Potable Water System Potable water will be provided at the TEO and includes bottled water and potable water stored in potable water tanks. The TEO will have a minimum of one potable water storage tank. The water storage tanks will be filled as needed. Water systems are detailed as follows: kitchenette and toilets, with an average potable water consumption of 195 gallons per day with an average of 13 workers occupying this site in any given day. The potable water tank will be at least 4,500 gallons. EnCana will use a CDPHE-certified potable water hauler (Artesian Water Supply, Mark Hudson 970-858-3479) to haul potable water to the TEO facility. Potable water sources include a groundwater well in Mesa County and municipal sources from Ute Water. A copy of the affidavit with EnCana's potable water contractor is included in the Hauler Affidavit Tab. The TEO facility will serve 12-15 people or less. Based on EnCana's experience, there will be an average of 13 workers at the office at any one time. EnCana's potable water contractors will conduct monthly tests and maintain records of stored potable water samples specific for coli form. Any tests indicating coli form contamination will be disclosed to the Garfield County 2 Special Use Pennit Narrative January 2008 Te1npora1y Employee Office Board of Health. EnCana will keep appropriate records, which will be provided to the County upon request, to demonstrate that water supplied to a site is from an approved source. 2.2 Wastewater System The TEO facility will have a minimum of one wastewater storage tank for black and grey water. Each wastewater storage tank will be equipped with an overflow alarm. Wastewater systems are based on 13 occupants with kitchenette and toilets averaging 15 gallons per day per worker for a daily total of 195 gallons per day. EnCana will use Mountain West Oil Field Services (Cal Harlow 970-858-8859) to empty the wastewater tanks. Tanks will be emptied as needed. Wastewater/sewage is disposed of at the South Canyon or the City of Rifle disposal facility. A copy of the affidavit with EnCana's wastewater/sewage contractor is included in the Hauler Affidavit Tab. Mountain West will provide the facility with a minimum of 4,500 gallon tank. EnCana will maintain all records including, but not limited to trip logs/reports and disposal receipts and will maintain all sewage disposal records as public records to be available to the County and/or any interested third party upon request. 2.3 Power The TEO facility will generate electrical power from adjacent available electric feed. The facility will use a 200 amp service. 2.4 Refuse EnCana will use Western Colorado Waste (Troy Latham 970-858-7518) to empty the refuse receptacles. Receptacles will be emptied as needed, with a minimum removal once per week. Refuse is disposed of at the Garfield County landfill. A copy of the affidavit with EnCana's refuse contractor is included in the Hauler Affidavit Tab. The TEO facility will have a minimum of three 35 gallon "bear-proof" trash receptacles. EnCana will maintain all records including, but not limited to; trip logs/reports and landfill receipts and will maintain all records as public records to be available to the County and/or any interested third-party upon request. 3.0 PROJECT OPERATIONS 3.1 Safety and Emergency Response The TEO facility will comply with all EnCana safety practices and emergency response procedures. A copy of EnCana's Emergency Response Plan and emergency contact numbers are provided in the Emergency Response Tab. The survey package includes a location map, detailed driving directions from the Town of Parachute, and GPS coordinates. EnCana will provide a copy of the survey package to the Garfield County's Sheriff Office, Dispatch, Planning Department, and to the Grand Valley Fire Protection District. 3.2 Sanitation The TEO facility will be maintained in a clean and sanitary condition. Refer to Sections 2.2 and 2.4 of this narrative for a discussion on wastewater and refuse collection and disposal. 3.3 Fire Protection The TEO facility will comply with all IFC fire requirements. Fire extinguishers of a type suitable for flammable liquids or electrical fires (Class B or Class C), carbon dioxide or dry chemical, will be located in each unit. A sufficient number of fire extinguishers will be provided so that personnel do not need to travel more than 100 feet to reach the nearest extinguisher. Smoke alarms and single-station carbon monoxide alarms will be placed throughout the TEO. 3.4 Food Preparation There will be no food preparation at this facility. 4.0 IMPACT STATEMENT 4.1 Water The TEO facility will be located on an existing parking lot. Potable water will be provided from groundwater wells or municipal sources. Wastewater will be collected and disposed of at an approved disposal facility. The site is an existing parking lot using best management practices and appropriate erosion control measures. There are no anticipated impacts to groundwater or surface water. 4.2 Emanations Installation of the TEO facility on this site is not expected to generate vapor, smoke, glare or vibration. Noise impacts will be minimal, localized to the vehicle traffic. Fugitive dust impacts will be the same as current levels. There are no residences within one mile of the property and the geographical relief is substantial in nature. Adjacent property owners will not be affected by any form of emission emanating from this site. 4.3 Traffic Access to the proposed TEO site will be off of County Road 215 in Garfield County north of Parachute, Colorado. EnCana has a well-maintained paved road to the site location that provides safe, convenient, year-round access to the existing facility and will be used for the TEO. 4 Special Use Permit 1Varrative January 2008 Tempora1y Employee Office Installation of TEO facility will not increase the vehicle traffic on County Road 215. EnCana employees currently use the existing driveway to access office building off of County Road 215. 4.4 Wildlife Installation of TEO at this location permitted through County will not result in additional impacts on wildlife or domestic animals. Construction of the TEO will have a short-term, localized impact on and will not effect the vegetation as it will be located on an existing parking lot. 4.5 Visual The proposed site is fairly isolated from any abutting uses. There are no residences within one mile of the property and the geographical relief is substantial, eliminating any noticeable effect. The TEO facility will be located in the American Soda LLP parking lot and will blend with the existing industrial neighborhood character. 5.0 MITIGATION MEASURES 5.1 Stormwater Management A stormwater management plan will not be needed; however a CDPHE Stormwater Permit and associated Stormwater Management Plan (SWMP) are in effect for construction activities. The SWMP describes the best management practices for erosion control and management of stormwater. The proposed site and other disturbed areas will be inspected every 14 days (and after significant rainfall events) to ensure compliance with conditions of the Storm water Permit. 5.2 Reclamation The TEO facility will be located on an existing parking lot. Upon removal of the TEO facility, EnCana will complete the following: remove debris and waste materials and dispose of at an appropriate facility; pump out wastewater tanks; and remove pipe, cables, and related infrastructure. 5.3 Weed Control EnCana will properly dispose of any weeds that may appear to the location during and after facility has been removed. These two elements are typically described in emergency response plans and are designed to effectively provide life safety, protect property, minimize risk to the environment, and manage impacts on corporate image and reputation. This plan, Emergency Response Plan (ERP), covers the expectations , protocols, roles , and responsibilities to support site-specific emergency response plans. It is an expectation that site-specific plans are in place as required by regulation for pipelines, compressor, battery, and plant facilities. Site-specific plans for facilities on a smaller scale than those described above will be assessed on an as required basis with Operations and EHS. The intent of this ERP is to comply with gu idelines set forth by the Occupational Safety and Health Administration (OSHA). Specifically, the regulations of 29 CFR 1910.38 and 29 CFR 1910.120 have been followed when applicable. EMERGENCYLEVELASSESSMENT An emergency is an unexpected or unplanned event that demands immediate attention and has or could result in harm to people, damage to property or the envi ronment, loss of process, or negative impact on co rporate image and reputation. Emergencies are defined in three levels that are universally recognized terms and fam iliar to most response participants. Level1 There is no potential danger to outside company property or right-of-way, no threat t o the public, and Company personnel can handle the situation . Notification to the Supervisors and other authorities should be timely. Examples of Level 1 emergencies include: -An oil or saltwater spill of any magn itude that is confined to the lease and does not flow onto private, state or federal property, or enter a stream, river, pond, dry dra inage. Any leak or spill (controlled or uncontrolled) that causes the evacuation of nearby residences, buildings or facilities , or causes significant environment damage. The nature and emergency level of the event determine the involvement of these functional roles as illustrated in the table. Those who assume actual control of the incident scene and direct emergency response operations are acting as Incident Commanders and must receive the required OSHA training per 29 CFR 1910 .120 (q). Offer to contact a neighbor, friend, relative , minister, doctor or counsellor. -Leave your name and telephone number with family members. -Ensure the next-of-kin are protected from media harassment as required. -If a contractor 's employees are involved, a senior official of that company should be called to begin their notification process . A communication link should be maintained between the contractor and the Company until all notification issues are addressed. NEWS MEDIA It is important to develop and maintain a good working relationship with the news media from the outset of any emergency. The way that both field and corporate personnel interface with reporters will affect the public perception of the company and the effectiveness of our response. The news media have a responsibility to report on the incident. We have a responsibility to provide accurate information in a timely, consistent, and professional manner. Sometimes the particulars of the incident are not known . Until the facts are clear, answers to media queries should be as follows : "On (date} I at (time} there has been a (what) at (where} that involved company (.facilities, emplovees. equipment). "A complete statement will be issued by the Company as soon as the facts have been determined; until then no further information is available." Until Media Relations has been engaged, the Emergency Coordination Officer will deal with media inquiries. Under no circumstances will the name of any accident victim be released to the public before the next-of-kin are notified. When the facts become known, a Senior Company employee will , in conjunction with Media Relations, prepare a statement for release to the news media, if appropriate. It may become the story . -Remember -Any statements made by Company employees' and/ or contractors that may in any way deal with root cause, fault o r liability have the potential to negatively impact the corporate reputation . Interview Tips -Look directly at the reporter as you answer the question . When you finish an answer and the reporter doesn't speak -wait and don't continue speaking to break the silence . -Control the pace of your answer ; speak calmly and deliberately. Keep it simple! Avoid using industry jargon or technical terms . -Express concern for individuals affected by the mishap. State that your company is striving to rectify the situation as quickly as possible, and that you are diligently following a plan . -listen to the question . Ask to have it repeated if necessary . Don 't speculate as to the cause. "It's too early to tell but an investigation will determine the cause of the accident". -If you don't know , say so. Offer to find out and provide the answer later. -Anything you say to a reporter at any time may be reported. Never offer to comment "off the record". Remember you are still "on the record", even after the camera has been turned off. -Don't speak or comment for or speculate about other parties. -Document reporter's name, organization, phone , and fax numbers. When possible , write down the name, company, and telephone number of every person on location at the time of the incident. Their information could be valuable during the investigation . All government investigators should be asked to present their credentials upon arrival at the accident scene and, upon verification , are to be afforded full cooperation. Answer the regulatory agency questions but do not speculate on any answers. The EHS Regional Support will coordinate internal investigations and follow-up written reports to any agency with the assistance of the Field Emergency Manager and Legal Counsel. The Emergency Coordihation Officer shall ensure that all evidence is preserved in its original state . Do not allow removal of any equipment (evidence) that was on site at the t ime of the incident. If, due to some unusual circumstance, an item of evidence must be removed, do not allow it to be altered or destroyed and document its handling and whereabouts . Work at the scene must not resume until permission has been obtained from the local, state and/or federal regulatory agencies. In some cases, work shall not resume until loss Control/ Insurance (insurance adjusters) has visited the site. The Emergency Coordination Officer and EHS Regional Support shall be responsible for obtaining that permission. EnCana utilizes the Incident Investigation Report Form and the Time and Event Log Form to capture all aspects of the incident. The Time and Event Log and Incident Investigation Report Form should be provided to the EHS Business Unit representative . These forms are included in the front and back covers of the ERP manual. REGULATORY REPORTING REQUIREMENTS Business Unit EHS support will ensure that the regulatory agencies are notified appropriate to the nature of the emergency. An accident that is fatal to one or more employees or causes the hospitalization of three or more employees shall be reported by the Business Unit EHS support to the nearest OSHA Area Office either orally or in writing within 8-hours of occurrence . The Business Unit EHS support ensures that appropriate OSHA reporting has taken place . EMERGENCY TIME and EVENT LOG The response to emergencies can be a hectic and stressful experience . One method to reduce the anxiety is to immediately begin a time and event log. The log is simple form used to document incident facts, communications, discussion de tails/ times and decisions made. A completed action log is very valuable information to recollect the chronological order of events for causal investigations , inquiries or any continuous improvement reviews . CHANGE MANAGEMENT Maintaining accurate emergency response information is the responsibility of all staff. Any misrepresentation of contact names or contact numbers or changes should be promptly brought to the attention of the Business Unit EHS Support . Changes to Emergency Response Plan The annual update will be used to modify the ERP with respect to : • Personnel. • Telephone numbers . • Resident lists (if any). • Health considerations . • Assistance requirements . • Road systems and evacuation routes. • Other area facilities, pipelines and facility operations . • Agency/regulation changes. • Debriefing results after drills or actual emergencies . • Evaluations of recommendations of company or contract personnel, or agency representatives .
