WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Barrett Resources Corporation for a Natural Gas Transmission Line and Processing Facility on the following described tract ofland: A tract of land located in portions of Sections 22, 27 & 34, T4S, R96 W; Section 2, 3, 11, 13, 14, 24, 25 & 36, TSS, R96 of the 6th P.M., an area extending northwest from Parachute Creek into Rio Blanco County (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 13th day of June, 1994, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Pennit~ and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: I. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. '2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special UsePennit be and hereby is authoriz.ed permitting the use of the above described tract of land for the natural gas trausmission line and processing facility, upon the following specific conditions: l. All proposals of the applicants shall be considered conditions of approval unless stated otherwise by the Board of County Conunissioners. 2. The applicants shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use Permit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use has commenced. 3. All vegetation shall be in accordance with the revegetation agreements approved by each property owner. All revegetation shall be conducted with certified weed-free seed. Barrett Resources Corporation shall be responsible for weed control in accordance with State and County regulations and a monitoring of the growth for two (2) years. 4. The applicant shall submit final easement agreements or evidence offinal condemnation proceedings prior to construction on properties that still require such agreements. 5. All contractors will be required to notify the County clerk and Recorder's office of all vehicles and heavy equipment brought into the County and not registered with the County. 6. Emergency response plan shall be filed with the County Emergency Preparedness officer. 7. All earth-moving equipment brought in from out-of-state shall be washed before entering Rio Blanco County to prevent the spread of noxious weeds. Equipment shall also be washed after working in any identified noxious weed area during construction within the pipeline easement in Rio Blanco County.
