Application Requirements: These items must be submitted with the application
l] Plans and specifications for the proposed use including the hours of operation, the amount of vehicles
accessing the site on a daily , weekly and/or monthly basis, and the size of any existing or proposed
structures that will be utilized in conjunction with the proposed use. Please submit this information
in narrative form and be specific.
2] If you will be using water or will be treating wastewater in conjunction with the proposed use, please
detail the amount of water that would be used and the type of wastewater treatment. If you will be
utilizing well water, please attach a copy of the appropriate well permit and any other legal wate r
supply information, including a wate r allotment contract or an approved water augmentation plan.
3] A map dra\vn to scale portraying your property, all structures on the property, and the County or State
roadways within one (1) mile of your property. If you are proposing a new or expanded acc e ss onto
a County or State roadway, submit a driveway or highway access permit.
4] A vicinity map, showing slope of your property, for which a U.S.G .S. I :24 ,000 scale quadrangle map
will suffice.
5] A copy of the appropriate portion of a Garfield County Assessor 's Map showing ail public and private
lando\vners adjacent to your prope rty . Include a list of all property owners and their addresses.
6] Attach a copy of the deed and a legal description of the property. If you are acting as an agent for the
property owner, you must attach an acknowledgment from the property owner that you may act in
his/her behalf.
7] For all applications pertaining to airports, the oil and gas industry, power generation and/or
transmi s sion industry, or any othe r classified industrial operation, you must submit an impact
statement consistent with the requirements of Sections 5 .03, paragraphs l thru 3 ; 5.03 .07. inclusive ;
and 5.03 .08, inclusive.
The consideration of this proposed Special Use will require at least one (l) public hearing , for which public
notice must be provided. The Planning Department will mail you information concerning this hearing(s).
approximately 30 days prior to the scheduled hearing . You will then be required to notify , by certified return
rece ipt mail , all adjacent landowners and publish the notice provided by the Planning Department, in a
newspaper of general circulation . Both these notices must be mailed/published at lea st 15 days prior to th e
public hearing. The applicant shall bear the cos t of mailing and publication and proof of mailing and
publication must be submitted at the time of the public hearing.

Enclosed are fire department comments to add to the recommendations in the draft staff report
which you forwarded to myself for review.
Access:
Per Article 9 of the 1994 Uniform Fire Code access to the property needs to be achieved by a fire
access road off of county road 117 which is no less than 20' in width and shall be designed and
maintained to support the imposed loads of fire apparatus and shall be provided with a surface so
as to provide all weather driving capabilities. An approved turn around capable of allowing our
class A pumpers to maneuver is required at the site. The maximum grade allowed by this
department is 10%.
Water Supply:
Based upon the information provided a fixed water supply is needed. I don't have enough
information to determine adequate water supply needs at this time. Access will also need to be
provided at the water source for department apparatus in the event of a fire.
More comments may be forthcoming as I receive more information about this project. The
comments you've provided at our behalf in the draft are appropriate. Please feel free to contact

This firm represents Dianne Holmes, who owns property located in Garfield County,
situated in the Four Mile Creek. County Road 117 vicinity. The applicant, Mr. Arbaney, has
delivered notice to our client in corutection with his application for a special use permit to run a
conunercial garage and storage space in an AIR/RD (Agricultural/Residential/Rural Density) zone
District. We understand that the scheduled public hearing on this matter has been set for
October 14, 1998, at the Courthouse in Glenwood Springs, and we will make an effort to have a
representative at the meeting .
On behalf of Ms. Hohnes, we want to put on record our client's strong objections to the
proposed special use pennit. Given the rural nature of this area. we believe that the existence of
any commercial activities, particularly a commercial garage and storage space, would substantially
aher the character of the surrounding environment. The applicant significantly understates the
potential disturbance posed by the "additional one or two vehicles per day" which he estimates his
customers will use to frequent .his conunercial garage. Inevitably, a conunercial operation of this
kind will involve a great deal more traffic than that. particularly on weekends, on a rural road that
is already under strain. In addition, many of Mr. Arbaney's customers will use larger trucks for
hauling trailers, or recreational vehicles or similar motor homes, which will have a greater impact
on the road and will be unsightly and noisy, as well as increasing the dust problem. A conunercial
storage operation and associated activities will involve an incr~ed. level of pollution as wen .

The commercial activity proposed by the applicant is best suited for an urban area, where
commercial garage and storage spaces are common, and the zoning is consistent with such uses.
This activity is simply not suited for a rural region and is inconsistent with the County's
Comprehensive Plan's credo that the County "shall develop, adopt and implement policies that
presetVe the rural landscape of the Roaring Fork Valley ... in a mutually beneficial manner that
respects the balance between private property rights and the needs of the community." (Page m-
15) The balance here, we submit, weighs in very heavily on the side of the applicant's neighbors,
visitors to this rural portion of the County and the community generally.
Lastly, and perhaps most impottantly, the commercial activities for which the applicant is
requesting a special use permit are wholly inconsistent with the Garfield County Zoning Code,
Section 3.02.03. The garaging and storage of"boats, recreational vehicles, automobiles, motor
homes, snowmobiles and trailers" is a far broader use than the simple "storage of heavy
equipment" that is allowed (as a special use only) by the Code, and clearly violates the intent of
the County CommWioners when they adopted the Code.

As you know, I represent Dianne Holmes. who has objected to Elmer Arbaneys' Special
Use Permit application to use his rural property for commercial storage purposes. I understand
that Mr. AJbaney's application for a Special Use Permit was withdrawn and/or continued at the
Public Hearing earlier this month. Given my client's interest in this potential dramatic change in
use of her neighbor's property, I would greatly appreciate it if you would inform me of Mr.
Arbaney,s decision to continue his application with the County.
Also, I must again state my frustration at receiving from your office a copy of the Garfield
County Zoning Resolution of 1978, which clearly states on the cover that it includes all
amendments through December 9, 1997 (i .e., the most r~t version), which included an
erroneous Section 3.02.03 (the section at issue in this matter). We rely upon the written
information provided by the County and, when erroneou8> we are seriously disadvantaged in
performing services for our clients. Given the confusion caused by the incomplete copy of the
Zoning Resolution delivered to us, please provide me for my files with a copy of Resolution 97-
112 (which added "storage" to the list of conditional uses for this zone district).

SPECIAL USE PERMIT REQUESTED BY ELMER ARBANEY
As a representative of the owner, Dianne Holmes, of a neighboring property to that of Mr.
Arbaney, 1 would like to confirm the owner's objection to this request for a special use
permit on the property along Four Mile Creek.
Mrs. Holmes relied on the rural and agricultural nature (and zoning) of this pristine
mountain property when making the purchase. Although one owner establishing a
unpermittcd business onto a secluded area of the property, may not sound detrimental to
some owners at first , however any such commercialization of the area could be effected
not only in the present, but also in the future by such a business venture. If one owner
gets a special use permit, this could set a precedent for granting similar requests in the
future. Perhaps that landowner has a much smaller piece of property, and therefore his
business would be near the road and visible to all passing by. We must protect the few
rural and agricultural areas that we still have. We must enhance and protect our land
and the environment by retaining its natural beauty and not trying to commercialize an
agricultural area.
There is also the issue of signage -most businesses put commercial signs at the
entry area to indicate the existence of the business. Any commercial signs along this
beautiful, rural area would certainly have a negative impact.
Although Mrs. Holmes received her notification late and has not had sufficient time to
thoroughly investigate all areas of the impact that such a special use permit may have on
the surrounding property, she is dclinitcly opposed to granting such a request.
On behalf of Mrs. Holmes, I thank you for your consideration of this letter of protest.
