RESOLUTION N0. 80-95
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION
BY SEBASTIAN J. BRUNGS
WHEREAS, the Board of County Commissioners of Garfield County has received
an application from Sebastian J. Brungs for a special use permit for a duplex
on the following described tract of land:
A parcel of land situated in Government Lot 2, Section 7,
Township 5 South, Range 90 West of the 6th Principal Meridian,
lying Westerly of the Westerly right-of-way of County Road
Number 241, and Easterly of the East Elk Creek centerline is
more particularly described as follows:
Beginning at the West quarter corner of said Section 7, a brass
cap found in place; thence N. 81°21'25" E., 649.46 feet to a
point on said Creek centerline, the "true" point of beginning;
thence N. 20°00'00" E., 110.00 feet along said Creek centerline;
thence N. 39°00'00" E., 70.00 feet along said Creek centerline;
thence N. 63°00'00" E., 93.50 feet along said Creek centerline;
thence leaving said Creek centerline, S. 86°48'00" E 268.54
feet to a point on said road right-of-way fence as constructed
and in place; thence S. 11°00'00" E., 215.70 feet along said
right-of-way fence: thence S.00°40100" W., 73.80 feet along
said right-of-way; thence leaving said right-of-way, N.86°48'00"
W., 39.49 feet to a rebar and cap in place, also being at a
fence as constructed and in place; thence N. 07°23'00" W., 75.00
feet along said fence to a rebar and cap in place; thence N.
86°48'00" W., 425.00 feet more or less along a fence as constructed
and in place to the "true" point of beginning.
The above described parcel contains 2.00 acres; more or less.
WHEREAS, pursuant to required public notice, the Board conducted a public
hearing on the 5th day of May, 1980, upon the question of whether the above
described special use permit should be granted or denied, at which hearing the
public and interested persons were given the opportunity to express their opinions
regarding the issuance of said special use permit; and
WHEREAS, the Board on the basis of the evidence produced at the aforementioned
hearing, has made the following determinations of fact:
1. The proposed use is compatible with the uses existing and permitted in
the district in which it is to he located, provided that certain hereinafter
contained conditions be complied with.
2. That neither the impact on traffic volume and safety or on utilities, or
any other impact of the special use will be injurious to the established neighbor-
hood or zone district in which the special use is proposed to he located.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County,
Colorado, that a special use of the above described tract of land for a duplex,
upon the following specific conditions:
1. That the use of the tract of land comply with present and future regula-
tions of Garfield County relating to'two family dwellings in the zone district in
which the property is now or may later be located;
2. That, prior to the issuance of the authorized special use permit, the
above described tract of land shall be severed from any other tract of land upon
which there may exist a principal use, unless such other such principal use has
been terminated at the time of the issuance of the special use permit.
