HomeMy WebLinkAbout2.0 BOCC Staff Report 01.04.1988BOCC 01/04/88 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: Public Hearing - Special Use Permit for an Agriculture -Related Business APPLICANT: Ralph Braden LOCATION; A tract of land located in a portion of the NW 1/4 of Section 31, T7S, R87W; more practically described as a tract of land located approximately 3 miles east of Carbondale, off County Road 100. DESCRIPTION OF THE PROPOSAL: It is proposed to operate a retail outlet for equestrian related equipment and apparel at an existing equestrian ranch. The ranch is now known as Preshana Farm, but was previously known as St. Finnbarr Farm. Parking will be provided in the existing parking area, which accesses off County Road 100. MAJOR ISSUES AND CONCERNS 1. ZONING: An agriculture -related business is defined as, "A business whose sole function is the provision of services or retail sales of products, agricultural in nature." A person is allowed to sell agricultural products grown or raised on the property without a land use permit. Because the products being sold are related to the equestrian farm/ranch activities, but not made on the farm from products grown or raised on the property, a Special Use Permit is required in the A/R/RD zone district. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. IV. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. RECOMMENDATION APPROVAL, with the following conditions: 1. All representation of the applicant, either within the application or stated before the Board of County Commissioners, shall be considered conditions of approval unless stated otherwise by the Board. 2. That the applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use Permit shall be issued when all conditions are met and shall expire 120 days after issuance unless use has commenced.
