S3k: � Co✓�-nJ� tii7 5 PC 3/10/99 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: A special use permit to allow an accessory dwelling unit in the A/R/RD zone. APPLICANT: Rick & Florence Broadhurst LOCATION: A tract of land located in portions of Section 22 T7S, R88W of the 6th P.M.; 1418 CR 107, Carbondale Colorado, 2 1/2 milesof Carbondale. 1/4S SITE DATA: 10.07 Acres WATER: Well SEWER: ISDS ACCESS: CR 107 EXISTING/ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in the Low Density Residential District (ten and greater ac/du) as designated by the 1994 Garfield County Comprehensive Plan's Proposed Land Use Districts, Area Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located south and east of Carbondale. (See location map pg. 3 LI ) B. Project Description: The proposal would allow for the designation of an accessory dwelling for the existing home. The applicant would then build a primary residence not to exceed 5,000 s.f.. (See Pg. 5-`i ) III. MAJOR ISSUES AND CONCERNS A. Zoning: The proposal is a special use as indicated in Section 3.02.03, Uses, Special of the Zoning Resolution of 1978, as amended. B. Legal Access: Legal access will be provided by County Road 107. (See Pg. /0 ) C. Water: Water will be provided via an existing well. The documentation provided does not indicate that augmentation exists for this well. Staff feels that proof of augmentation needs to be provided prior to approval. (See Pg.//r4 6' :'r APP lA 1. w5 D. Sewer: The existing ISDS has the capacity to handle an additional unit. IV. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. That for the above stated and other reasons, the proposed special use permit to allow for an accessory dwelling unit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION Staff recommends APPROVAL, finding that the proposed use is in compliance with all plans, policies, resolutions and regulations as adopted and amended by Garfield County, and that the approval be granted with the following conditions: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. That the applicant provide an augmentation plan for the existing well. 3. The applicant shall obtain all necessary permits and all development shall comply with the application and site plan as submitted.
