Dear John, Walt and Larry:
I am in opposition to the proposed accessory dwelling unit for the Botkin. Property, 2943
Morrisania Road. Please stay consistent with decisions that have been made recently voting
down the Walt Smith/Nagle and Wayne Rothgerry requests to divide a small acreage into two,
three and five acre plots. There was much opposition from the Morrisania Community pertaining
to the Smith/Nagel and Rothgerry requests. Please find an attachment with signatures. Both of
these requests were on Morrisania properties.
There are currently 6 homes (plus outbuildings) including Botkin's, within a ten acre radius. The
six homes are: Hayward rental house; Ron & Bonnie Palmer; Don and Linda Moore; Don and
Donna Moore; Mr. & Mrs. Birchfield (located adjacent to Morrisania property) and the
Botkin's.

On December 12, 2000, Colorado River Engineering, Inc. performed a pump test on the
Botkin well to assess its ability to serve two residential units for in-house uses. The results of the
pump test indicate that this well has sufficient capacity to service the two dwelling units. We have
prepared a brief summary of the existing well, water demands, and well pump test data.
Stoneman Drilling constructed the well in June of 1986. The well was drilled to a depth of
125 feet. A % horsepower Gould 230 volt pimp was installed. Attached is the well construction
report. Geologic data was not provided on the completion report. Our observations indicate that
Morrisania Mesa is comprised of colluvium and alluvial deposits overlying Wasatch bedrock. This
formation yields groundwater supplies sufficient to meet domestic water demands.
The well has historically provided the "in-house" domestic supply for one residence with no
reported shortages. The well is proposed to service two residences for in-house uses. We have
estimated that each residence will have an average demand of 350 gallons per day. The well will be
required to yield a minimum of 0.48 gallons per minute (gpm) to provide adequate service for both
residences.
The initial static water level was measured to be 90'-6". The well has an available
drawdown depth of about 34.5 -feet (125' — 90.5'). The well was pump tested at a rate of 10 gallons
per minute using the existing pump. After 24 minutes of pumping the water level in the well
stabilized at 5.5 -feet of drawdown. The water level in the well returned to the original static water
level after pumping was terminated. The attached Table 1 summarizes the drawdown data.
The well yield is greater than 10 gpm and is sufficient to supply the two residences. The
second home to be served is not part of subdivision split and we believe will not require a well
sharing agreement. Water samples from the well were collected and are being tested by an
independent laboratory for bacteria, nitrate & nitrites, and total dissolved solids. We will forward
the test results, as they become available.

After two hours of pumping the water level in the well stabilized at 4.83 -feet of drawdown below
the initial static water level. The water level in the well returned to the original static water level
after pumping had ceased. The results of the pump test indicate that this well has sufficient capacity
to service the two dwelling units.

Please be advised that the homeowners and/or Landowners of Morrisania Mesa recently
became aware that certain property owners were intending to subdivide the properties that
they presently own into smaller tracts of two to three acres.
The attached letter addressed to you is intended to describe the opinions of the remainder
of the landowners. We want you to be aware that the vast majority of the landowners do
not want existing properties further subdivided. We are asking you to review this letter
very seriously. We are strongly requesting the Garfield County Planning and Zoning
Commission to refuse to grant the requested subdivisions. Please note the signatures of
residents and landowners on the attached signature pages. These signatures represent
over 80 percent of the deeded properties on the Monisania Mesa subdivision.

Dear Kit:
Enclosed is a copy of the Referee's Ruling on the Botkin's water rights filing to allow
for a water well for the accessory dwelling unit requested by the Botkins. The State Water
Engineer approved the Ruling before submission to the Referee and there were no contests
filed, so I expect the Ruling to be approved by the Water Court the end of February.
We would like to get this matter placed on the Commissioner's Agenda as soon as
possible. Please advise if any additional information is required.

Dear Mr. Barbee;
We are extremely concerned about the Rothgery and Nagle -Smith subdivision applications before
you. We are opposed to the three part subdivision of Tracts 22 and 23 on the Morrisania Ranch.
The Monisania Ranch comprises over 800 acres of good quality rural residential and agricultural
land, irrigated with 880 shares of water from Battlement Creek. The Morrisania Ranch was
platted in 1910 (Document No. 39511 Office of the Clerk and Recorder). Seventy-six "Tracts"
were platted to facilitate a community of small farms and orchards. Many of Morrisania's families
continue to maintain and sell produce from orchards, berry patches and vegetable gardens
established 50 to 80 years ago. Until recently, Tract 23 was an apricot orchard and Tract 22 is
mainly an alfalfa and fruit orchard with one dwelling. Elsewhere on our Mesa fields produce hay
and pasture for livestock. Several beehives thrive on alfalfa and fruit trees; producing honey for
sale. Monisania Mesa's open spaces and the large gullies that rim the Mesa provide good wildlife
habitat. Undoubtedly Morrisania Mesa is a great place to call "home." Over the years the
population of the Mesa has increased to 54 households, mostly within the framework of the
original Morrisania Ranch plat. This original division established the character and community of
Morrisania which continues to today. It is precisely this character and community that are
important to us.
The 1984 Garfield County Comprehensive Plan recognized Monisania Ranch as a subdivision.
Almost 30 percent of the original tracts are not yet residentially developed, If Rothgery and
Nagle -Smith are allowed to subdivide Tracts 22 and 23, it will set a precedent that could lead to a
300 percent increase in the number of dwelling units on Monisania Mesa. Assuming every tract
would have the right to divide into two to three acre tracts, we are certain that the small farm
character and quality of life supported by the original subdivision simply could not be upheld at
the proposed level. The 1994 Comprehensive Plan directed the Garfield County Planning
Commission to encourage build -out of existing subdivisions prior to approving any new divisions.
We are seriously concerned that development at this level would impact irrigation delivery
systems. The United States Department of Agriculture classifies Morrisania Mesa as irrigated

farmlands with inadequate water. The Morrisania Water Supply Company struggles to meet
present irrigation water demands. Further division of the tracts will stifle Morrisania Mesa's
agricultural productivity.
We are concerned that the residential development at two or three acre densities will create
drinking water quality and septic problems. The description in the Rifle Area Soil Survey of the
soil type found in Tracts 22 and 23 states, "...community development and recreation are limited
by low strength, shrink/swell potential and siope...community sewage systems will be needed if
the population density increases." At what point and on which tract subdivision application will
the Garfield County Planning Department decide that Morrisania Ranch needs a full-blown
community sewage system? At what point will the number of water wells affect our general
supply? At what density will one resident's septic affect another resident's drinking water? All of
the tracts are not yet residentially developed. Still the original plat divisions have served the
community well for over 90 years. While we have continued to maintain excellent water quality
and quantity, we also believe further division of the original tracts will threaten the same.
The road network that serves the original Morrisania Ranch plat is not perfect; it is barely
sufficient. However, increased residential development increases traffic, which raises our concerns
for road maintenance and community safety. Arguably the proposed three-part division of Tracts
22 and 23 will increase traffic negligibly, but the precedent it creates could allow for development
densities that would create serious traffic and safety issues. At what point on which tract
subdivision will the Garfield County Planning Department decide the density is too much?
Increased growth is inevitable. Planning growth is our opportunity and our responsibility; which
was most recently determined with the Smart Growth Incentive. The original Monisania Mesa
plat is a plan for growth. Further division of the original tracts should only be considered after
build -out of the original Morrisania Ranch subdivision tracts. The applications before you are
unwarranted and unfounded especially as it relates to the goals and policies of the Garfield County
Comprehensive Plan 1994. Further division of the tracts of the Mottisania Ranch could
negatively affect the health and safety of Morrisania Mesa residents. It would decrease the
agricultural and open space value of the land. These are values that the original Morrisania plat
embodied and issues of great concern for the present community.
We therefore urge the Garfield County Planning Department to reject the proposed three part
subdivisions of Tracts 22 and 23 of the Morrisania Ranch plat. We request the Planning
Department honor the present division of the land that serves this community well. The health of
the land and water are important to this community's well being and quality of life. Do not allow
the three part, or maybe greater, subdivision of the tracts of Morrisania Mesa. Do not set a
precedent that could negatively influence our health, safety, lifestyle and general welfare.
