The monopole will be within an 80' x 80' lease parcel that is secured by a 6'(foot) high fence. Each provider's antennas will be attached to the monopole and their respective base station equipment will be contained within the lease parcel. Legal description: A portion of Section 25, Township 7 South, Range 88 West of the Sixth Principal Meridian, County of Garfield, State of Colorado. Location The site is located approximately 2.5 miles east of Carbondale on the north side of Highway 82 behind the Western Slope Aggregates gravel mining operation. Prentice Ave., Suite 100 Denver, CO 80111 Phone 303.756.2900 x 104 Fax 303.756.4245 Contact: Lance Evans Tower and Site Description Proposal: a 70' monopole painted to match the surrounding hillside on an 80' by 80' fenced lease area. Site description: The site is slightly sloping clearing at the base of a hill. It is just above the existing access road surrounded by 15' juniper trees. To the south is a 25' dirt mound, part of the Gravel mining operation. The ground then continues at a slope to the edge of a bench, overlooking Highway 82, see Exhibit 2. The north side of the site slopes steeply to the top of the hill. The east and west elevation follows the contour of the hill curving back to the north. The existing gravel mine to screen the site from view to the surrounding property owners Site justification: The site is needed to provide wireless telephone coverage along Highway 82. Currently, there are only weak signals for two providers and others are looking to expand their service in this area. By constructing one colocatable site strategically placed Garfield County will prevent the proliferation of towers and minimize the visual and aesthetic impacts of telecommunication towers while still providing a needed service. Visual Considerations: It is also located at the base of a 360 -foot hill that will provide a backdrop for the site and help the facility to blend. This, along with the junipers and gravel mine will prevent any significant visual impacts. Coverage objectives: The telecommunication facility is designed to provide coverage along a heavily traveled section of Highway 82 in Garfield County. Application Requirements 11 Plans for the site are attached. Due to the nature of the facility, it will be operating at all times; however, these functions are automatic and require no human support other than maintenance. Maintenance staff will visit the site approximately once a month per provider. Only existing access and roads will be used to access the site; the creation of a new access road is not necessary given the existing condition of the property selected. It will not be necessary to disturb or alter any of the existing ranch structures for this proposal. The proposed lease parcel will be used for the placement of either outdoor base station equipment cabinets or small shelters (10' x 28') that will be used at the facility for protection of the telecommunication equipment. The determination between outdoor cabinets and small shelters is a function of the specific provider; the proposed telecommunications facility is intended to support both. 2] No water or wastewater systems will be used for this facility. 3] A survey of the property and site are included in the attached drawings depicting the relevant structures and roadways and easements for utilities, access on the property. 4] A vicinity map for the site is attached. The site has been surveyed and the grading plan shows the proposed slope of the site. Due to the fact that the site is relatively flat and sparsely populated with scrub vegetation only minimal grading will be required to essentially clear the lease parcel area for construction. Before and during construction standard erosion control methods will be utilized to minimize any further disturbance. 5] Assessor's map and list of surrounding property owners is enclosed. 6] Deed is attached for the property as well as the Memorandum of Option and Land Lease file with the county. See Exhibit 1. 7] The proposed facility meets the Garfield County Conditional and Special Use Requirements (Section 5.03) as follows. A. No water or sanitation services are required for the proposed facility. B. Street and traffic impacts will be minimal and require no additional improvements for the maximum of 4 vehicle trips per month C. The design of the proposed use is organized to minimize any potential impact to the community by: 1. Placing the site as far away from residential uses as possible. 2. Placing the facility at the base of a hill with the intent of using the hill as a backdrop to minimize any potential visual impacts associated with the monopole. This also prevents any silhouetting of the pole. 3. The associated equip will be screened from the views of adjacent properties due to the lease parcel located directly behind the gravel mine. Making the site almost invisible from the adjacent properties; thus not requiring additional landscaping or screen fences. 4. The property to the east is the former landfill and creates a Yz mile buffer for properties further to the east. Review Criteria Relationship to the Comprehensive Plan: This proposal balances the visual and economic goals of the Comprehensive Plan to allow for a compromise that benefits every aspect of the community. By providing a colocatable facility along this section of Highway 82 it reduces the overall visual impact of the proposed services, while still providing services people desire. The county will receive both a visually unobtrusive structure and increased wireless services with this one facility. The existing land uses (gravel mine, former landfill, sloped hill) will create an excellent buffer to the site. The location was also chosen to reduce the visual impact. This location conceals the required electronic equipment from public view and the higher elevation of the terrain and vegetation will make a green facility very difficult to see. Specifically, the site is located at the back of a bench above Highway 82. This bench blocks any direct view of the site from Highway 82 and the residential neighborhood to the south. See Exhibit 2. The site itself is in an open area, but the surrounding vegetation on the hillside and east and west of the site will also help to screen. II. Compliance with the Garfield County Zoning Resolution All of the zoning regulations will be met. A. A communication facility is listed as a special review use. B. Lot area minimum is 2 acres; the parent property for the proposed telecommunications facility is 1320 acres. C. Maximum lot coverage is 15%, as a result of the proposed facility the lot coverage increase will be less than one-hundredth of one percent. D. Minimum Setback: Front 75', Side 35' (% height of the proposed facility), and 25' from rear property line. The site will be 1634' from Highway 82 (front), and 621' from the closest side property line, and approximately 3000' from the rear property line. E. Maximum height of buildings 25'. As per Section 5.06.02 Communication Towers: "Communication towers may exceed the building height limitations provided they are approved by Special or Conditional Use Permit. (A. 84078; 85 D46)". All associated base station equipment (cabinet type or shelter type) will meet the height requirements. The monopole that supports the antennas is required to exceed this height in order to function. At 25' feet the facility would have minimal visibility to the remainder of the valley. In addition, the site will not be colocatable and more towers would be required. III Use Appropriate and Compatible: The facility is appropriate for county citizens and many others who travel along the Highway 82 corridor who want and use wireless services. The site is at a location that will allow for it to provide good coverage while still hiding the majority of the structure and support equipment among the trees. III. Summary: SBA is devoted to complying with the visual and aesthetic concerns of Garfield County, while providing a needed service. The height that is required to provide good service for multiple carriers and is the basis for this proposal. This is a great location for a communication use, the bench and adjacent hill provide us with the necessary elevation to transmit signals, while allowing SBA to hide the facility from direct view and blend it with the surroundings for a very minor visual impact. The proposal has mitigated any potential negatives and still provides a service that is wanted and needed by county residents. In the event Lessee exercises the Option, Lessee shall lease the Site from Lessor, together with all easements for ingress, egress and utilities as more particularly described in the Option and Land Lease, all upon the terms and conditions more particularly set forth in the Option and Land Lease for a term of five (5) years, which term is subject to four (4) additional five (5) year extension periods. 3. The sole purpose of this instrument is to give notice of said Option and Land Lease and all its terms, covenants and conditions to the same extent as if the same were fully set forth herein. The Option and Land Lease contains certain other rights and obligations in favor of Lessor and Lessee which are more fully set forth therein. 4. Right of First Refusal. If at any time during the term of this Agreement Lessor receives an irrevocable (except such offer may be conditional upon the non -exercise of this right of first refusal) bona fide written offer from a third person ("Offer") to sell, assign, convey or otherwise transfer its interest in the Leased Space, which Lessor desires to accept, Lessor shall first give Lessee written notice (including a copy of the proposed contract) of such Offer prior to becoming unconditionally obligated. SBA's site acquisition personnel first looked at the existing coverage from the perspective of what carriers have coverage and what carriers are likely to require a future site to meet their coverage objectives in the future. Generally we looked at the surrounding sites and the various carriers who provide coverage and try to determine where coverage gaps exist. One way we determined the coverage of the carriers along this corridor was to drive Highway 82 with test phones from all the cell phone providers. We found coverage to be lacking for Verizon Wireless, Sprint PCS and Voicestream Wireless. Another criteria we looked at is the traffic volume of the corridor. This portion of Highway 82 carries an average of approximately 15,000 vehicle trips per day based on studies provided by the Colorado State Highway Department. This volume of traffic has been increasing over the past few years, which is likely to require an expansion of coverage of other carriers to meet demand. With regard to your inquiry about possible tenants for our proposed tower, SBA has spoken with Sprint PCS, Verizon Wireless, Nextel Communications and Qwest Wireless about locating on our proposed facility. At this time we have not received a firm commitment from any of the carriers regarding their short-term interest in the site. Given that these carriers are looking toward 2002 for their budgetary requirements, at this late in the year we do not foresee a tenant for this site until early in 2002. SBA would suggest that the Board of Commissioners approve our site on the condition that we would not construct the site until a Letter of Intent from a carrier is provided to the county. The following approved conditions will need to be met prior to the issuance of the Special Use Permit: 1. All representations of the applicant made in the application and during the public hearing shall be considered conditions of approval, unless approved otherwise by the Board of County Commissioners. 2. The applicant shall have one year from the date of approval to construct the communications facilities. If the communication equipment becomes obsolete or inoperable for any period of twelve months, the applicant shall remove the tower and accessory building from the property. 3. The applicant shall provide a copy of the FCC license for the company providing telecommunication service from the site, prior to the issuance of the Special Use Permit. 4. An exception is granted from the height restrictions sited in Section 5.03.13 (3)(a -c) of the Garfield County Zoning Regulations. 5. The applicant will allow for co -location of other communications facilities on the site, if physically and technically feasible. 6. The fence surrounding the tower shall be increased to eight feet (8') per Division of Wildlife recommendations. 7. PROPOSAL FOR A WIRELESS TELECOMMUNICTION FACILITY DEAR NEIGHBOR, SBA would like to follow up and correct an error in the letter recently sent out with the public notice of the December 3, 2001 County Commissioners hearing for a 70' wireless communication facility in Garfield County. Our letter states in the fourth paragraph, page 1, that the proposal includes "two antenna towers" this statement is incorrect. The proposal is for only one 70' monopole. I am sorry for this error and hope it has not caused any undue concern. For further clarification of the proposal I have included a copy of the tower elevations (Exhibit A), lease parcel sketch (Exhibit B), and a profile of the terrain from Highway 82 north to the top of the adjacent hill (Exhibit C). The tower elevation (Exhibit A) depicts a four -carrier monopole. This is to allow future carriers in the area a location for their antennas. The monopole will be painted green to blend with the surrounding juniper trees on the hillside. The lease parcel sketch (Exhibit B) is the location for the monopole and the support equipment required for transmitting and receiving the wireless phone signals. Carriers store equipment in various kinds of small shelters as small as 3'x5'x 5' up to equipment sheds 10'x 20'x10'. One of the many benefits to this site is that the topography blocks the equipment shelters from view of any of the area homes. The profile (Exhibit C) is a cross-section of the slope of the land from Highway 82 north to the top of the adjacent hill. You can see how the placement of the site at the back of the bluff will screen it from view from Highway 82 and also allow the tower to blend into the background of the hill behind it.
