HomeMy WebLinkAbout5.0 Resolution 80-080STATE OF COLORADO )SS county of Garfield ) At a commissioners Meeting Room the 26th regular meeting of the Board of county for Garfield county, Colorado, held at the Commissioners' at the Garfield county courthouse in Glenwood Springs on day of September A.D. 19_.§..L, there were present: Robert Richardson , Commissioner Chairman _M_a_r_i-na~I-.~S-m_i_t_h~~~~~~~~~~, Commissioner Larry Schmueser , Commissioner ~D~on~D~e~F~o~r~d~~~~~~~~~~~~-, County Attorney Mildred Alsdorf , Clerk of the Board ~Ch~u~c~k'-"-'DLe~s~c~h~e~nLes~~~~~~~~~~-, county Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO· 88-080 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY BONNEVILLE FUELS CORPORATION WHEREAS, the Board of county commissioners of Garfield county, Colorado, has received application from Bonneville Fuels Corporation for a natural gas well on the following described tracts of land: Well 24-14-W A parcel located in the SW 1/4, Section 24, T6S, R94W; (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 12th day of September, 1988, upon the question of whether the above-described Special use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special use permit; and WHEREAS, produced at determination the Board on the basis of substantial competent the aforementioned hearing, has made the of fact: evidence following l. 2. That proper publication and public notice was provided as required by law for the hearing before the Board of county Commissioners. That the hearing before the Board of county Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. FOr the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board Of county commissioners of Garfield county, Colorado that the Special use permit be and hereby is authorized permitting the use of the above described tract of land for a natural gas well upon the following specific conditions: 1. All verbal and written proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County commis~ioners. 2. The applicant and driller shall notify the county and the Assessor's office to ensure proper assessment of equipment and vehicles based in prior to final approval. Clerk's office licensing and the operation, 3. The applicant and driller shall notify the County Road and Bridge Department, prior to moving a drilling rig across county roads. In addition, the applicant shall provide qn-going maintenance to County Roads 320 and 321, under supervision of the Road and Bridge supervisor, including, but not limited to, returning the county roads to not less than its• condition prior to the commencement of drilling activities. The County roads shall be returned to said condition at such time as the wells are drilled, completed, or equipped for production. Dust control measures will be utilized as needed. 4. The applicant's $100,000 road bond shall be adequate to insure compliance with Condition #3 and shall be maintained in place until such time as the well has been drilled, completed, or equipped for production. 5. The applicant shall comply with all applicable state and Federal Agency requirements and obtain all appropriate permits. 6. The applicant shall obtain Road Garfield County Road and Bridge points off county roads. cut permits, Department, as for required by the all new access 7. The applicant shall have 120 days from the date of the Resolution of conditional Approval to meet all conditions set forth in the Resolution. The Special use permit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use has commenced. Dated this 26th day of September , A.D.1~.
