Gentlemen:
In a recent telephone conversation you advised that the
captioned Letter of Credit could not be released until the frost
melts and the Road and Bridge Department could inspect County
Road 320 leading to Bonneville's well sites. In light of the
fact that Bonneville plans to drill several additional wells in
Garfield County later in 1989, Bonneville hereby retracts its
request for the release of the subject Letter of Credit. In the
near future, Bonneville shall request that the subject $100,000
Letter of credit be amended to secure its 1989 drilling program.
Please be advised that all wells drilled by Bonneville in
1988 were drilled, completed, equipped for production, and
awaiting hookup with all vehicles removed by December 1, 1988, in
full compliance with Garfield County's specifications and
requirements. Bonneville will not be responsible for any damage
to County Road 320 not caused by Bonneville and occuring after
December 1, 1988. If you have any questions or would like to
discuss this matter, please feel free to contact the
undersigned.

that the Board of Commissioners of Garfield county release the
captioned Irrevocable Letter of Credit which is in the amount of
$100, 000. Please be advised that Bonneville has completed its
1988 drilling program in compliance with all County requirements
and has no present drilling activities in Garfield County secured
by the subject Letter of Credit.
Upon release of the Letter of Credit, please forward the
original signed copy of same to the attention of the undersigned
at the letterhead address. If you have any questions or require
any further information, please contact me at 863-1555. Your
continued cooperation in this matter is sincerely appreciated.

RE: Your letter: September 27, 1988
Dear Mr. Wert:
September 30, 1988
First, allow me to set the tone of this letter. I DO NOT
appreciate the lame tactics you employed in trying to excuse
your contractor's and subcontractor's neglect by use of out
of context inference regarding one of my employee's comments.
D.O.T. specifically outlines the parameters under which
corporations must secure special permits for operating their
vehicles on State and County roadways. Participation on the
part of my employee does not alleviate YOUR corporation's
responsibility of following the letter of the LAW!
In an effort to assist those haulers who had not secured
permits, but had already hauled in equipment, Dennis had
begun to issue several sets of bulk permits via the mails.
Further, he has allowed these haulers to secure permits for
future return trips, provided they can supply him with
accurate written documentation. This type of permit can also
be generated through the mail. This saves your haulers both
TIME and MONEY by not having to come to Glenwood to obtain
these permits. At the same time giving them the opportunity,
albeit, ex post facto, of satisfying D.0.T. regulations by
obtaining permits for equipment already in place at various
drill sites.
The sudden influx of drilling, and subsequent attempts of
several haulers to obtain permits due to increased drilling
activity in this County, has greatly increased Dennis's work
load.

In a conversation with one of the drivers for Sanders Oil
Field Construction Company, Dennis had scribbled a hand
written note to the driver in an attempt to clarify the
permit process. His comments in that note were made in
context to a discussion between that driver and Dennis, and
pertained solely to the s'cope of that one particular
conversation.
By offering to accommodate these haulers in this fashion,
Dennis is providing a service that is above and beyond the
requirements that I set forth when I outlined the job's
parameters to him.
We have been writing permits in this County for quite a few
years. The statutes governing this aspect of your
contractor's business have been in existence for several
years. If your lack of professional conduct precludes their
being cognizant of them, this certainly is not Dennis's
fault.
If, in the future, you cannot find the spirit of cooperation
that my employee's have extended to you, then I will not
allow Dennis, or anyone else under my supervision, from
issuing any permit of any kind, without the contractor or
their driver physically being present in this office.
Further, any infraction of these statutes by any company
operating within the boundaries of this County will result in
the issuance of a citations, and impoundment of vehicles on
the spot.
