APPLICATION SUBMITTAL REQUIREMENTS
As a minimum, specifically respond to all the following items below and attach any additional information to
be submitted with this application:
1. Please submit, in narrative form, the nature and character of the Special Use requested.
Submit plans and supporting information (i.e. letters from responsible agencies). Include
specifications for the proposed use including, but not limited to, the hours of operation, the
number and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and
the size and location of any existing and/or proposed structures that will be used in conjunction
with the proposed use, and provisions for electric power service and any other proposed utility
improvements. Be specific.
2. If you will be using water or will be treating wastewater in conjunction with the proposed use,
please detail the amount of water that would be used and the type of wastewater treatment. If
you will be utilizing well water, please attach a copy of the appropriate well permit and any
other legal water supply information, including a water allotment contract or an approved water
augmentation plan to demonstrate that you have legal and adequate water for the proposed
use.
3. Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all
existing and proposed structures on the property, and the County or State roadways within one
(1) mile of your property. If you are proposing a new or expanded access onto a County or
State roadway, submit a driveway or highway access permit.
4. Submit a vicinity map showing slope / topography of your property, for which a U.S.G.S.
1:24,000 scale quadrangle map will suffice.
5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing all
mineral rights owners of the subject property and public and private landowners adjacent to
your property (which should be delineated). In additional, submit a list of all property owners
and their addresses adjacent to or within 200 ft. of the site. This information can be obtained
from the Assessor's Office.
6. Submit a copy of the deed and a legal description of the subject property.
7. If you are acting as an agent for the property owner, you must attach an acknowledgement
from the property owner that you may act in his/her behalf.
8. Submit an statement that specifically responds to each of the following criteria from Section
5.03 of the Zoning Regulations:
(1) Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Board of County Commissioners shall either
be in place or shall be constructed in conjunction with the proposed use.
(2) Street improvements adequate to accommodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either be in place or
shall be constructed in conjunction with the proposed use;
(3) Design of the proposed use is organized to minimize impact on and from adjacent
uses of land through installation of screen fences or landscape materials on the periphery
of the lot and by location of intensively utilized areas, access points, lighting and signs in
such a manner as to protect established neighborhood character;
9. Depending on the type of Special Use Permit requested, you may need to respond to
additional review standards in the Garfield County Zoning Resolution Section 5.00
[Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 &
5.03.08], Accessory Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific
sections of the Zoning Resolution which can be located on the Garfield County web site at
http://www.garfield-countv.com/building and planninq/index.htm or information can be
obtained from this office
10. A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment" form and provide the
fee with the application.
11. Submit 2 copies of this completed application form and all the required submittal materials to
the Building and Planning Department. Staff will request additional copies once the Special
Use Permit application has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(The following steps outline how the Special Use Permit Application review process works in
Garfield County.)
1. Submit this completed application form, base fee, and all supplemental information to the
Garfield County Planning Department. It will be received and given to a Staff Planner who
will review the application for technical completeness.
2. Once the application is deemed technically complete, the Staff Planner will send you a
letter indicating the application is complete. In addition, Staff will also send you a "Public
Notice Form(s)" indicating the time and date of your hearing before the Board of County
Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum
regarding your requested Special Use. (If Staff determines you application to be deficient,
a letter will be sent to you indicating that additional information is needed to deem your
application complete.)
3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested Special Use and the public hearing. If proper notice has not occurred, the
public hearing will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed special use and nature of the hearing, and the
date, time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.
b. Notice by mail, containing information as described under paragraph (1) above,
shall be mailed to all owners of record as shown in the County Assessor's Office of
lots within two hundred feet (200') of the subject lot and to all owners of mineral
interest in the subject property at least thirty (30) but not more than sixty (60) days
prior to such hearing time by certified return receipt mail, and receipts shall be
presented at the hearing by the applicant.
c. The site shall be posted such that the notice is clearly and conspicuously visible
from a public right-of-way, with notice signs provided by the Planning Department.
The posting must take place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applicant to post the
notice, and ensure that it remains posted until and during the date of the hearing.
4. The Applicant is required to appear before the Board of County Commissioners at the time
and date of the public hearing at which time the Board will consider the request. In addition,
the Applicant shall provide proof, at the hearing, that proper notice was provided.
5. Once the Board makes a decision regarding the Special Use request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board. Following
the Board's approval, this office will issue the Special Use Permit to the applicant. If the
Board's approval includes specific conditions of approval to be met, this office will not issue
the Official Special Use Permit certificate until the applicant has satisfied all conditions of
approval. The Special Use Permit approval is not finalized until this office has issued the
Official Special Use Permit certificate signed by the Chairman of the Board of County
Commissioners.

RE: Special Use permit application for 1240 AM radio antenna
Dear Mark:
On behalf of Jim TerLouw of MBC Grand Broadcasting Inc., and Dee Blue, the property owner,
we are resubmitting a Special Use Permit application for a communications antenna on the Dee
Blue property.
At the conclusion of a public hearing held on February 22, 2005, the Garfield County Board of
County Commissioners requested a continuance of the public meeting for March 21, 2003. In the
interim, County Commissioner Tresi Houpt, asked us to search for a suitable alternate location to
place the antenna.
In scouting for such a site we considered three parameters. The parameters were: (1) within two -
miles of Carbondale, (2) a relatively level and open parcel of land with a minimum surface area of
2.9 Acres so radials can be buried in a two hundred foot radius from the antennas base (3) minimal
visual impact on adjacent property owners. We deemed eleven properties to fit these parameters.
A letter proposing a forty -year lease (see appendix) for such use was delivered via Certified Mail
to the eleven property owners. Of the eleven contacted, none were amenable to such negotiations.
An alternative location on Dee Blues property was also considered. Areas along the edge of the
hayfields in proximity of the gravel pit were looked at. However, due to a recently installed roller
sprinkler systems we were unable to fmd a functional location where the antenna wouldn't impede
the irrigation system.
On March 15, 2003 we withdrew our application because we needed more time to follow through
with the commissioners request. Having completed a thorough search of the Carbondale vicinity it
is our opinion the initial location is the most suitable and hereby resubmit our original application.
Enclosed is the original application modified to include information pertaining to our search for an
alternative location as well as photographs representing a visual impact analysis of the original
proposed location.

Narrative
Proposal for MBC Grand Broadcasting, Inc. to erect a seventy five-foot
broadcasting antenna.
MBC Grand Broadcasting Inc. requests a special use permit for the erection of a
seventy eight -foot broadcasting antenna on a 31.37 acre parcel of land owned by
Dee Blue, described as a tract in Lots 5 & 11, Section 25, Township 7 South,
Range 88 West of the 6'h P.M.
The purpose of the proposed antenna is the broadcast of a 1240 AM frequency to
the Town of Carbondale and out lying areas from an undetermined location
within the immediate area.
A 2.7' tall valcosphere, a 72.3' foot fiberglass antenna and a 3' base to which the
antenna mounts will comprise the total height of seventy eight -feet. The antenna is
freestanding with no guy wires and will painted a color, which minimizes a visual
impact. The proposed operation will use a buried radial ground system with 120
copper radials 200' in length around the base of the antenna. The radials are
#10 gauge in diameter and will be buried 2-4' underground. Antenna
specifications are included in the appendix.
The antenna height is less than the two hundred -foot height restriction of the
Federal Aviation Administration therefore will not be lighted or marked (see
attached FAA letter, Determination of No Hazard to Air Navigation).
A wood or plastic fence six-foot in height will surround the antenna a minimum of
10 feet from the base protecting it from wildlife, livestock and human intrusion.
Plastic or wood is recommended over a steel wire fence to avoid antenna system
de -tuning effects. Additionally, wooden or plastic fences avoid the possibility of RF
energy induction into the fence itself, which may create an electrical hazard.
An underground electric line serviced by Holy Cross Energy will provide electricity
to the facility.
The site will be used only as an unmanned communications facility, visited
approximately once a month by passenger vehicle.

The site does not require water or generate wastewater and there are not plans to
provide water or sanitary sewer services to the site.

proposed location for the antenna, the existing structures, and all roads within
one -mile of the site.

submittal.

Gamba & Associates, Inc. (G&A) is submitting this special use application package
on behalf of the tower owners, MBC Grand Broadcasting, Inc., and the real
property owners, Dee Blue. A letter acknowledging this is attached to this
submittal.
7. Zoning Response
(1) The only utility required for the operation of the antenna is electric power.
Holy Cross Energy has agreed to provide electric power to the project upon
completion of appropriate contractual agreements. A "will serve" letter is
attached to this submittal.
(2) Street improvements will not be required as the site will be infrequently
visited and the resultant vehicle trips will have a negligible impact on
existing roadways.
(3) The antenna is inherently small of profile. The Federal Aviation
Administration does not require the antenna to be lighted eliminating visual
impact in low light periods.
8. Additional Review Standards
A review of county zoning regulations indicates that Section 5.03.13 Broadcasting
Studio and/or Communication Facility: is an applicable additional review
standard.
1. The facility shall comply with the radio frequency emission
requirements of the Federal Communications Commission as
demonstrated by Facility Id No.: 160494 and Antenna registration
number 20040129axx.
2. The physics of AM frequency radio waves makes Co -location
unfeasible.
3. The facility includes a freestanding antenna.
(a) To make the antenna less visible it will be painted to blend with the
surrounding landscape.

(b) The antenna tapers from 17.5" at the base to 3.75" at the tip and is
capped with a 2.7' high by 3.75' wide valcoshere (see attached
tower information).
(c) There are no existing communication facilities on the site.
9. Base Fee
A check in the amount of $400.00 is included with this application submittal. A
signed "Agreement for Payment" is attached to this submittal.
10. Submittal
Two copies of this submittal, including the completed application, are to be
submitted to the Building and Planning Department.

Gamba and Associates is acting on behalf of Dee Blue, 0404 County Road 104,
Carbondale, CO, 81623 and MBC Grand Broadcasting, Inc., 1360 E. Sherwood Drive,
Grand Junction, CO 81501, for the purpose of applying for a Special Use Permit. We ask
that Gamba and Associates represent both parties at public hearings.
MBC Grand proposes to build a 78 -foot tower on the Blue Property, near 0404 County
Road 104, Carbondale, CO for the purpose of broadcasting signals for a new AM radio
station on 1240 kHz to serve Carbondale. MBC Grand agrees to pay all charges for work
done by Gamba, and for all fees assessed by the County for this tower project.

Holy Cross Energy has existing power facilities located on or near the above mentioned project.
These existing facilities have adequate capacity to provide electric power to the development,
subject to the tariffs, rules and regulations on file. Any power line enlargements, relocations,
and new extensions necessary to deliver adequate power to and within the development will be
undertaken by Holy Cross Energy upon completion of appropriate contractual agreements and
subject to necessary governmental approvals.

basis, we recommend it be installed and maintained in accordance with FAA
Advisory Circular .70/7460-1 AC10/7460-1K.
This determination expires on 5/24/2006 unless:

the Federal Communications Commission (FCC) and an

This determination is based, in part, on the foregoing description which includes
specific coordinates, heights, frequency(ies) and power. Any changes in

determination. Any future construction or alteration, including increase to
heights, power, or the addition of other transmitters, requires separate notice
to the FAA.
This determination does include temporary construction equipment such as cranes,
derricks, etc., which may be used during actual construction of the structure.
However, this equipment shall not exceed the overall heights as indicated above.
Equipment which has a height greater than the studied structure requires separate

In determining compliance with limits for Maximum Permissible Exposure (MPE) for
AM radio broadcast stations, it is normally most important to determine electric and magnetic
field strength at distances relatively close to transmitting antennas. Fields from these
monopole antennas decrease relatively rapidly with distance, and MPE limits for AM radio
frequencies are not as restrictive as those for other frequencies, such as those used for FM
radio. Therefore, even for the highest powered stations, MPE limits for AM radio
transmissions would normally only be exceeded relatively close to antennas. Compliance
with the FCC's guidelines for AM stations typically will involve assessment of exposure
potential of persons working or occupying areas in the close -in vicinity of transmitting
antennas. Because such persons will always be in the near field of' AM antennas, due to the
relatively long wavelengths in the AM frequency band, an evaluation of both electric and
magnetic field strength is necessary.
In the original version of OET Bulletin 65, staff from the U.S. Environmental
Protection Agency (EPA) provided the FCC with results from a computer-based model to
help determine compliance with MPE limits for AM radio broadcast stations. The EPA
model used the Numeric Electromagnetic Code (NEC) computer program to predict field -
strength levels near AM monopole antennas. In the past several years a PC-based version of
this code, called MININEC,' has also become available. The FCC has used MIN1NEC to
expand and refine the predictions for electric and magnetic field -strength presented in the
original version of Bulletin 65. They are included in this supplement in the form of tables
and figures that can be used in evaluating compliance at these stations.
Tables 1-4 may be used to determine the minimum distance from an AM broadcast
antenna to the point where electric and magnetic field strengths are predicted to correspond to
MPE limit values. The tables provide compliance distances from antennas of various electrical
heights transmitting at various frequencies and using various power levels. The distances
specified are the distances from an antenna at which access should be restricted in order to
comply with both the electric and magnetic field -strength MPE limits. For antennas that do
not correspond to the specific conditions given in these tables, interpolation can be used to
arrive at intermediate values, or, alternatively, the greatest distance for the range used for
interpolation could be used.
Since the MPE limits for the two exposure tiers are similar for most AM frequencies,
and because of variability in compliance distances according to electrical height and operating
frequency, one entry is given in each case that applies for both occupational/controlled and
general population/uncontrolled exposures. These numbers represent the minimum worst-case
distances predicted for compliance with the strictest MPE limit for each case. Note that time -

averaging considerations are not taken into account in these computations. Continuous
exposure is assumed in all cases.
This model computes field strength values in the vicinity of single antennas. For AM
stations with multiple -tower arrays a conservative "worst case" prediction could be made by
assuming that all transmitted power is radiated from each antenna. Therefore, in such cases
the appropriatevalue from the tables could be used to define a zone of restriction around the
array, consisting of circles with equal radii, each of which'is centered around a tower in the
array. Alternatively, a more accurate prediction could be made if the power actually radiated
by each tower is known.
It may be necessary to predict electric and magnetic field -strength at various locations
in the vicinity of AM antennas. Therefore, Figures 1-4 have been developed for this purpose
using MININEC. These figures show conservative predictions of electric and magnetic field -
strength versus distance from typical AM broadcast antennas for towers with electrical heights
equal to 0.1, 0.25, 0.5, and 0.625 wavelengths, respectively.
Figures 1-4 predict field strength for nations transmitting with 1 kilowatt of power.
Therefore, for stations operating at other power levels values obtained from these figures
should be multiplied by the square root of the station's power. The following example
illustrates the proper procedure. In this example a 50 kilowatt AM station is located near.a
publicly accessible area. It is desired to obtain an estimate of the field -strength levels in this
area which is at a distance of 10 meters from the station's single rower that has an electrical
height of 0.25. To arrive at the estimated field strength values proceed as follows:
✓ Consult Figure 2 for an antenna with electrical height = 0.25
✓ At 10 meters read predicted electrical field -strength = about 8 Vim
./ At 10 meters read predicted magnetic field strength = about 0.06 A/m
✓ Multiply each value by 50
✓ Predicted values are 56.6 Vim and 0.42 Alm
As discussed in Section 4 of Bulletin 65, RF currents will be induced in the body of
persons who climb transmitting AM broadcast antennas for maintenance or other purposes.
This is a significant source of RF exposure and can be related to the limits for specific
absorption rate (SAR) adopted by the FCC) Although many stations may prefer to shutdown
power entirely while persons are climbing their antennas, in some cases this may be difficult
or undesirable. Studies have been undertaken by the FCC and the EPA to determine
SAR is discussed in Section 1 of Bulletin 65.

appropriate operating power levels which should allow climbing of transmitting AM antennas
without exceeding the SAR guidelines.' The results of these studies were used to develop
Figure 5, which shows operating power levels versus frequency for a variety of different
electrical heights that are predicted to allow tower climbing without exceeding the exposure
guidelines in terms of SAR. Recommended power levels are shown for tower climbing with
or without the use of gloves, A study by Tell performed for the FCC (Reference 28 in
Bulletin 65) indicated that certain gloves (particularly leather gloves) can significantly reduce
the induction of RF currents in tower climbers.
Figure 5 is designed to be used to provide guidance for use by AM radio stations
which find it necessary to continue transmitting while persons are climbing their towers. It
can be used to determine the levels to which operating power should be reduced before a
person climbs an active tower. However, there is variability in the data, and whenever there
is a question about which condition may apply in a given situation it is recommended that the
most conservative power level be used or, alternatively, that power be turned off completely
while the climber is on the tower.

RE: Potential AM Radio Antenna Location
To Whom It May Concern:
We have scouted the area and have determined that a parcel of land owned by you
is a likely candidate for the installation of an AM Radio Antenna. A suitable site
for such an antenna is relatively flat, free from sprinkler systems, covers about
four acres, and is within two miles of the town of Carbondale. Ideally the site
would be somewhat isolated so as to impact as few residents as possible. Your
parcel seems to us to meet these requirements.
On behalf of MBC Grand Broadcasting, Inc., Gamba & Associates, Inc. is
contacting you with the intent of obtaining a forty -year lease for the purpose of
installing an AM Radio antenna to serve listeners within a 20 -mile radius. The
fiberglass antennae is 78 feet in height, 10 inches in diameter at the base and
tapers to 3 inches in diameter at the top. It is freestanding with no guy wires or
lights and will be painted to blend in with the surrounding landscape making it as
unobtrusive to the view of the neighboring landowners as possible.
MBC Grand Broadcasting, Inc. will soon be licensed by the F.C.C. to broadcast in
the Carbondale vicinity and will apply for a Garfield County Special Use permit
once a suitable location has been established.
We have been authorized by our client to start negotiations for securing a lease.
