RESOLUTION NO. 2009-95
A RESOLUTION CONCERNED WITH THE APPROVAL OF A LAND USE CHANGE
PERMIT FOR MATERIALS HANDLING (PAD D), LOCATED ON MINEOTA DRIVE
EAST OF COUNTY ROAD 331 SOUTH OF SILT, AND WITHIN A PROPERTY
OWNED BY THE DIXON WATER FOUNDATION, INC., GARFIELD COUNTY
PARCEL NO# 2179-114-00-114
Recitals
A. The Board of County Commissioners of Garfield County, Colorado, received an
application for a Land Use Change Permit to allow for Material Handling for the transport,
storage, and disposal of produced water into an injection well (Pad D).
B. The 2.2 -acre site is located on Mineola Drive east of County Road 331, South of
Silt, and within property owned by the Dixon Water Foundation.
C. The 2.2 -acre site is located within the following property description of the Valley
Farms parcel contained within the application documents attached hereto as Exhibit A and
incorporated by this reference;

D. The subject property is contained within the Rural zoning district and a Land Use
Change Permit for Material Handling requires approval of a Limited Impact Review Process by
Garfield County.
E. The Board is authorized to approve, deny or approve with conditions a Land Use
Change Permit for Material Handling pursuant to Section 1-301 and 4-105 of the Garfield
County Unified Land Use Resolution of 2008, as amended.
F. The Board of County Commissioners opened the public hearing on the 218` day of
December, 2009 upon the question of whether the Land Use Change Permit application for
Material Handling should be granted or denied, during which hearing the public and interested
persons were given the opportunity to express their opinions regarding the application.
G. The Board of County Commissioners closed the public hearing on the 21st day of
December, 2009 to make a final decision.
H. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. Proper posting and public notice was provided as required for the public hearing
before the Board of County Commissioners.
2. The public hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that hearing.
3. For the above stated and other reasons, the proposed Land Use Change Permit for
Material Handling has been determined to be in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. The application has met the requirements for a Land Use Change Permit as required
in the Garfield County Unified Land Use Resolution of 2008, as amended for
Material Handling.
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Land Use Change Permit to allow for Material Handling for the transport, storage,

and disposal of produced water into an injection well (Pad D).is hereby approved subject
to compliance with the following conditions:
1. That all representations made by the Applicant in the application, and at the public
hearing before the Board of County Commissioners, shall be conditions of approval,
unless specifically altered by the Board of County Commissioners.
2. That the operation of the facility be done in accordance with all applicable Federal,
State, and local regulations governing the operation of this type of facility.
3. Vibration generated: the facility shall be so operated that the ground vibration
inherently and recurrently generated is not perceptible, without instruments, at any
point of any boundary line of the property on which the use is located.
4. Emissions of smoke and particulate matter: the facility, generator, pump, or related
driveway and parking area shall be so operated so as to comply with all Federal,
State and County air quality laws, regulations and standards, including CDPHE
APCC Regulation 1 for dust.
5. Emission of heat, glare, radiation and filmes: the facility, generator, pump, and related
roadway and parking area shall be operated so that it does not emit heat, glare,
radiation or fumes which substantially interfere with the existing use of adjoining
property or which constitutes a public nuisance or hazard.
6. All equipment and structures associated with this permit shall be painted with non -
reflective paint in neutral colors to reduce glare and mitigate any visual impacts.
7. Volume of sound generated shall comply with the standards set forth in the COGCC
Series 800 Rules and Regulations.
8. All lighting associated with the property shall be directed inward and downward
towards the interior of the property.
9. All future exempt pipelines installed to transport produced water to the injection well
on Pad D shall obtain a Garfield County Grading Permit if the total disturbed area
exceeds 6,000 square feet.
10. The Applicant shall adhere to the Best Recommended Practices for the Area Wide
Stormwater Management Plan for Construction Activities and the required
procedures detailed in the Spill Prevention, Control and Countermeasure Plan, as
follows:
a. Erosion Control shall be accomplished by diversion of run-on water; diversion
and control of run-off water; vegetation establishment and maintenance; and
application of maintenance of mulches, blankets, tackifiers, tracking and
contouring.
b. Run-off control shall be accomplished using check dams; berms; culverts;
culvert protection; diversions; land grading; mulches, with or without
tackifier; and erosion control blanket.

c. Sediment reduction and control shall be accomplished by the use of; silt fence;
straw bales; wattles; and vehicle tracking pads (cattle guard).
d. The applicant shall adhere to the following Structural and Administrative Site
Management Practices:
i. Terrain outside of' the construction project will not be graded, except
where necessary.
ii. To prevent tracking of sediment mud and rocks onto public roads,
portions of access roads may be graveled, as appropriate. Other means
such as track pads/angular rock or cattle guards may be utilized if
appropriate.
iii. Silt barriers (e.g. wattles, silt fence, straw bales) will be installed as
needed on down gradient portions of project areas.
iv. Side hill cuts (cut slopes) will be kept to a minimum to protect local
resources while providing a safe and stable plane for the efficient and
safe use of equipment.
v. Where conditions warrant, erosion control structures such as berms,
diversion or culverts may be constructed to divert water away from the
project areas. These control structures will also reduce soil erosion
along and adjoining areas disturbed during construction.
vi. During construction near perennial streams, lakes or wetlands, the
utilization of sedimentation basins, silt fence, straw bales may be
considered in order to prevent suspended sediments from reaching
down slope water courses, streams, lakes or wetlands.
vii. Where appropriate, staked straw bales or silt fence may be constructed
adjacent to crossings to reduce potential sedimentation in streams or
wetlands.
viii. In areas that have steep slopes, water bars or runoff diversions may be
installed. When used, water bars will generally begin and end in
undisturbed ground at approximately a 2% slope.
ix. Culverts may be installed at a grade ranging from 2% to 5%. Inlet
protection may include inlet aprons and rock armoring around the
culvert perimeter while below grade inlet sumps may be installed to
enhance sediment deposition. Outfall protection may include the use
of a rock barrier to slow the discharge of runoff water. Culvert pipe or
outfall protection will be extended to the toe of the slope on the
discharge end.
x. During the reclamation of a pad, all cut and fill slopes in steep terrain
will be graded and contoured to blend into the adjoining landscape.
Natural drainage patterns will also be reestablished. When possible
cut and fill slopes will be constructed so they are no steeper than a 1 to
3 ratio.
xi. Reclaimed pads may have a fence constructed around areas that have
been seeded. These fences will be installed in order to keep livestock

and vehicles off reseeded areas.
11. The Applicant shall adhere to the mitigation recommendations identified in the
Wildlife and Sensitive Area Report as follows:
a. Reclamation areas shall include Wyoming and Big Basin Sagebrush in the re -
vegetation plan. Local sagebrush seed should be used.
b. The applicant shall control noxious and invasive weeds to maintain native
vegetation.
c. No development activity should occur between January 1 and March 31 to
meet CDOW and COGCC standards for the protection of Mule Deer critical
range in the project area.
d. Brush and tree clearing should occur outside of the nesting seasons.
e. Soil erosion within the project area shall be implemented.
f. Food and garbage shall be removed in a timely and secure manner to reduce
attractants for bears.
12. The Applicant shall treat the infestation of Russian Knapweed and Chicory located
north of the Pad D site no later than June 15, 2010 and a follow-up treatment no later
than October 15, 2010.
13. The Applicant shall comply with the Best Management Practices noted in Section 3
of the Integrated Vegetation and Noxious Weed Management Plan as follows:
a. During construction the applicant shall;
i. Top soil shall be segregated from deeper soils and replaced as top soil
on the fmal grade.
ii. Wetland vegetation, if encountered, should be live handled like sod,
temporarily watered if necessary, and placed over excavated sub -soil
relative to the position from which the wetland sod was removed.
iii. Cut-off collars should be placed on all wetland and stream crossings to
prevent back washing or draining of important aquatic resources.
iv. Temporary disturbances shall be kept to an absolute minimum.
v. Equipment and materials handling should be done on established sites
to reduce area and extent of soil compaction.
vi. Disturbances shall be immediately reseeded with the recommended
mix in the re -vegetation section.
vii. Topsoil stockpiles shall be seeded with non-invasive sterile hybrid
grasses, if stored longer than one growing season.
viii. Prior to delivery to the site, equipment shall be cleaned of soils
remaining from previous construction sites which may be
contaminated with noxious weeds.
ix. Equipment shall be cleaned of potentially seed -bearing soils and
vegetative debris prior to moving to uncontaminated terrain.
b. Herbicides shall be selected to minimize damage to desirable grasses.
c. Grazing in reclaimed areas shall be deferred until the desired grass species are

established.
d. Weeds, other than the identified Russian Knapweed, may be eradicated using
mechanical means.
e. The application of vesicular-arbuscular mycorrhizal fiingi may be used as an
alternative treatment where there is poor or destroyed topsoil.
f. Reclamation of the project area shall use a mix of grasses and shrubs as
identified in Table 6, attached hereto as Exhibit A and incorporated by this
reference.
g. During site reclamation, the recommended grass mixture shall be applied in
late August using a multiple seed bin rangeland drill with no soil preparation
other than simple grading.
h. After the desired grasses are established then forbs, shrubs and trees can be
planted.
14. All vehicles hauling equipment and materials for this application shall abide by
Garfield County's oversize/overweight Vehicles permit system.
15. All vehicles requiring oversize/overweight permits shall apply for them at the
Garfield County Road & Bridge Department and have them in place at all times.
16. All vehicles requesting oversize/overweight permits shall have on file with Garfield
County Road and Bridge Department a letter or e-mail from Antero Resources
stating said vehicles can obtain permits under their road bond on file with Garfield
County.
17. Prior to issuance of a Land Use Change Permit the Applicant shall provide an
estimate for reclamation of that portion of Pad D that addresses the site reclamation
requirements of Section 7-212 Reclamation in the Unified Land Use Resolution of
2008, as amended. The Applicant shall verify that the existing bonding requirements
under the COGCC Series 700 and Series 1000 Rules for site reclamation and
bonding cover these reclamation requirements and if not, a separate reclamation
security will be required before the Land Use Change Permit is issued.
