HomeMy WebLinkAbout4.0 Resolution 2004-91111111111111111111 1111E11111 61B11011111111111111 660194 09/22/2004 12:23P B1624 P393 M RLSDORF 1 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on, Monday, the 11t" day of August 2004 A.D., there were present: John Martin Larry McCown Tresi Houpt Don DeFord Mildred Alsdorf Ed Green , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2004-91 A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION FOR GREG WILLIAMS TO OPERATE A HOME OCCUPATION STORING, SELLING, SIDING AND INSTALLING GARAGE DOORS WITHIN TWO SEPARATE BUILDINGS, 960 SQ. FT. AND 2,400 SQ. FT. WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"), has received an application from Greg Williams, for a Conditional Use Permit ("CUP") to allow a "Home Occupation" within the A/R/RD (Agricultural/ Residential/ Rural Density) zone district; and WHEREAS, the Board held a public hearing on the 11th day of August, 2004, upon the question of whether the above described CUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, it was established that the CUP runs with the land and is issued to the property owner, Greg Williams; and WHEREAS, the subject property which is the recipient of this Conditional Use Permit, is legally described as Lot 15, Sierra Vista Ranch to Garfield County, in the SE'/ of the NW'/ and the SW''A of the NE'/ of Section 22, Township 6 South, Range 92 West of the Sixth Principal Meridian. The site is practically located at 0019 Harmony Way, south of Silt; 1 Greg Williams, Conditional Use Permit 11111 660194 09/22/2004 12:23P B1624 P394 M ALSDORF 2 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO Colorado; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. Proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. The meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed conditional use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of Conditional Use (Section 5:03) the Garfield County Zoning Resolution of 1978. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Conditional Use Permit is hereby approved, subject to compliance with all of the following specific conditions: 1. That all representations made by the Applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 1. The Applicant shall be required to gain any and all applicable land use permits required for the buildings used for the proposed use. 2. The Applicant shall not operate the proposed use in such a way as to generate any excessive nuisance or hazards as defined in Sections 5.03.07 and 5.03.08 of the Garfield County Zoning Resolution of 1978 as Amended. 3. Applicant shall have no inside or outside sales and no customers visiting the site and shall the site shall only be used as a staging area for the applicants business. 4. The Applicant shall do no Home Occupation work preparing, building or constructing items for delivery and installation outside of the proposed and existing storage buildings. 5.
