Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs
on Monday , the 20th of October A.D. 19 97 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 97-100
A RESOLUTION CONCERNED WITH THE CORRECTION OF A SCRIBNER'S ERROR FOR THE
APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION BY COMMUNITY BASED
SERVICES, INC. dba WESTERN ACADEMY
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received an
application from Community Based Service Inc.,A William Evans, Administrator for a school on the
following described tract of land:
1252 County Road 294, Rifle, Colorado
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board held a public meeting on the 12th day of August, 1997, upon the question
of whether the above-described Conditional Use Permit should be granted or denied, at which meeting the
public and interested persons were given the opportunity to express their opinions regarding the issuance
of said Conditional Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned meeting approved by Resolution No. 97-84 said conditional use permit.
WHEREAS, there was a scribner's error in the last paragraph identifying the conditional use permit
approved to be a "Home Occupation (Barber Shop)", rather than a school.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Conditional Use Permit be and hereby is authorized permitting the use of the
above described tract of land for a school , upon the specific conditions contained in Resolution No. 97-84.

Dear Commissioners:
Western Academy is a residential treatment center and school originally granted a Conditional
Use Permit in July 1986 for the anticipated maximum capacity of 28.

Recently, on October 20, 1997, the county commissioners approved renewal of the Conditional
Use Permit. The request for the renewal was made due to the addition of a building adjoining the
present structure. The addition continues the existing use of the property and adds to it one
classroom and four single bedrooms.
At the time of the application, a study of the existing septic system, its history of actual water use,
and a proposal for alteration of the system was presented. The analysis of the system and its use
was provided by Jeff Simonsen, P.E., of Schmueser, Gordon, Meyer Engineers of Glenwood
Springs. The alteration of the system was approved.
Although the resolution by the commissioners approving the continuation of the Conditional Use
Permit did not specifically identify the number of residents allowed, and although our addition
provides four new single bedrooms, our application for the Permit did not specify the change from
28 residents to 32, the total facility's new licensed capacity. Mr. Simonsen's analysis indicates
that the system in its altered state, as approved, would accommodate a greater number of
residents.
We now believe that the potential exists for the building to occasionally be occupied for brief
periods by the licensed capacity of 32 and would like that potential recognized without having to
repeat the entire process.
Therefore. considering the recent date of the application and commissioners' approval for
renewal, and considering the analysis accompanying the application, this letter hereby requests
that the application and the renewal be amended to recognize the maximum capacity of 32
without having to repeat repeating the entire application and hearing process.
If such a procedure is possible, we would appreciate having that adjustment expedited at the
earliest possible date. If other information or another procedure is required, please notify me as
soon as possible in order for the proper number to be reflected.
I would appreciate your prompt consideration of my request as there is an occasional but urgent
need for such use.
