HomeMy WebLinkAbout2.0 BOCC Staff Report 03.25.2002BOCC 03/25/02 KKS PROJECT INFORMATION AND STAFF COMMENTS REQUEST: A request for review of a Conditional Use Permit to allow a Church in the R/L/SD zone district. APPLICANT: Sonlight Foursquare Gospel Church (Bernard Masimer, Pastor) LOCATION: 0355 County Road 132, Glenwood Springs, CO 81650. Located west of Glenwood Springs near the intersection of County Road 130 and County Road 132. SITE DATA: 9.55 acres ACCESS: Private driveway off of County Road 132 WATER: City of Glenwood Springs SEWER: West Glenwood Sanitation District EXISTING ZONING: R/L/SD I. DESCRIPTION OF THE PROPOSAL A. Site & Project Description: The applicant is proposing to permit an existing 1,500 square foot modular home on the site as a church facility. The modular will house the church offices and also the meeting room space for church use. The office space will be used on a daily basis from 8:OOam to 5:OOpm. A total of two workers will run the office; One full-time 40 hour per week employee, one part-time 20 hour per week employee. The meeting rooms will be used three (3) to four (4) times a week, several hours at a time. The amount of vehicles accessing the site will be approximately two (2) to nine (9) vehicles per day. 1 II. MAJOR ISSUES AND CONCERNS A. Conditional and Special Uses: Conditional Uses are subject to the standards set forth in Section 5.03 of the Zoning Resolution. This section states the following: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use; (A97-60) The City of Glenwood Springs and the West Glenwood Sanitation District currently provide water and sewer service to this property. The applicant has provided a letter from the West Glenwood Sanitation Distract that sewage service will be continued. The City of Glenwood Springs has indicated that they will continue to provide water service to this property as long as the applicant is enters a pre -annexation agreement with the City. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; The applicant has indicated that approximately two (2) to nine (9) vehicles per day will be entering the site. Staff does not believe this will constitute street improvements. The applicant is however, relocating the existing driveway access to the south of the property to provide safer access per Road and Bridge recommendations. (3) Design of theproposed use is organized to minimize impact on and from adjacent uses of lnd through installation of screen fences or landscape materials on the periphery o/'the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; The proposed use will be within an existing structure already located on the site. B. Access: The proposed access is a private drive off of County Road 132. The application includes correspondence from the Road and Bridge Department recommending a new access point on the southern portion of the property to achieve adequate site distance for motorists. The existing driveway on the site will be required to be abandoned after completion of the new entry. C. Parking: The following standards apply to the proposed use: 2.02.40 Off -Street Parking: An area maintained on the lot in an accessible and unobstructed condition for parking of automobiles by the residents, visitors, employees and customers of uses occupying the lot shall be a minimum of two hundred (200) square feet. The applicant has provided parking spaces with the dimension of 8.5' x 18' (153 square feet). As can be seen in the regulation above, the requirement is two 2 hundred (200) square feet. The applicant will be required to modify the parking configuration before a Conditional Use Permit will be issued. 5.01.02 Minimum Off -Street Parking: Parking for each use shall be provided in the following amounts: (4) Auditorium and public assembly: one (1) space per one hundred (100) square feet of floor area used for seating or assembly; The applicant has provided two (2) handicapped spaces and seven (7) standard parking spaces, at a reduced size than what is required by Section 2.02.40 of the Zoning Regulations. The applicant has stated that approximately 522 square feet of the modular will be used for meeting areas. This would require six (6) parking spaces, pursuant to the regulation listed above. The applicant will be required to provide at least six (6) two hundred (200) square foot parking spaces before a Conditional Use Permit will be issued. D. Water: The applicant has indicated that the existing modular will be served by City of Glenwood Springs water. The applicant will need to demonstrate a completed pre -annexation agreement with the City of Glenwood Springs prior to the issuance of a Conditional Use Permit. E. Sewer: The proposed use on this property will be served by the West Glenwood Sanitation District. The applicant has provided a letter from the West Glenwood Sanitation District stating that they can and will serve the unit. III. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed conditional use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended. 3 IV. RECOMMENDATION Staff recommends APPROVAL, with the following conditions: 1. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. That the applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended. 3. A pre -annexation agreement with the City of Glenwood Springs and the applicant is in place before a Conditional Use Permit is granted. 4. The applicant must provide at least six (6) two hundred (200) square foot parking spaces to comply with Section 2.02.40 and 5.01.02 of the Zoning Resolution of 1978, as amended. 5. That this approval shall be valid until 03/25/03. If the applicant fails to meet these conditions by 03/25/03, and subsequently the special use permit is never issued, the approval shall be automatically revoked, unless an extension is granted by the Board of County Commissioners. 6. Any expansion or modification of this use shall require an amendment of the Conditional Use Permit. 4
