D. there were present: John Martin Larry McCown Tresi Houpt Don DeFord Mildred Alsdorf Ed Green when the following proceedings, Commissioner Chairman , Commissioner Commissioner , County Attorney , Clerk of the Board , County Manager among others were had and done, to -wit: RESOLUTION NO. inns .t9 A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION FOR A PROPERTY LOCATED AT 7950 COUNTY ROAD 309, GARFIELD COUNTY, COLORADO AND OWNED BY BARRY STAHL & JODI PETERSON Parcel ID: 2175-332-00-124 WHEREAS, the Board of County Commissioners of Garfield County, Colorado (the Board), received an application for a Conditional Use Permit (CUP) for a Home Occupation to operate Outdoor Services which is a service oriented business that specializes in weed control and concrete landscape curbing; and WHEREAS, the subject property is located at 7950 County Road 309 and owned by Barry Stahl and Jodi Peterson and is also located within the A/R/RD zone district; and WHEREAS, the Board held a public hearing on the 5th day of June, 2005, upon the question of whether the above described CUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said CUP; and WHEREAS, the Board, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 111111111111 1111111 11111 11111 1111111111III1111111111111 676706 06/22/2005 11:268 B1699 P380 M PLSDORF 2 of 4 R 0.00 D 0.00 GARFIELD COUNTY CO 1. That adequate public notice was provided as required for the hearing before the Board of County Commissioners and proof thereof submitted in the record; 2. That the hearing before the Board of County Commissioners was extensive and complete, that sufficient pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting; That for the above stated and other reasons, the proposed Conditional Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with Sections 2.02.29, 5.03, and 9.02 of the Garfield County Zoning Resolution of 1978, as amended; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Conditional Use Permit is hereby approved subject to compliance with all of the following specific conditions: 1. That all representations made by the Applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. The Applicant shall be prohibited from erecting any signage or lighting associated with the Home Occupation. 3. Only one delivery truck shall be allowed per week bringing supplies and materials to the property for the purpose of the Home Occupation. No other visitor traffic associated with the Home Occupation shall be allowed to visit the property. 4. All trailers, ATVs, skid mounted spray rigs that slide onto the truck and ATV's, materials and supplies associated with the Home Occupation shall be stored inside the storage structure. 5. The Home Occupation shall be permitted to occur from April 15th to November 15th and have regular business hours between 6:00 AM to 6:00 PM, Monday through Friday. 6. No sales (retail or wholesale) of any kind associated with the activities of the Home Occupation shall be allowed to take place at the property. 7. The Applicants (Barry Stahl and Jodi Peterson) shall be the only employees allowed to operate the business at the property. 8. In the event any representations made in the application for which this permit is granted, change and are no longer consistent with the representations in this application, the applicant shall be required to submit a new permit application to the county addressing the changes. 10. In the event the Applicant relocates the 3,024 sq. ft. structure on the property, the Applicant shall be required to submit a new site plan to the Building and Planning Department that reflects the change from its original location.
