The proposed church facility designed for The Church of Jesus Christ of Latter
Day Saints will be constructed on parcel #2407-171-17-001, 3.154 acres of the
Battlement Mesa Block #3 Subdivision. This building will conform to the 2009
International Building Code and the Garfield County requirements.
This church facility is designed to have Phase 01, also known as the
Independence — 130 plan, be constructed as soon as permitted. With Phase 02, also
known as the Independence — 170 plan, be constructed at some undetermined future
date. Both phases of construction will include; concrete footing and foundation with slab
on grade, wood framing including engineered wood trusses, brick and EIFS exterior,
painted drywall interior, asphalt single roofing and a prefabricated metal steeple.
Phase 01 site layout will include 54 parking stalls, four accessible parking stalls,
and a single access drive off of Sipprelle Drive. Phase 02 site layout will add 29 stalls
for a total of 83 stalls and allow for a second drive when future development of a public
road (Arroyo Drive) to the southeast of the property takes place. A traffic impact review
has been conducted by Colorado River Engineering and has been provided. This review
states that "peak day use (Sunday) will be successfully incorporated in the existing
roadway network." The review recommends the use of either R1-1 "STOP" or R2-1
"YIELD" sign at the driveway access to identify the right-of-way for Sipprelle Drive. This
project will provide a R1-1 "STOP" sign.
Through the position of the building and use of features such landscape
materials, parking lot lighting, and detention basin the proposed project minimizes
impact from and to adjacent properties (see attached drawings). The building was
positioned on the northern portion of the property so as to keep the southern portion of
the site un -obstructed and un -disturbed, this minimizes the impact to adjacent property
owners at the south. The parking lot lights are directional lights (directed downward) and
as conveyed on the site lighting plan the luminance and location of said lights are
positioned nearest the building, not around the parking lot, this minimizes any exposure
to adjacent properties. A native grass/flower seed will be planted to minimize any
erosion and give a natural/native planting look around the exterior of the site. Trees are
placed at the frontage (name/type shown on planting plan) of Sipprelle Drive in Phase
01, with additional trees added in Phase 02 at the frontage of future Arroyo Drive.
Concrete retaining walls are to be added at the east corner of the property in Phase 02.
All of these improvements will help eliminate erosion to and from the site and deliver a
more pleasing and beautified look around the site. No trees are being placed directly
adjacent to property owners as to not obstruct views.
The local public water and sewer utility jurisdiction has reviewed and approved
the design of the connections to the building and have provided a "can and will serve
letter" for the proposed construction.

PAYMENT AGREEMENT FORM
GARFIELD COUNTY ("COUNTY") and Property Owner ("APPLICANT")
Agent - Dennis B. Patten agree as follows:
1. The Applicant has submitted to the County an application for the following Project:
Parachute Independence -130 LDS Chapel
2. The Applicant understands and agrees that Garfield County Resolution No. 98-09, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.

Recitals
A. The Board of County Commissioners of Garfield County, Colorado, received a
Conditional Use Permit request to allow for a Church to be located within the Battlement Mesa
Planned Unit Development.
B. The Church use is proposed to occur on property legally described as Battlement Mesa
Town Center Filing #5, Block 3 as contained in Special Warranty Deed recorded at Reception
Number 785364 in the office of the Garfield County Clerk and Recorder.
C. The subject property is contained within the Battlement Mesa Planned Unit
Development and subject to the PUD zoning approved by the Board of County Commissioners
in Resolution Number 82-121, as amended.
D. The Battlement Mesa PUD requires a Condition Use Permit for Church in all zone

districts within the PUD.
E. The Board is authorized to approve, deny or approve with conditions a Conditional
Use Penult pursuant to the Zoning Resolution of 1978, as amended by Resolution 79-132, and is
further authorized to approve, deny or approve with conditions a Land Use Change Permit
pursuant to the 2013 Land Use and Development Code, as amended.
E The Board of County Commissioners opened a public hearing on the 7ih day of April,
2014 for consideration of whether the proposed Conditional Use Permit should be granted or
denied, during which hearing the public and interested persons were given the opportunity to
express their opinions regarding the request.
11. The Board of County Commissioners closed the public hearing on the 7th day of April,
2014 to make a final decision.
I. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
I. That proper public notice was provided as required for the hearing before the Board
of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted or could be
submitted and that all interested parties were heard at that meeting.
3. That for the above stated and other reasons and upon compliance with the conditions
of approval, the Land Use Change Permit for a Church to be located in the MDR
zone of the Battlement Mesa PUD is in the best interest of the health, safety,
convenience, order, prosperity and welfare of the citizens of Garfield County.
4. That the application has adequately demonstrated that the proposed Church is
compliant with the requirements of the 1978 Zoning Resolution and Battlement Mesa
PUD zoning.
5. That the application is generally consistent with the Garfield County Comprehensive
Plan 2030, as amended.
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
