' The follo?'1ng items are required by Garfield County for a final inspection:
' 1. A final Electrical Inspection from the Colorado State Electrical Inspector;
2. Pennanent address assigned by Garfield County Building Department posted where readily
visible from access road;
3. A finished roof, a lockable house, complete exterior siding, exterior doors and windows
installed, a complete kitchen with cabinets, a sink with hot & cold running water, non-absorbent
kitchen floor coverings, counter tops and finished walls, ready for stove and refrigerator, all
necessary plumbing;
4. All bathrooms must be complete, with washbowl, tub or shower, toilet stool, hot and cold
running water, non-absorbent floors and walls finished and a privacy door;
5. All steps outside or inside over three (3) steps must have handrails, guard rails on balconies or
decks over 30" high constructed to all IBC and IRC requirements;
6. Outside grading done to where water will detour away from the building;
7. Exceptions to the outside steps, decks and grading may be made upon the demonstration of
extenuating circumstances, i.e. weather, but a Certificate of Occupancy will not be issued until
all the required items are completed and a final inspection made;
8. A final inspection sign off by the Garfield County Road & Bridge Department for driveway
installation, where applicable; as well as any final sign off by the Fire District, and/or State
Agencies where applicable.
A CERTIFICATE OF OCCUPANCY WILL NOT BE ISSUED UNTIL ALL THE
ABOVE ITEMS HAVE BEEN COMPLETED.

In order to understand the scope of the work intended under a permit application and expedite the
issua.J)ce of a pennit it is important that complete information be provided. When reviewing a plan
and it's discovered that required information has not been provided by the applicant, this will result
in the delay of the permit issuance and in proceeding with building construction. The owner or
contractor shall be required to provide this information before the plan review can proceed . Other
plans t~at are in line for review may be given attention before the new information may be reviewed
after it has been provided to the Building Department.
Please review this document to determine if you have enough information to design your
project and provide adequate information to facilitate a plan review. Also, please consider
us~g a design professional for assistance In your design and a construction professional for
construction of your project. Any project with more than ten (10) occupants requires the plans
to be sealed by a Colorado Registered Design Professional.
To provide for a more understandable plan in order to determine compliance with the building,
plumbing and mechanical codes, applicants are requested to review the following checklist prior to
and during design. Applicants are required to Indicate appropriately and to submit the
completed checklist at time of application for a permit.
Plans to be included for a Building Permit, must be on drafting paper at least 18"x24" and
drawn to scale.
Plans must include a floor.·plan, a concrete footing and foundation plan, elevations all sides w.ith
decks, balcony, steps, hand rails and guard rails, windows and doors, in~luding the finish gradehne
and original grade. A section showing in detail, from the bottom of the footing to the top of the roof,
including re·bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation,
sheeting, house·rap, (which is required), siding or any approved building material. Engineered
foundations may be required.
A window schedule. A door schedule .. A floor framing plan, a roof framing plan, roof must be
designed to withstand a 40 pound per square foot up to 7,000 feet in elevation, a 90 M.P.H . wind
speed, wind exposure B or C, and a 36 inch frost depth .
All sheets to be identified by number and indexed. All of the above requirements must be met or
your plans will be returned.
All plans submitted must be incompliance with the 2003 IRC.
1. Is a site plan included that identifies the location of the proposed structure or addition and
distances to the property lines from each comer of the proposed structure(s) prepared by a
licensed surveyor and has the surveyors signature and professional stamp on the drawing?
Properties with slopes of 30% or greater must be shown on the site plan. (NOTE
Section: 106.2) Any site plan for the placement of ariy portion of a structure within 50 ft.
of a property line and not within a previously surveyed building envelope on a
subdivision final plat shall be prepared by a licensed surveyor and have the surveyor's
signature and professional stamp on the drawing. Any structure to be built within a .
building envelope of a lot shown on a recorded subdivision plat shall include a copy of
the building envelope as it is shown on the final plat with the proposed structure located

P er your request, we vi s ited the s ubject s ite on November 15 , 2006 to o bserve the construction of the trench
beams of the po st-tensioned s lab-on-grade. The dimen sio ns, geometry, and required opti ons have not bee n
verified at this time. The contractor ass umes responsibility for the accuracy of all building dim ensions, locations
on lot , foundation elevations, and the s lab step layout.
The trench beam depth, width, and required steel placement appeared to be in gener al confo rm a nce with
approved construction doc uments . Also, we observed th e required I -in ch polystyrene foam (extrud ed) insulation
was placed in the tre nche s at the exterior of the buildin g footp rint per plan and is temporaril y to the trench wa ll.
We also observed that an Ufer rod was placed at the time of t he wall steel in sta ll atio n. No other items were
o bserved at thi s time.

Per your request, we visited the subject site on November 15 , 2006 to observe the tendon placement and interior
trench beams of the post-tensioned slab-on-grade. The dimensions, geo m etry, and required options have not
been verified at this time. The contractor assumes responsibility for t he accuracy of all building dimensions,
locations on lot, foundation e levations, and the s lab step layout.
The installation of the tendons and interior stiffened beams appeared to be in genera l conformance with the
construction plans. We observed the top of grade appeared to be at the correct e levation to maintain the slab
thickness per plan. It is the responsibility of the contractor to verify s lab thickness and tendon layout rem ai n as
observed during concrete placement. No other items were observed at this t ime .

Per your request, we vis it ed the subject si te on December 7, 2006 to observe the tendon stressing operation s for
post-tensioned s lab-on-grade de s ign.
The stressing of the tendons were conducted within acceptable tolerances and appeared to be in general
conformance with the construction. At this time, tendon tails may be cut off and the a nchor caviti es grouted with
a high strength, non-shrink gro ut. This concludes the construction of the post-tens ioned foundation sys tem.

Freed om Program Purchase and Sale Agreement dated Mo...y ~ , 200 fo. Term s defined in t he
Freedom Program Purchase and Sales Agreement and used in this Contract shall ho ld t he same definition in thi s
Contract. The constru ction of the Re sidence on th e Lot, each as defined in the Freed om Pro gram Purchase and Sa le
Agreement shall be referred to herein as (the "House").
1. Contactor's Scope of Work. Contractor's scope of work shall consist of construction serv ices for t he House as
set forth below, which colle ctivel y shall be referred to herein as the "Work."
2. Plan s
a. Contractor has prepared the following drawings, consistent with other homes in the Project, as defined in the
Freedom Prog ram Purchase and Sale Agreement, and const ructed by Contra ctor :

3. Construction Services
a. Contractor shall procure and pay for all permits, lice nses, ap provals and inspect ions required for the House .
b . Contractor shall provi de or cause to be pro vided all labor, materials, equ i pment and services to construct the
House in a workmanlike manner, consistent with ho mebuilding indu stry standards in Garfield County,
pursu ant to the Plan s. Contractor shall not be re spo nsibl e for fu rn ishing or const ructing any improvements o r
performing any work unless the same are specifica ll y set forth in the Plans or in this Contract.
4. Owne r's Re sponsibiliti es
a. Owner shall cooperate with Contract or in securing a ny permits , li cen ses , approvals and inspections f or the
H ouse.
b. Upon Co ntractor's request, Owner sha ll provide a ll "Requ ested Informa ti on " to Contractor in a timely manner,
and shall be available to meet with Co ntractor to ap prove plans and re view the progress of th e W ork .
Requested Inform ati o n shall includ e, but no t necessarily be limited to:
i. proof of fin anc ing
ii. change ord er re qu ests
iii. proof o f necessary insurance
c. Owner specificall y agrees and ackn owledg es th at fin a ncin g for th e Hou se is the sole a nd exclusive obl igati o n
of Owne r, a nd Owner's a bility to obtain fin ancing is not a cond ition preceden t to Owner's obligations set forth
in this Contract. Owne r represe nt s th at Owner is qualified to obtain suc h fin a ncing and/or has availab le funds
in the amo unt necessary to compl ete th e House. Owner agrees to promptly seek and obtain any and all
required financing for th e House. Owner ag rees to provide Contractor wi t h proof, satisfactory to Contractor,
that Owner's financing for th e Ho u se has been finalized, and agrees th at Contractor is n ot ob ligated to
proceed with const ru ction o n the House until such proof is delivered to Contractor and t he Closing of the Lot

has occurred.
d . Owner agrees not to let or enter into any o ther contracts in connection with the Hou se or the Lo t without t he
prior w ritten approval of Con tractor. Owner acknowledges and agrees that entering in to any contract or
permitting an y o ther contracto r o nto the Lot may impede the Contract or's ability to manage the cost of the
House a nd tim ely complete performance of the Work as contem plat ed herein . Violation of this provision, shall,
in addition to any other remedi es set forth herein, permit Contractor to exercise its terminat ion rights as
specified herein .
e. Within three (3) days after substantial completion of the Work, Owner shall notify all utility suppliers t hat
Owner is responsible for utility expenses from and after the date o f subs tantial completion.

a . Without limiting the foreg oing, Owner agrees to provide all Requested Information to Contractor to start
construction within three (3) months of the date on which the Closing of the Lot occurs. Should Owner delay
commencement construction beyond said three (3) months, Owner shall pay Contractor the sum of Five
Thousand Dollars ($5,000.00) per month, allocated fo r fractiona l portions of months ("Extension Fee"). The
parties hereby agree that Contractor 's actual damages for such Owner delay cannot be calculated now with
certainty, and that Liquid ated Damages are a re aso nable estimate thereof.
b. Provided that Owner ha s complied w ith all of its obligations hereunder, including but not limi ted to tim e ly
payment of all sums due to Contractor, a nd Owner has secured financi ng for the House and delivered
satisfactory proof thereof to Contractor, and Clos ing of the Lot has occurred, Contractor sha ll commence
co nstruction a t the House Site within sixty (60) d ays after the issua nce of a build ing permit (t he
"Commencement Date").
c. Substantial Completion of the House shall occur within eight (8) months after the Commencement Date (the
"Completion Date"). Th e Comple tion Date may be extended on account of:
i. labor disputes;
ii. fire or other damage to the House;
iii. material or labor s hortages ;
iv . transportation delays;
v. governmental action;
vi. unusual weather condition s;
vii. c h ange orders o r delays caused by Owner;
viii. the failure of Owner to provide information and/or approvals in a timely manner; or
ix . any other causes which are beyond Contractor's control or w hich may otherwise jus tify the delay; and
x . Force Majeure events .
d . W ithout li miting the foregoing , Owner agrees to provide all required information to Contractor to substantially
complete construction by the Completi on Date. Should either party delay Substantial Completion of the
House beyond the Completion Date , th e delaying pa rty shall pay the other pa rty the sum of Five Tho u sand
Dollars ($5,0 00.00) per month , a llocated for fract ional portions of mont hs as an Extension Fee. The parties
he reby agree that actual damages for such delays ca nnot be c al cula ted now with ce rtainty, and that th ese
Liquid a ted Damag es a re a reasonable estim ate there of.
Ownership of Plan s. Owner ag rees and acknowledges that the Pl ans, and any amendm ents or revisions th e reto ,
are and s hal l remain the sole a nd exclusive property of Contractor, and Owner ag rees not to sell, transfer, assign ,
use, copy or share the same with any person or entity without the prior and express written consent of Contractor,
which may be withh eld in Contrac tor's sole di sc re tion .

b. Owner acknowledges th at upon the execution of a ny change o rd ers during the course of construction, t he
Contract Pri ce may increase, and in s uc h event Owner shall pay to Contrac tor such increase upon execution
of th e change order , and prior to Contractor's performance of any wo rk in connecti o n with the c hange o rder.

a. Owner shall make, or cause Owner's lender to make, progress payments for the Work in accordance with the
schedule attached hereto as Exhibit A ("Draw Schedule") or at any intermediate point based on the
percentage of completion of work at that time identified by inspection. Progress payments shall be delivered
to Contractor within five (5) days after Owner's receipt of Contractor's request for payment, which requests for
payment shall in clude appropriate lien waivers from all parties who prov ided labor and/o r m aterials applicable
to the previous request for payment.
b. In the event that at any time the amount of Owner's loan availab le for distribution is less than the amount of
the Contract Price remaining to be paid, Owner shall deposit the difference into a construction control account
and execute a customary construction control agreement with resp ect to the holding and d istribution of said
sum prior to Contractor's obligation to commence or continue construction at the House Site. Owner shall be
responsible for the payment of any fees in connection with the construction contro l.
c. Within ten (10) days after substantial completion of the Work, Owner sha ll pay all re ma ining amounts due
under this Contract.
d. All monies not paid when due as provided herein shall bear interest at the rate of eighteen percent (18%) per
annum.
e. In the event any installment is not paid when due, Contractor may exe rcise any remedy set forth in this
Contract or exercise any other legal and/or equitable rights which may be necess ary or appropriate to enforce
this Contract.
9. Changes in the Work
a. Buyer understands, acknowledges and agrees that the Contract Price includes only the items set forth in the
document attached hereto as Exhibit B ("Features List"). These are referred to herein as ("Standard
Selections").
b. Additions, upgrades, and/or optional items which are made available to Owner shall be selected, contracted
and paid for in a separate contract with Contractor or by Change Order.
c. Contractor may offer pre-designed and priced options for each Residence to Owner.
i. Options which change the architectural design of the Residence, such as an additional garage bay,
are referred to as architectural options ("Architectural Options").
ii. Options which change the materials and colors of the Residence, such as carpet type and/or color,
are referred to as design options ("Design Options").
iii. Together these are often referred to as ("Options').
d. Changes to the Work that are not a pre-designed and priced Architectural Option or Design Options are
referred to as change orders ("Change Orders").
i. All change orders shall specify the following :
1. the change in the Work,
2. the adjustment to the Contract Price, if applicable, and
3. the adjustment to the Completion Date, if applicable.
e. Changes in the Work can only occur by purchasing an Architectural Option , purchasing a Design Option or by
written Change Order prepared and approved by Contractor.
f . Options will be offered to the Owner, provided the following conditions have been adhered to:
i. Options must be selected in a timely manner. Each Option is assigned one of three dates which are
referred to as design selection 1 ("DS1"), design selection 2 ("DS2") and design selection 3 ("DS3").
DS1 is six weeks prior to the start of construction, DS2 is prior to the start of construction and DS3 is
45 days after the start of construction.
ii. Should Owner fail to select Options on or before the applicable des ign select ion date, Seller shall
have the right to either install the standard selection or deny the Option .
iii. Architectural Options shall be selected concurrently with the execution of this Agreement, and the
cost of each Architectural Option shall be added to and included i n the Purchase Price.
iv. Design Options shall be selected subsequent to the execution of this Agreement. Payment in the
amount of 1 00% of the price of each Design Option shall be due when each Des ig n Option is
ordered.
g. ALL PAYMENTS FOR DESIGN OPTIONS ARE NON-REFUNDABLE TO OWNER
h. All Option purchases and change orders shall be executed by both the Owner and the Contractor and paid for
by Owner, prior to the commencement of the work set forth therein .
i. In the event that any increase in the cost of construction arises because of a change in appli cable
governmental regulations taking effect after the date of this Contract, such revi sion or condition shall be the

basis for a change order and Contractor shall receive approp riate co m pensat ion f or making such change.
10. Possession and Use of the Lot. Upon the Closing of the Lot, Owner is deemed to have conveyed to Contractor
an absolute and exclusive right to poss ess and use the Lot. Owner sha ll not enter the Lot unless accompanied by
an authorized representative of Contractor. Owner shall not inst ruct , direct or otherwis e contact Contractor's
laborers, subcontractors or consultants. Contra ctor shall permit access to the Lo t by i nsp ectors of Owner's lender.
Contra ctor shall return possession of the Lot to Owner at th e time that all payments and obligations requi red of
the Owner have been fully paid and performed by th e Owner. If possessio n of the House and Lot is ta ken by the
Owner before Owner's obligations set f orth in thi s Contract are fully perfor med and without t he prior written
consent of Contractor, Owner shall be deemed to have accepted the Work as comp lete and sa tisfactory, in
compliance of all of Contractor's obligations hereunder.
11 . Walk Through.
a. Upon notice from Contractor to Owner, Owner and Contractor sha ll schedu le a wa lk-th rough of Owner's home
and shall compile a list of any items which are materially not in accordance with a pp roved plans and
specifica tions , or do not mate rially ·conform to Garfield County standards . Contractor shall repair, replace or
otherwise remed y the item s within a reasonab le time after Substantial Comp letion .
b. Notwithstanding the fact that additional work may be required to correct t he items, if the Hou se has reached
Substantial Completion, then no fund s shall be withheld from Contractor for these items.
c . After Substantial Completion , the Limited Seller's Warra nty includ ed in the Fre edom Program Purchase and
Sale Agreem ent shall app ly.
12. No Assignment. This Contract shall not be assigned by Owner or Contractor to any other party except after the
prior written con sent of Owner or Contractor, which consent may be rese rved in Owner's or Contractor's sole
discret ion. If Owner or Contractor ass igns any of Owner's or Contracto r's rights under this Contract to any o ther
party in violation of this provision, said assig nment shall be void and of no effect, and Owner sha ll be in d efault
hereunder . Notwithstanding the foregoing , Contractor consents to a collatera l assignment of t his Contract to
Owner's lender pursuant to Ow ner's agreement with its lender.
13. Insurance.
a. Owner shall pro cure and maintain during th e term of this Contract the following poli ci es of insurance:
i. Course of Const ru ction in su rance in the amount of the Contract Price;
ii. Homeowner's in su rance, and a fire and extended risk insurance policy, covering the House and Lot,
in an amount not less than the Purchase Price, together with insurance cove ring loss or damage to
Owner's personal property, and Owner's perso nal liabili ty f or inj uries wh ich may be sustained within
the Property; and
iii. Comprehensive General Liability insurance in the amount of $1,000 ,000 .
b. Contractor shall maintain during the term of this Contract:
i. Workers compensation insurance, as required by law.
14. Termination of the Contract upon Termination of the Freedom Plan Purchase and Sale Agreement. This
Contract shall be ·deemed terminated upon the termination of the Freedom Plan Pu rchase and Sale Agreement
for any reason. In such event , unless the ca use of such termination is th e default of Contractor as seller under
the Freedom Pla n Purchase and Sale Agreement , Contractor shall be entitled to reta in all other amount(s)
previously paid to Contractor or otherwise due to Contractor under this Contract.
15. Contractor's Ri g ht to Stop Work and Terminate Contract. In addition to all other re medie s set fo rth in this
Contra ct, in the event that any payment is not made i n full within five (5) days after such payment is due, or
Own er fails to perform any of its duties under this Contract within ten (1 0) days after written notice from
Contractor, Contractor may stop the Work until payment is made or O wne r fulfi lls its duties . Should the Work be
stopped for a period of fifteen (15) days or more upon Owner's failure to make a progress payment or as a result
of any other act , omission or neglect of the Owner, then Con tra ctor may, upon provi ding written notice to Owner,
terminate this Contract. Upon suc h termin ation, the Contractor may recover from the Owner payment for all work
completed and for any loss sustained by the Contrac tor for materials , equipmen t, tools, or machinery to t he extent
of actual loss thereon, plus an amount eq ua l to the Co ntra ctor's anticipated profit under this Cont ract, plus interest
on the f oregoi ng amoun ts at the rate of eigh teen percent (18 %) per annum .

16 . Alternative Dispute R eso lution. Owner and Contractor agree to be bound by the alternative dispute resolution
procedures se t forth in the Declaration . Any and all claims, disputes and con troversies arising between Owner
and Contractor, whether before or after Closing, relating to thi s Contract or it s subject matter, including, but not
limited to, any alleged construction defect, shall be submitted to final and binding arbitration.
17. Notices. All notices required by this Contract sha ll be in writing an d shall be given by any of t he following means
to the below listed add resse s or fa x numbers :
a. certified or registere d mail, postage prepaid, return receipt req uested, in wh ich case notice shall be deemed
delivered three (3} business days after the postmark date;
b. recognized commercial overnight courier, in which case notice shall be deemed delivered one (1) bu siness
day after receip t for deli very by the courier;
c. telecopy transmittal ("fax"), in which ca se notice shall be deemed delivered upon fax confirmation of
transmiss ion to the intended party ; or
d. personal delivery, in which case th e notice s hall be effective when received.
e. Notice shall be given to Contractor to:

g. Notice of change of address shall be delivered by written notice in the manner described in thi s sect ion.
Rejection or other refu sa l to accept a notice or the inability to de liver a noti ce because of changed address of
which no notice was given shall be deemed to constitute re ce ipt of the noti ce sent.
18. Contractor's Limited Warranty. Contractor shall provide a one-year l imited warranty on the house as provided for
in the Freedom Program Purchase and Sales Agreement.
19. Contractor's Disclaimers . Contractor makes no representation o r warranty, a nd shall in no event be responsible
for the following :
a. Hazardous materials (as defined by applicab le law) in the House or on the Lot;
b. Homeowner's association assessme nts and/or property ta xes applicab le to the Lot;
c. Owner's financing of the Work;
d. Any work or materials not supplied or in stalled by Contractor pursuant to thi s Contract; or
e. All of the matters desc ribed in the disclosures and disclaimers set forth in the Freedom Plan Purchase and
Sale Agreement , whi ch disclosures and disc laimers are fully incorporated he re in by thi s referen ce.
20 . Gene ral Provisions .
a. This Contract shall be governed by the laws of the State of Co lorado . Juris diction a nd venue for any action
concerning this Contract s hall be in Garfield County, Colorado.
b. In the event of any litigation or other proce edings between the parties concerning thi s Contrac t, the prevailing
party shall be entitled to the payment by the nonprevailing party of all of its reasonable attorneys' fees, court
costs, a nd litigation expenses.
c . This Contract constitutes the entire agreement between th e parties and any prior understandings, agreements
or repre sentations of any kind whatsoever preced ing the date of this Contract shall not be binding u pon ei t her
party except to the extent th at they are specifically incorporated into this Contra ct.
d. Thi s Contract sha ll be binding upon and inure to th e benefit of the parties hereto and to their respective heirs,
re presentatives, successors a nd permitted ass ign ees. Thi s Contract is intended for the exclusive benefit of
