D. there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Tresi Houpt , Commissioner Don DeFord , County Attorney Mildred Alsdorf Clerk of the Board Ed Green , County Manager -Absent when the following proceedings, among others were had and done, to -wit: RESOLUTION No. 2006-84 A RESOLUTION CONCERNED WITH A REQUEST FOR TWO (2) SPECIAL USE PERMITS AS FOLLOWS: 1) TO CONSTRUCT AN ADU IN THE FLOODPLAIN, AND 2) TO ALLOW AN ADU ON THE SUBJECT PROPERTY, 8.49 ACRES IN SIZE - PARCEL B OF THE RIFLE VILLAGE SOUTH SUBDIVISION FILING NO. 1, LOCATED AT 335 VILLAGE DRIVE, RIFLE, COLORADO, ZONED A/RIR/D, OWNED BY BRIAN AND TANNI RUST WHEREAS, the Board held a public hearing on the 17TH day of July, 2006 A.D., upon the question of whether the above described Special Use Permits should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said Special Use Permits; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. Proper publication, public notice, and posting were provided as required by law for the meeting before the Planning Commission and the hearing before the Board of County Commissioners. 2. The meeting before the Planning Commission and the hearing before the Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings. 1 • 111111! l1111 011111111111111111111111111'111111111111 704367 08/15/2006 10 10A 61831 P938 M RLSDORF 2 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO 3. The application is in compliance with the standards set forth in the Garfield County Zoning Resolution of 1978, as amended. 4. That for the above stated and other reasons, the proposed Zone District Amendment is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permits for the 8.49 acre property at 335 Village Drive, Rifle, Colorado are hereby approved subject to compliance with all of the following specific conditions: SPECIAL USE PERMIT — FLOODPLAIN: 1. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. That the Garfield County Zoning Resolution of 1978, as amended, and any other applicable state or federal laws concerning the 100 yr. floodplain, be complied with. 3. That all State and Local health standards be complied with. 4. That a flood elevation certificate, signed and stamped by a licensed engineer or surveyor (in the state of Colorado), be submitted to the Garfield County Planning Department prior to issuance of a Certificate of Occupancy. 5. That once the foundation has been staked, the existing ground elevations shall be surveyed by a professional land surveyor, consistent with the building permit. 6. That all building improvements be installed consistent with the Garfield County Building Code and that the finished floor shall be constructed at least two (2) feet above the existing grade, consistent with the building permit. 7. All proposed construction shall be adequately anchored, whether addressed by building code or not. SPECIAL USE PERMIT - ADU: 1. All representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless otherwise modified by the Board. 2. All lighting associated with the ADU shall be the minimum amount necessary. The Applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended, and shall meet all building code requirements 4. The gross floor area of the accessory dwelling unit shall not exceed 1,500 square feet 5. The accessory dwelling unit shall not be conveyed as a separate interest but may be leased 6. That all construction shall require the appropriate building permits and inspections to be conduc =. by the County Building and Planning Department.
