HomeMy WebLinkAbout4.0 Resolution 97-41• STATE OF COLORADO ) )ss County of Garfield ) At a regular hearing of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners Meeting Room, Garfield County Courthouse, in Glenwood Springs on Tuesday , the 18th of February A.D. 19 97 , there were present: Marian I. Smith John Martin Larry McCown Don DeFord Mildred Alsdorf Chuck Deschenes Commissioner Chairman , Commissioner , Commissioner ,County Attorney Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 97-41 A RESOLUTION CONCERNED WITH THE APPROVAL OF A FLOODPLAIN SPECIAL USE PERMIT FOR LAURENCE BRADLEY WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Laurence Bradley for construction of a single family dwelling on the following described tract of land: Lots 1 & 2, Block 7, Rifle Village South (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 18th day of February 1997, upon the question of whether the above-described Floodplain Special Use Permit should be granted or denied, at which hearing the public and inter were given the opportunity to express their opinions regarding the issuance of said Special Usgpttitarand WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is authorized permitting the use of the above described tract of land for the construction ofa single family dwelling, upon the following specific conditions: 1. That all representation of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. That the minimum, finished floor elevation of the residence shall be no less than 5324.2 feet. 3. That the foundation shall be cast -in-place reinforced concrete footers and stem walls and all foundation designs should be based on the site specific geotechnical soil and foundation investigations. 4. That site grading around the perimeter of the residence be such that there is a minimum grade of 10% for a minimum distance of 10 feet and all patios, driveways and sidewalks slope away from the house at a minimum grade of 2%. Beyond these features, the 10%/10 foot grade shall be continued. 5. That all foundation construction shall comply with the 1994 Uniform Building Code, as adopted by Garfield County. 6. That prior to the approval of a final/certificate of occupancy for the residence, the property owner shall submit an elevation certificate, signed and stamped by a licensed land surveyor, for the finished floor elevation of the single family dwelling unit. 7.
