Once the Board makes a decision regarding the Special Use request, Staff will provide the Applicant with a signed resolution memorializing the action taken by the Board, Following the Board's approval, this office will issue the Special Use Permit to the applicant. C) C )UN (Y BUILDING & PLANNING Mark Bean Garfield County Building and Planning Dept. 108 W. 8th Street Glenwood Springs, CO 81601 RE: Special Use Permit Application -Willow Ranch Dear Mark: The purpose of this letter is to request a Special Use Permit for residential building construction, excavation and landscaping within the Colborn property, also known as Willow Ranch. Willow Ranch contains approximately 27.54 acres of vacant/agricultural land and is located along C.R. 320, just east of the Rifle Village South Subdivision. A Special Use Permit is required since the property is located within the Helmer Gulch 100 -yr floodplain. The owners, Harry and Colleen Colborn, are requesting the permit to construct improvements, including rehabilitation and rock lining of the Helmer Gulch channel, pond/driveway/trail construction, overlot grading, vegetation management and a rock retaining wall. They are also requesting permission to manage vegetation and improve the C.R. 320 catch slope adjacent to their property. A Special Use Permit Plan depicting the proposed improvements and a list of adjacent property owners and mineral rights owners has been included with this application. The floodplain for this property has been mapped by the Federal Emergency Management Agency (FEMA FIRM CP #080205 1353 B) as Zone -A0, "Special flood hazard areas inundated by types of 100 -year shallow flooding where depths are between 1.0 and 3.0 feet; depths are shown, or areas of 100 -year alluvial fan flooding, depths and velocities shown, but no flood hazard factors are determined." Stormwater runoff velocities have been determined by FEMA to range from 4-6 fps within this flood zone. Wetlands within the property have been delineated by Bio -Environs, Inc., confirmed by the U.S. Army Corp of Engineers (USACE) and are mapped on the Special Use Permit Plan. The Applicant has applied to the USACE for the Nationwide Permits required for construction. Copies of the pertinent portions of the FEMA map, a letter from the USACE and the Nationwide Permit Application have been included with this application. The property is presently accessed from Village Drive. An old access appears to have been located off County Road 320 near the southeast comer of the property. Stopping sight distances for County Road 320 traffic will be well over 500 -feet at the proposed driveway access location. This driveway will be constructed in conjunction with the proposed site work. A copy of the driveway permit has been included with this letter. The proposed residence will be served potable water by the City of Rifle system main that traverses through the center of the property. The residence will utilize an engineered individual sewage disposal system since municipal sewer is located over 1000 -feet west of the proposed building site. Natural gas and electricity will be provided by Xcel Energy and telephone will be provided by Qwest Communications. The proposed single-family residence, landscaping, excavation and vegetation management will all work together to enhance the character of the property and the adjacent communities. Subject: Snowbird Ranch Subdivision, Rifle, Colorado On April 17`s, 2003, Bio -Environs, Inc. performed a routine wetland delineation according to the 1987 U.S. Army Corps of Engineers Wetlands Delineation Manual, on the Snowbird Ranch Subdivision in Rifle, Colorado. This property is located in the NE 1/4 of Section 20, T6S, R93W (Figure 1). It is 29.6 acres in size. Helmer Gulch flows north through the property from the south edge where it is culverted at County Road 32D. A spring located outside the property boundary to the west, is directed along the southwest border of the property by ditch and pipe. Presumably this spring was piped across Helmer Gulch to irrigate the southeast corner of the property. This pipe leaks considerably and adds to the flow of Helmer Gulch. Also situated on the property is tail -water from the Last Chance Ditch, located on the northeastern portion of the property and ending at Helmer Gulch. Wetlands were delineated inside the incised channel of Helmer Gulch as well as along the tail - water of Last Chance Ditch (Figures 2 and 3). Helmer Gulch is a low -gradient intermittent riverine system with sandy bottom and shows signsof flood events (debris and sediment deposits). It is fed from the hills above, the spring, storm run-off and snowmelt. At the time of investigation, sandy soils were saturated at the surface and we found water at a 16 -inch depth. After a small rainfall, water flowed with depths from 2 to 4 inches. Vegetation within the wetland area consists of willows (Salix sp.), sedges (Carex sp.) and rushes (Juncus sp.). Cottonwoods, elm, greasewood and brome grasses grow along the upper edges and on the terrace above the channel. Average channel width measured at the edge of the top terrace is 30 feet. The average width of the actual drainage and associated wetland is 10 feet. A dirt road constructed across the drainage and culverted, measures 20 feet of impact. This road is located just south of the junction of the tail -water ditch and Helmer Gulch. At the western end of the tail -water ditch is an area thick with cattails (Typha latifolia) and sedges (Carex sp.). Sedges grow along the length of the ditch. Standing water was found at the time of investigation, approximately 6 inches deep in the cattail area and shallower along the length of the ditch. Soils are sandy. This ditch contains abandoned tail -water and is considered jurisdictional. Soils on this site are in the Arvada series of the Ustollic Natrargids. They are well drained formed in alluvium derived from shales, and typically found on benches, terraces, and outwash fans. They are calcareous, strongly alkaline, typically moist and support greasewood, saltgrass, and alkali sacaton (SCS, 1977) (see Figure 4). In conclusion, these wetlands serve important functions such as ground water recharge, sediment and toxicant retention, shoreline anchoring, food chain support and wildlife habitat. Per our telephone conversation on July 28, 2003, Helmer Gulch is an ephemeral stream. The banks would be graded back at a maximum slope of 2:1 beginning at an elevation at least 12 - inches above the delineated wetland. Channel bank grading would extend through the property for a total distance of approximately 1650 -feet. Some portions of the banks would also be pushed back away from the wetlands to provide room for a 6-8 foot wide gravel foot trail. Based on our conversation, it is my understanding that a permit is not required for this work. A Nationwide Permit #18, `Minor Discharges', is requested for the construction of the water drops within the channel flowline. Each drop would be constructed of boulder material beginning at a depth approximately 12 -inches below the delineated wetland elevation and extended to a height of 24 -inches above the same elevation. The surface area of each drop would range from 80-100 square feet per drop. Since the total discharge of material below the delineated high water mark is limited at 25 cubic yards and 1/10 of an acre, it appears that six (6) to eight (8) drops could be constructed. All wetlands adjacent to the proposed earthwork would be lined with sediment control fencing prior to excavation. Water and gas mains presently cross the gulch near the center of the property. A Nationwide Pen -nit #12, `Utility Line Activities', is requested for the installation of additional residential utilities across the gulch at the same location and to rebuild the irrigation crossing near the Church property. A Nationwide Pennit, #27, `Stream and Wetland Restoration Activities', is requested for the creation of an open water impoundment in a non -tidal emergent wetland near the outfall of the Last Chance Ditch. Use of the Last Chance Ditch continues to decline as commercial and industrial development continues to press its banks to the east. As you are aware, the ditch and wetlands are littered with an abandoned vehicle and other rubbish. The owner desires to relocate the Last Chance Ditch along the northeast property boundary and construct a 1/3 acre pond. Approximately 0.17 acres of delineated wetlands would be affected by the construction. Wetland vegetation would be reestablished along the banks of the pond through transplanting and/or seeding. All excess excavated material would be placed and graded along the southern property boundary. Garfield County Vegetation Manager From: Lynn Cudlip Subject: Weed Management Plan: Willow Ranch Subdivision - Colborn Floodplain Special Use Permit On October 30, 2003 we reviewed Harry Colbom's property located in the NE1/4 of Section 20, T6S, R93W for noxious weeds as listed by Garfield County. In a letter to Boundaries Unlimited, Inc. the county requested applicant to inventory and map any noxious weeds listed by the Garfield County, and to prepare a weed management plan for the Willow Ranch subdivision. The county expressed concern regarding the presence of Russian olive on the north end of the property. The Russian olives that the county vegetation manager saw are on property to the north of the Colborn property. Likewise, tamarisk (saltcedar) was found on property east of the Colborn parcel and along the county road south of the parcel. Consequently, the concern regarding Russian olive being on the property is dispelled. The following provides a map of noxious weeds found on the property and the weed management plan for the Willow Ranch subdivision. Vegetation of the Willow Ranch Subdivision In general, the parcel's upland vegetation consists of cheatgrass (Anisantha tectorum) with sparsely interspersed greasewood (Sarcobatus vermiculatus) on the southern end and denser greasewood on the northern end of the property. At one time the parcel was marked for irrigation and production of hay. Since enough water could not reach the site, production was marginal and cheatgrass became dominant. Helmer Gulch, the main drainage that flows north through the western portion of the property, supports coyote willow (Salix exigua), cottonwood (Populus deltoides) and various grasses, sedges and rushes. This habitat was described in the wetland delineation report. A ditch flowing east near the church also supports willows. A ditch flowing west from the east boundary supports sedges, bulrushes, and cattails. Bordering the county road to the south of the parcel, is an upland area supporting rabbitbrush and some sagebrush. The shoulder of the county road is now being re- contoured with some of this vegetation being removed, and the area reseeded according to the revegetation plan. Noxious Weeds We compared plant species to those listed on the Garfield County noxious weed list and found only one species present — Russian knapweed (Acroptilon repens) (Figure 1). However, what dominates almost the entire site is cheatgrass. This grass species is an annual and colonizes disturbed areas. it is well adapted to fire and will thrive under conditions of recurring fire. Another alien species present on the property, but not listed by Garfield County is Chinese elm (Litmus pumila). Lastly, Russian thistle (Salsola australis) is present along the exiting entry road. This species is not on the county's list, but can be a nuisance. Weed Management Plan Since only one patch of the Russian knapweed was found, its control can be accomplished with appropriate measures. Russian knapweed revegetates by seed and root, and is therefore difficult to manage. An integrated approach is necessary and will include mechanical and chemical means along with appropriate revegetation. The patch, approximately 45 x 45 feet in size, is located along the existing entry road. The patch will be removed by track hoe and bucket. The material which has already flowered will be buried to a depth of 10 feet in the newly re-contoured slope along the county road. Although the seed bank and rootstock will remain in the soil, it will be buried too deep for germination and rooting. Burning onsite is not an option, since it abuts the cheatgrass and since fire conditions are extreme. In addition, the proposed revegetation seed mix will be planted on the re-contoured slope as well as at the site where the weeds were removed. This latter effort is most important; if no seed mix is planted, it is likely that the knapweed will reappear. Future maintenance of that site will include removal, by hand, of any new sprouts and spraying of an appropriate herbicide after the revegetation seed mix has established. Two years may pass before adequate coverage by the seed mix occurs (please refer to revegetation plan already provided to the county). Garfield County Vegetation Management or a licensed applicator will be asked for a recommended herbicide. A site map prepared by Boundaries Unlimited, Inc. (7/10/02) showed that the existing entry road will be removed and the area where the knapweed occurs now will be a developable lot. As such, potential landscaping with grass will prohibit the knapweed from re -occurring. Likewise, with the development of the Willow Ranch Subdivision, cheatgrass and Russian thistle will be removed as a result of landscaping. Mr. Colburn was shown the Russian olive, the tamarisk, and the Chinese elm. He stated that he can remove the two former species if for some reason they begin to occur on his property, and he will remove the two or three small Chinese elms that presently grow on his property. Cutting and application of the herbicide Garton to the stumps have proved successful. Since few noxious weeds were found on the property, their control can be accomplished, and revegetation of the site where the Russian knapweed occurs can happen at the time that revegetation of other sites occur. 2 ti; as XY x I� a REVEGETATION PROCEDURES ALL AREAS DISTURBED DURING CONSTRUCTION WILL BE REVEGETATED ACCORDING TO THE FOLLOWING CRITERIA. DURING CONSTRUCTION, EROSION WHICH MAY POSE A THREAT TO SURROUNDING PROPERTIES OR WATERWAYS WILL BE CONTAINED THROUGH THE USE OE TEMPORARY EROSION CONTROL MEASURES AS DEEMED NECESSARY TO COMPLY WITH GOVERNING AUTHORITIES. REVEGETATION OF DISTURBED AREAS SHALL COMMENCE IN THE FALL, PRIOR TO THE FIRST MAJOR SNOWFALL, OR EARLY SPRING IF SITE CONDITIONS ALLOW. EROSION CONTROL MEASURES ARE AIMED AT CONTROLLING/CONFINING SEDIMENT WITHIN OR NEAR THE AREA OF DISTURBANCE. THE LONG TERM STABILITY OF THESE AREAS WILL DEPEND ON THE ESTABLISHMENT OF APPROPRIATE GROUND COVER VEGETATION. THE PRIMARY GOAL OF THE REVEGETATION EFFORT IS TO PROTECT WATER QUALITY WHICH WILL REQUIRE A STURDY GROUND COVER AS SOON AS POSSIBLE. FOLLOWING ARE STANDARDS WHICH HAVE BEEN ESTABLISHED FOR REVEGETATION APPLICATION TECHNIQUES: 1. ALL TOPSOIL SHALL BE SALVAGED FROM DISTURBED AREAS, STOCKPILED AND RE—SPREAD PRIOR TO REVEGETATION. TOPSOIL SHOULD NOT BE RE—SPREAD ON AREAS OF THE SITE PROPOSED FOR FUTURE BUILDING. THE FINISHED SOIL SURFACE SHALL BE LEFT IN AN IRREGULAR, SCARIFIED CONDITION WHICH MAXIMIZES MOISTURE RETENTION ON THE SLOPE. STOCKPILES THAT ARE IN TENTED TO REMAIN IN PLACE FOR A PERIOD GREATER THAN 90—DAYS SHALL BE PREPARED WITH MINI BENCHES AND SEEDED. 2. WHERE SLOPE ALLOWS, SEED SHALL BE DRILLED OR OTHERWISE MECHANICALLY INCORPORATED INTO THE SOIL ("FARMED"). After reconsidering that, I believe that I made an error in my review. On page 2 of the Plan the applicant suggests that they will remove a 45 x 45 square foot patch of Russian knapweed by track hoe and bucket and then bury it to a depth of 10 feet in a newly re-contoured slope along the county road. My suggestion would be that the applicant first attempt to manage the knapweed with herbicides. Russian knapweed growth and proliferation is encouraged by mechanical disturbance. My concern is that the applicant may increase the problem in the area of the original infestation by using the back hoe and also in the area to which he moves the scrapped off topsoil to. NOW THEREFORE, for and in consideration of the mutual promises and covenants herein contained, the parties agree as follows: 1. Service Provided. At or prior to the first delivery of municipal service pursuant to this Contract, the Owners agrees to pay all system improvement fees at the out -of -City rate, Owners further agree to reimburse the City for all engineering, legal, and associated fees and costs it incurs in the review and implementation of this Contract. The City reserves the right to modify these charges or regulations. 6. No Precedential Value. Nothing herein shall obligate the City to extend additional service to the Owners or to the Property, other than that service described in Paragraph 1, above. There shall be no expansion of such service without the express written consent of the City. 7. Service Subject to Municipal Code: Termination for Breach. The extension of municipal service under this Agreement is subject to all requirements of the Rifle Municipal Code applicable to the supplying of such services now in effect or as hereafter amended. A failure by the Owners to comply with all applicable provisions of the Rifle Municipal Code or with the terms of this Contract shall constitute a material breach, and the City shall be entitled to terminate this Contract upon such a breach and/or to discontinue the municipal services provided hereunder. 8. Annexation. To the maximum extend permitted by law, the parties agree that this Contract, pursuant to C.R.S. §31-12-121, constitutes an enforceable obligation upon the Owners, their successors, and assigns to annex the Property as required under the terms hereof. At such time as the Property is eligible for annexation to the City, as prescribed by statute or ordinance, and as determined by the City, the Owners shall submit a petition for annexation to the City to annex the Property to the City. The Owners may annex their Property in conjunction with adjoining property owners; provided, however, that a petition for annexation is filed within sixty (60) days of the time the Owners' Property becomes eligible for annexation. The Owners shall pay all costs for review of the annexation petition, as required by the Rifle Municipal Code (currently Section 17.02.160). The passage of time between the eligibility of the Property for annexation and the time the City requests the Owners file a petition for annexation shall not constitute a waiver of the City's right to enforce, or estop the City from enforcing, the Owners' obligations under this paragraph. As required by Section 17.02.155 of the Rifle Municipal Code, the Owners will be required to submit a radiation hazards report with their petition for annexation or petition for annexation election. 9. Payment of Impact Fees. Prior to the provision of services to the Property, Owners agree to pay the impact fees in effect at the time of execution prescribed by the Rifle Municipal Code and City Resolutions for the single family residence to be constructed on the Property. Therefore, Owners shall pay a water rights dedication fee, currently $200.00, a parkland dedication fee, currently $980.00, and an offsite street impact fee, currently $3,762.00. Owners further agree to pay at the time of annexation all applicable offsite street impact fees and parkland dedication fees for the Property in the amounts set forth under I:120031Clients\ Rifle \R-3(288)Colborn\Agreements\Pre-Annexation. wpd Page 2 of 6 Resolution No. 25, Series of 1995 and Resolution No. 6, Series of 2000, or as hereafter amended, and any other fees prescribed by Resolution, Ordinance or policy as may apply to annexations for any further development on the Property beyond the single family residence contemplated by this Agreement. 10. Termination Upon Annexation. This Contract shall terminate automatically on the effective date of the annexation to the City of the Property; provided, however, that nothing in this paragraph shall limit any other rights of termination provided in this Contract. Upon termination after annexation, service to the Property shall be provided pursuant to the Rifle Municipal Code and all applicable rules and regulations. Until annexation, nothing herein shall be construed as obligating the City to provide additional taps of any kind to the Owners of the Property. 11. Districts. The Owners, upon execution of this Contract and at any time thereafter, shall join in any street, curb, sidewalk, or other improvement district which may be formed by the City and which affects the Property. 12. Park District. Pursuant to Rifle Municipal Code Section 17.02.230, the Owners' petition for annexation pursuant to Paragraph 9 shall be accompanied by a petition to include the Property within the Rifle Metropolitan Park District. 13. Failure or Refusal to Annex. In the event the Owners fail to annex their Property to the City as required by this Contract, the City may, at its sole option and without otherwise limiting its legal rights, bring an action at law or equity, including an action for specific performance, to enforce the terms of this Contract, discontinue providing municipal service(s) to the Property, or treat this Contract as a petition for annexation and annex the Property without consent after thirty (30) days' written notice to Owners. The rights and remedies under this paragraph shall be cumulative. To the extent permitted by law, the Owners hereby appoint the City Clerk as their attorney-in-fact to execute and deliver all documents necessary to annex Owners' Property to the City, should the Owners fail or refuse to annex as required under this Contract. If the City proceeds to annex the Owners' Property as permitted under this paragraph, it may advance all fees and costs related to the annexation, and shall be entitled to recover the same as a personal obligation of the Owners. Such fees and costs shall also constitute a lien against the Owners' Property, which may be foreclosed as provided by law. 14. Lien Rights. The City shall be entitled to prepare and record a lien against the Owners' Property for the amount of any costs, fees, and other expenses which it has advanced or which the Owners are required to be pay pursuant to this Contract and/or the Rifle Municipal Code. Such costs and fees include, but are not limited to, system improvement fees, user fees, recording, annexation, and staff review and document preparation fees and costs; and engineering and attorneys' fees. 15. Time of Connection. The Owners shall, at their expense, connect to the offered City service pursuant to the Rifle Municipal Code within one (1) year of the date of execution 1:120031Ciients\Rifle\R-3(288)Colborn\Agreements\Pre-Annexation. wpd Page 3 of 6 of this Contract and said connection shall comply with the requirements of the City of Rifle Public Works Manual. In the event the Owners do not make such connection within such one- year time period, this Contract shall be null and void and of no precedential value, and all parties relieved of all obligations hereunder; provided, however, that if the City physically connects the offered City service to the Owners' Property after one (1) year, the fact of connection shall constitute a waiver of the time limit contained in this paragraph, and a bonafide purchaser of the Owners' Property shall be entitled to rely thereon. 16. No Guarantee of Fire Flows. Nothing herein shall be construed to obligate the City to provide adequate fire flows for residences or developments outside the City which receive City water or sewer services hereunder. 17. Miscellaneous. The parties agree time is of the essence in the implementation of this Contract. All of the terms and conditions of this Contract shall bind the heirs, successors, assigns, or personal representatives of the parties hereto. This Contract constitutes a covenant which runs with the real Property. This Contract sets forth the entire understanding between the parties, and any previous agreements, promises, or understandings have been included in this Contract. 18. Recording; Fees. The City shall record this Contract upon execution. The Owners shall simultaneously with the execution of this Contract tender to the City the actual amount of recording fees. (Checks shall be payable to the Garfield County Clerk and Recorder.) 19. Affidavits. Upon completion or satisfaction by the Owners, or their successor in title, of all of the terms and conditions of this Contract, the City Manager is authorized to prepare an affidavit to that effect, which the Owners may record with the Garfield County Clerk and Recorder. If the Owners do not connect to the offered City services within the time limit in Paragraph 15, the City shall have the right to record a notice of the termination of this Contract. 20. Regulatory Jurisdiction. The City shall have the right to terminate this Contract in its sole discretion in the event the Colorado Public Utility Commission, the Garfield County Commissioners, or any other governmental entity or body asserts regulatory jurisdiction over the rates, fees, or charges the City imposes pursuant to this Contract. 21. Additional Conditions of Service. A. Owners agree to comply with the setback requirements of the City's LDR Zone District when constructing the proposed single-family residence on the Property to which services will be provided, and the Owners shall comply with all building codes adopted by the City; provided, however, if a conflict exists between the City's building codes and the Garfield County building codes, the Garfield County building codes shall control for such conflict.
